Application for the grant of a AQUARIUM TRADER LICENCE

Information Relating to the Application
This form is to be used by a person who wishes to apply for a Aquarium Trader licence.
This is an Application only – once your application has been processed you will be advised of the decision.
You are not permitted to carry out any activities in relation to this application until you have been advised
of the decision.

(Note: Under Regulation 206 the Minister may prescribe fees)

199 Sale, purchase and exhibition of live fish and aquatic life
1) A person may sell fish or aquatic life for use in an aquarium if he or she holds an Aquarium Trader licence.
1A) A person may keep live fish and aquatic life for the purpose of exhibiting them for profit in the Territory if the
person holds an Aquarium Trader licence.
2) An Aquarium Trader licensee must not purchase fish or aquatic life except:
(a) From an Aquarium Fishing/Display Fishery licensee; or
(b) From an Aquarium Trader licensee; or
(c) From an Aquaculture licensee; or
(d) Under and in accordance with a permit; or
(e) From an interstate or overseas supplier.
200 Place of trade to be set out in licence
1) An Aquarium Trader licensee shall not hold fish for sale or sell fish except at a place specified in the
licence.
2) The Director shall not grant an Aquarium Trader licence in respect of a domestic dwelling unless the
dwelling will not contravene control plans under the Planning Act.
201 Licence to be displayed
An Aquarium Trader licensee shall display, in a prominent position at each of the places specified on the
licence, the number and expiry date of the licence.
201A Notification of exhibition
1) An Aquarium Trader licensee must not exhibit live fish or aquatic life for profit at a place that is not specified
in the licence unless the licensee has notified the Director.
2) The notification must be in writing and give details of the address of the place where the live fish or aquatic
life are to be exhibited.
3) If the Aquarium Trader ceases to exhibit fish or aquatic life at the place, the Aquarium Trader must immediately
notify the Director in writing of the cessation.

26 Permit to import fish or aquatic life
1) The Director may, in accordance with this Division, grant to an applicant a permit to import live fish or live
aquatic life into the Territory.
2) The Director shall not grant a permit to import fish or aquatic life:
(a) Unless that species of fish or aquatic life:
(i)
is indigenous to the Territory;
(ii)
is in pursuance of section 303EB of the Environment Protection and Biodiversity Conservation
Act 1999 of the Commonwealth taken to be suitable for live import; or
(iii)
is specified in Schedule 7; and
(b) If, in his or her opinion:
(i)
there may be a risk of disease to people, fish or aquatic life by the importation;
(ii)
there may be a risk of variation of the genetic composition or genetic material of Territory fish or
aquatic life by the importation;
(iii)
the fish or aquatic life to be imported may adversely affect the diversity of genetic material within
the Territory; or
(iv)
the fish or aquatic life may present an unacceptable risk of detriment to other fish or aquatic life
in the Territory.

Instructions for completing an application
for an Aquarium Trader Licence
1. Before completing the form read these instructions. Please use BLOCK LETTERS when completing this
form.
2. The application can be in the name of a company, partnership or individual.
3. If the licence is to be in an individual or partnership complete the application on the top left hand side.
Individual person – Photographic identification: i.e. Driver’s licence or passport.
Partnership - Photographic identification for each partner: i.e. Drivers licence or passport.
Company or Corporation – Copy of Certificate of Incorporation (AD-HOC Statement) requested by a Director;
available from Australia Security & Investment Commission. Current company extract listing directors required
– fee payable. ASIC search or use the link below.

4. Trading outlet No.1 and Trading outlet No. 2 are physical locations where the business is to be operated
from. This is the name of the shop or business as displayed to the public. If you have more than 2 trading
outlets you will need to use an additional application.
5. An appointee is the person who will be physically in charge of the facility. You may own the business but you
have a manager operating it for you. The manager will be the appointee. If you are the owner and the
operator you are still required to complete the Trading outlet details. The appointee must sign in this section.
If you have a second facility you are physically unable to be at 2 different locations at any one time.
Therefore, you will have to appoint a second person for trading outlet No. 2. Proof if Identity will be required
for the appointees in trading locations.
6. Make sure the application in signed by all applicant’s and appointees.
7. To import fish from interstate, a Section 16 Translocation Permit application form must be completed and
approved prior to importation.
8. If you are receiving aquatic life from the public, a Section 17 Permit application form must be completed and
approved prior to receiving any aquatic life.
9. If you are intending to export your product overseas then you will require a licence from AQIS. Contact
numbers are 89207021 or 89207039.
10. The Development Assessment Services of the Department Planning and Infrastructure is to be consulted
regarding any license to operate from a residential or industrial block. An Aquarium Trader licence will not be
issued unless approvals are presented with the licence application.
