Building Appeals Board Application Guide The Building Appeals Board is established under section 166 of the Building Act 1993 (the Act) and is empowered to determine any matter relating to the Building Regulations 2006, the Building Code of Australia and specified sections of the Act. The Building Appeals Board hears appeals and disputes in relation to building control matters and can waive, modify or vary the provisions of particular regulations or the Building Code of Australia based upon the particular circumstances. The Building Appeals Board generally operates in panels (usually 3 or more members) of its members to consider specific matters brought before the board. Membership The Building Appeals Board comprises a Chairperson, a Deputy Chairperson and as many members as the Minister considers necessary to fulfil its statutory function. Members are appointed as legal members, consumer representatives, or persons with building industry experience. Members are expected to behave in a professional manner at all times, acting with integrity, identifying and appropriately managing any possible conflicts of interest and earning the trust and respect of others. Members are expected to communicate well with people from diverse backgrounds, seek and listen to the views of others, participate in constructive debate and make objective, considered decisions based on all relevant facts. Members are also required to have knowledge of the building legislation and the jurisdiction of the Building Appeals Board and understand the concept of natural justice. Positions Available The Minister is seeking to appoint a Chairperson, Deputy Chairperson and up to 30 members to the Building Appeals Board. Expressions of interest are sought from individuals with the relevant knowledge, skills and experience. Chairperson Candidates will possess a strong reputation as a dynamic leader with exemplary levels of professional credibility and integrity. The successful candidate will possess knowledge of and familiarity with the Victorian building industry combined with a commitment to the betterment of the industry. Members The Building Appeals Board can comprise as many members as the Minister considers necessary and are appointed under one of the following categories: Building Appeals Board Legal representatives- candidates must be an Australian lawyer within the meaning of the Legal Profession Act 2004 of at least 5 years standing. Sound building industry and regulatory knowledge together with strong administrative law experience will be a distinct advantage. Building industry experience – candidates are expected to possess considerable experience in or related to the building industry and more specifically, have an established reputation in building control matters. Applicants with qualifications and experience in one or more of the following areas will be considered favourably: - building surveyors civil engineers fire safety engineers domestic or commercial builders architects town planners. Time Commitment and Meeting Schedule Members are appointed on a part-time basis and will be appointed for a fixed term as determined by the Governor in Council, up to a maximum of three years. Members are required to attend regular Board meetings in addition to serving as a panel member. Hearings (which may be in person or paper based) are generally conducted every Thursday commencing at 9.00am and run about 3 hours. Each member is generally expected to participate in two panel hearing days per month outlined by way of a roster. Members are required to attend on hearing days from 8.30am to allow preparation for hearings. Members may also be required to consider documentary material and work with Panel members and the Commission support team on preparation of determinations on non-hearings days. Panel hearing days will generally conclude by 1.00pm but it may in some cases be necessary for Panels to sit for longer periods to complete the Board’s business. Meetings are held at the office of the Victorian Building Authority which is located in the Goods Shed North, 733 Bourke Street, Docklands. Remuneration and Allowances Remuneration of members is provided on a sessional basis in accordance with Government guidelines. Remuneration for members of the Building Appeals Board is currently set at $371 per sitting day for the chairperson and $317 per sitting day for eligible members. Remuneration per half sitting day (less than 4 hours) is 50% of the full day amount. In accordance with clause 2 of Schedule 3 of the Building Act travelling and other allowances are fixed at the rates that apply to the Victorian Building Authority. As a guide, payment is made for the following: attendance at meetings, including official committee meetings of the Board and other necessary activities, such as site visits conducted as part of Inquiries; and formal meetings with industry representatives. Payment will not be made for: individual research or reports not authorised by the Board; or preparation time for meetings (this has been incorporated into the fee). © The State of Victoria Department of Environment, Land, Water and Planning 2015 Building Appeals Board Members will be provided with the minimum level of superannuation provided for under the Superannuation Guarantee (Administration) Act 1992 (Cth). In accordance with government policy, public sector employees (including state, federal and local government bodies) will only be entitled to remuneration if they are not employed in executive officer or equivalent position and their duties on the board will be performed outside their current position.
