a. Functions of the Committee
(derived from Standing Orders [DSO 82A; SSO 70A])
(1)
The Select Committee shall consider and report to the Dáil on—
(a) such aspects of the expenditure, administration and policy of the
relevant Government Department or Departments and associated
public bodies as the Committee may select, and
(b) European
Union
matters
within
the
remit
of
the
relevant
Department or Departments.
(2)
The Select Committee may be joined with a Select Committee
appointed by Seanad Éireann to form a Joint Committee for the
purposes of the functions set out below, other than at paragraph (3),
and to report thereon to both Houses of the Oireachtas.
(3)
Without prejudice to the generality of paragraph (1), the Select
Committee shall consider, in respect of the relevant Department or
Departments, such—
(a) Bills,
(b) proposals contained in any motion, including any motion within
the meaning of Standing Order 164,
(c) Estimates for Public Services, and
(d) other matters as shall be referred to the Select Committee by the
Dáil, and
(e) Annual Output Statements, and
(f) such Value for Money and Policy Reviews as the Select Committee
may select.
(4)
The Joint Committee may consider the following matters in respect of
the relevant Department or Departments and associated public
bodies, and report thereon to both Houses of the Oireachtas:
(a) matters of policy for which the Minister is officially responsible,
(b) public affairs administered by the Department,
(c) policy issues arising from Value for Money and Policy Reviews
conducted or commissioned by the Department,

(d) Government policy in respect of bodies under the aegis of the
Department,
(e) policy issues concerning bodies which are partly or wholly funded
by the State or which are established or appointed by a member
of the Government or the Oireachtas,
(f) the general scheme or draft heads of any Bill published by the
Minister,
(g) statutory instruments, including those laid or laid in draft before
either House or both Houses and those made under the European
Communities Acts 1972 to 2009,
(h) strategy statements laid before either or both Houses of the
Oireachtas pursuant to the Public Service Management Act 1997,
(i) annual reports or annual reports and accounts, required by law,
and laid before either or both Houses of the Oireachtas, of the
Department or bodies referred to in paragraph (4)(d) and (e) and
the overall operational results, statements of strategy and
corporate plans of such bodies, and
(j) such other matters as may be referred to it by the Dáil and/or
Seanad from time to time.
(5)
Without prejudice to the generality of paragraph (1), the Joint
Committee shall consider, in respect of the relevant Department or
Departments—
(a) EU draft legislative acts standing referred to the Select Committee
under Standing Order 105, including the compliance of such acts
with the principle of subsidiarity,
(b) other proposals for EU legislation and related policy issues,
including programmes and guidelines prepared by the European
Commission as a basis of possible legislative action,
(c) non-legislative documents published by any EU institution in
relation to EU policy matters, and
(d) matters listed for consideration on the agenda for meetings of the
relevant EU Council of Ministers and the outcome of such
meetings.

(6)
A sub-Committee stands established in respect of each Department
within the remit of the Select Committee to consider the matters
outlined in paragraph (3), and the following arrangements apply to
such sub-Committees:
(a) the matters outlined in paragraph (3) which require referral to the
Select Committee by the Dáil may be referred directly to such
sub-Committees, and
(b) each such sub-Committee has the powers defined in Standing Order
83(1) and (2) and may report directly to the Dáil, including by way of
Message under Standing Order 87.
(7)
The Chairman of the Joint Committee, who shall be a member of Dáil
Éireann, shall also be the Chairman of the Select Committee and of
any sub-Committee or Committees standing established in respect of
the Select Committee.
(8)
The following may attend meetings of the Select or Joint Committee,
for the purposes of the functions set out in paragraph (5) and may
take part in proceedings without having a right to vote or to move
motions and amendments:
(a) Members of the European Parliament elected from constituencies
in Ireland, including Northern Ireland,
(b) Members of the Irish delegation to the Parliamentary Assembly of
the Council of Europe, and
(c) at the invitation of the Committee, other Members of the
European Parliament.

b. Scope and Context of Activities of Committees
(as derived from Standing Orders [DSO 82; SSO 70])
(1)
The Joint Committee may only consider such matters, engage in such
activities, exercise such powers and discharge such functions as are
specifically authorised under its orders of reference and under Standing
Orders.
(2)
Such matters, activities, powers and functions shall be relevant to, and
shall arise only in the context of, the preparation of a report to the Dáil
and/or Seanad.
(3)
It shall be an instruction to all Select Committees to which Bills are
referred that they shall ensure that not more than two Select Committees
shall meet to consider a Bill on any given day, unless the Dáil, after due
notice given by the Chairman of the Select Committee, waives this
instruction on motion made by the Taoiseach pursuant to Dáil Standing
Order 26. The Chairmen of Select Committees shall have responsibility for
compliance with this instruction.
(4)
The Joint Committee shall not consider any matter which is being
considered, or of which notice has been given of a proposal to consider, by
the Committee of Public Accounts pursuant to Dáil Standing Order 163
and/or the Comptroller and Auditor General (Amendment) Act 1993.
(5)
The Joint Committee shall refrain from inquiring into in public session or
publishing confidential information regarding any matter if so requested,
for stated reasons given in writing, by—
(a)
a member of the Government or a Minister of State, or
(b)
the principal office-holder of a body under the aegis of a
Department or which is partly or wholly funded by the State or
established or appointed by a member of the Government or by
the Oireachtas:
Provided that the Chairman may appeal any such request made to the
Ceann Comhairle / Cathaoirleach whose decision shall be final.

Order establishing a Sub-Committee to examine the workings and current status
of the on-going implementation of the 20 Year strategy for the Irish Language
2010 – 2030 and related matters
Ordered on 16 April 2013:“That a Sub-Committee will be established, in accordance with the Terms of
Reference of the Joint Committee on Environment, Culture and the Gaeltacht,
(that will be called the Sub-Committee on the 20 Year Strategy for the Irish
Language 2010 – 2030 and Related Matters) to examine the workings and
current status of the on-going implementation of the 20 Year strategy for the
Irish Language 2010 – 2030 and related matters.”

Concerning the Sub-Committee:1) The Sub-Committee will continue in existence as long as the Joint
Committee continues in existence.
2) The Sub-Committee may put draft report(s) before the Joint Committee
when this is necessary.
3) The Sub-Committee may issue invitations to witnesses to appear before it
and present evidence to it.
4) The Sub-Committee may seek submissions from the public, including from
individuals and from organisations.
5) The following are the 7 members of the Sub-Committee (updated 14 July
2015):

6) The quorum of the Sub-Committee will be 2 members, one of whom will
be a Member of Dáil Éireann and one of whom will be a Member of Seanad
Éireann.
7) The Sub-Committee shall have the power, in accordance with Standing
Order 83(8) (Dáil Éireann) and Standing Order 71(8) (Seanad Éireann) to
employ consultants, subject to permission from the Joint Committee.
8) The Sub-Committee shall have the power, in accordance with Standing
Order 83(9) (Dáil Éireann) and Standing Order 71(9) (Seanad Éireann) to
undertake travel, subject to permission from the Joint Committee.

Dáil Standing Order 83
Powers of Select Committees.
83. Without prejudice to the generality of Standing Order 82, the Dáil may confer
any or all of the following powers on a Select Committee:
(1) power to take oral and written evidence and to print and publish from time to
time minutes of such evidence taken in public before the Select Committee
together with such related documents as the Select Committee thinks fit;
(2) power to invite and accept oral presentations and written submissions from
interested persons or bodies;
(2A) power to send for persons, papers and records;
(3) power to appoint sub-Committees and to refer to such sub-Committees any
matter comprehended by its orders of reference and to delegate any of its powers
to such sub-Committees, including power to report directly to the Dáil;
(4) power to draft recommendations for legislative change and for new
legislation;
(4A) power to examine any statutory instrument, including those laid or laid in
draft before either House or both Houses and those made under the European
Communities Acts 1972 to 2009, and to recommend, where it considers that such
action is warranted, whether the instrument should be annulled or amended;
(4B) for the purposes of paragraph (4A), power to require any Government
Department or instrument-making authority concerned to submit a Memorandum
to the Select Committee explaining any statutory instrument under consideration
or to attend a meeting of the Select Committee for the purpose of explaining any
such statutory instrument: Provided that such Department or authority may
decline to attend for stated reasons given in writing to the Select Committee,
which may report thereon to the Dáil;
(5) power to require that a member of the Government or Minister of State shall
attend before the Select Committee to discuss policy for which he or she is
officially responsible: Provided that a member of the Government or Minister of

State may decline to attend for stated reasons given in writing to the Select
Committee, which may report thereon to the Dáil: and provided further that a
member of the Government or Minister of State may request to attend a meeting
of the Select Committee to enable him or her to discuss such policy;
(6) power to require that a member of the Government or Minister of State shall
attend before the Select Committee to discuss proposed primary or secondary
legislation (prior to such legislation being published) for which he or she is
officially responsible: Provided that a member of the Government or Minister of
State may decline to attend for stated reasons given in writing to the Select
Committee, which may report thereon to the Dáil: and provided further that a
member of the Government or Minister of State may request to attend a meeting
of the Select Committee to enable him or her to discuss such proposed
legislation;
(6A) power to require that a member of the Government or Minister of State shall
attend before the Select Committee and provide, in private session if so
requested by the member of the Government or Minister of State, oral briefings
in advance of meetings of the relevant EU Council of Ministers to enable the
Select Committee to make known its views: Provided that the Committee may
also require such attendance following such meetings;
(6B) power to require that a member of the Government or Minister of State who
is officially responsible for the implementation of an Act shall attend before the
Select Committee in relation to consideration of a report under Standing Order
141A;
(7) subject to any constraints otherwise prescribed by law, power to require that
principal office holders in bodies in the State which are partly or wholly funded by
the State or which are established or appointed by members of the Government
or by the Oireachtas shall attend meetings of the Select Committee, as
appropriate, to discuss issues for which they are officially responsible: Provided
that such an office holder may decline to attend for stated reasons given in
writing to the Select Committee, which may report thereon to the Dáil;
(8) power to engage, subject to the consent of the Houses of the Oireachtas
Commission, the services of persons with specialist or technical knowledge, to
assist it or any of its sub-Committees in considering particular matters; and

(9) power to undertake travel, subject to—
(a) such recommendations as may be made by the Working Group of
Committee Chairmen under Standing Order 100(2)(a); and
(b) the consent of the Houses of the Oireachtas Commission, and normal
accounting procedures.
Dáil Standing Order 87
Messages from Select Committees in relation to Bills or Estimates.
87. Where a Select Committee shall have completed its consideration of a Bill or
Estimate referred to it by the Dáil, the Committee shall send a Message to this
effect to the Dáil. Such Messages shall be in writing, signed by the Clerk to the
Committee, and shall be addressed to the Clerk of the Dáil. Messages from Select
Committees shall be received by the Clerk of the Dáil. The Ceann Comhairle shall,
at the first convenient opportunity, communicate any such Message to the Dáil.

Dáil Standing Order 105
Draft legislative acts: eight week limit to express opinion on infringement of
subsidiarity (“yellow and orange card”).
105.
(1) In accordance with Article 6 of Protocol No. 2 to the Treaty on European Union
and the Treaty on the Functioning of the European Union (Protocol on the Application
of the Principles of Subsidiarity and Proportionality) as applied by section 7(3) of the
European Union Act 2009, the Dáil may empower a Select Committee to form a
reasoned opinion that a draft legislative act (within the meaning of Article 3 of the
said Protocol) does not comply with the principle of subsidiarity.
(2) All draft legislative acts forwarded to the Dáil under Article 4 of the said Protocol
shall stand referred to a Select Committee empowered under this Standing Order.
(3) It shall be an instruction to a Select Committee empowered under this
Standing Order that—
(a) in forming a reasoned opinion on whether a draft legislative act
complies with the principle of subsidiarity, the Committee shall consult
with such other Committees and such stakeholders as it considers
appropriate;
(b) where the Committee is of the opinion that a draft legislative act does
not comply with the principle of subsidiarity, it shall submit a reasoned
opinion to this effect by way of a report which shall be laid before the Dáil;
and
(c) where a report has been laid by the Committee under paragraph (3)(b)
of this Standing Order, the Chairman shall forthwith table a motion
thereon under section 7(3) of the European Union Act 2009, and such
motion shall be given priority on the Order Paper in accordance with
Standing Order 28;
Provided that the Dáil may substitute, add to or otherwise vary, the reasoned
opinion set out in the Committee’s report by way of amendment to the motion
tabled by the Chairman under this paragraph.

(4) Where the Dáil agrees a motion tabled pursuant to paragraph (3)(c) of this
Standing Order, either with or without amendment, the Ceann Comhairle shall cause a
copy of—
(a) the Resolution agreed by the Dáil,
(b) the reasoned opinion agreed by the Dáil, and
(c) the report of the Committee referred to in paragraph (3)(c),
to be sent to the Presidents of the European Parliament, the Council and the
Commission.

Dáil Standing Order 163
Committee of Public Accounts.
163.
(1) There shall stand established, following the reassembly of the Dáil subsequent
to a General Election, a Standing Committee, to be known as the Committee of
Public Accounts, to examine and report to the Dáil upon—
(a) the accounts showing the appropriation of the sums granted by the
Dáil to meet the public expenditure and such other accounts as they see fit
(not being accounts of persons included in the Second Schedule of the
Comptroller and Auditor General (Amendment) Act 1993) which are
audited by the Comptroller and Auditor General and presented to the Dáil,
together with any reports by the Comptroller and Auditor General thereon:
Provided that in relation to accounts other than Appropriation Accounts,
only accounts for a financial year beginning not earlier than 1 January,
1994, shall be examined by the Committee;
(b) the Comptroller and Auditor General's reports on his or her
examinations of economy, efficiency, effectiveness evaluation systems,
procedures and practices; and
(c) other reports carried out by the Comptroller and Auditor General under
the Act.
(2) The Committee may suggest alterations and improvements in the form of the
Estimates submitted to the Dáil.
(3) The Committee may proceed with its examination of an account or a report of
the Comptroller and Auditor General at any time after that account or report is
presented to Dáil Éireann.
(4) The Committee shall have the following powers:

(a) power to send for persons, papers and records as defined in Standing
Order 83(2A) and Standing Order 85;
(b) power to take oral and written evidence as defined in Standing Order
83(1);
(c) power to appoint sub-Committees as defined in Standing Order 83(3);
(d) power to engage consultants as defined in Standing Order 83(8); and
(e) power to travel as defined in Standing Order 83(9).
(5) Every report which the Committee proposes to make shall, on adoption by the
Committee, be laid before the Dáil forthwith whereupon the Committee shall be
empowered to print and publish such report together with such related
documents as it thinks fit.
(6) The Committee shall present an annual progress report to Dáil Éireann on its
activities and plans.
(7) The Committee shall refrain from—
(a) enquiring into in public session, or publishing, confidential information
regarding the activities and plans of a Government Department or office,
or of a body which is subject to audit, examination or inspection by the
Comptroller and Auditor General, if so requested either by a member of
the Government, or the body concerned; and
(b) enquiring into the merits of a policy or policies of the Government or a
member of the Government or the merits of the objectives of such
policies.
(8) The Committee may, without prejudice to the independence of the
Comptroller and Auditor General in determining the work to be carried out by his
or her Office or the manner in which it is carried out, in private communication,
make such suggestions to the Comptroller and Auditor General regarding that
work as it sees fit.

(9) The Committee shall consist of thirteen members, none of whom shall be a
member of the Government or a Minister of State, and four of whom shall
constitute a quorum. The Committee and any sub-Committee which it may
appoint shall be constituted so as to be impartially representative of the Dáil.
Dáil Standing Order 164
Approval of International Agreements involving Charges on Public Funds.
164.
(1) Where approval by the Dáil of the terms of any international agreement
involving a charge upon public funds is required, a motion to that effect may be
made by a member of the Government or Minister of State.
(2) Subject always to the requirement of Article 29.5.2° of the Constitution,
nothing in this Standing Order shall preclude the referral of a proposal contained
in any such motion to a Select Committee for its consideration.
Privilege
Notice read to witnesses attending a public meeting of the committee
I draw the attention of witnesses to the fact that by virtue of section 17(2)(l) of
the Defamation Act 2009, witnesses are protected by absolute privilege in respect
of their evidence to the committee. However, if they are directed by the
committee to cease giving evidence on a particular matter and they continue to
so do, they are entitled thereafter only to a qualified privilege in respect of their
evidence. They are directed that only evidence connected with the subject matter
of these proceedings is to be given and they are asked to respect the
parliamentary practice to the effect that, where possible, they should not criticise
or make charges against any person, persons or entity by name or in such a way
as to make him, her or it identifiable. Members are reminded of the long-standing
parliamentary practice to the effect that they should not comment on, criticise or
