A separate, written regulators report is still pending due technical problems. It is in the process of being recovered and will be provided as soon as possible.

A. Equivalent Means of Securement – Airgaz Safecor

As a follow up on previous Forum action, the Regulators Group was asked if anyone had been contacted by Airgaz Safecor. The response was negative.

B. 12-013-VEH Shrink Wrap Used to Secure or Unitize Loads

This item had been closed at the previous Forum meeting. In reviewing what had been discussed Forum attendees felt there was value in providing some limited guidance on the proper use of stretch film to both industry and enforcement.

A proposal was made to develop a question and answer to be put into Operational Policy 15.

After some discussion, development of the proposed wording was deferred. Later in the day the issue was discussed again.

Forum Action: The following wording was approved to be submitted to the Vehicle

Committee:

Is stretch film and/or shrink-wrap an acceptable means of unitizing cargo?

Yes. As long as all of the individual articles in the unit of cargo remain secured inside the surface of the material.

E. 13-045 VEH - Securement of Equipment with Hydraulic Shovels or Accessory

Attachments that the Manufacturer Deems Adequate

Although the issue had been closed, Forum attendees raised some concerns with the application of the principle that: in the absence of any damage or apparent imminent failure, anchor points designated by the manufacturer can be used as the manufacturer intended. The discussion raised concerns with the lack of a recognizable symbol to indicate what might be an anchor point, and the fact that many markings that are visible on new equipment are often no longer visible once the vehicle has been in service for some time. Also in many cases, the steel tracks on tracked vehicles are suitable anchor points, and are never marked.

Forum Action: The clarification that was made is that, acceptable use of designated anchor points does not apply to heavy equipment, as defined in the regulations.

A. 14-001-VEH - Cargo Securement - Ice & Snow Buildup

The issue sought to address ice and snow build-up on vehicles through the cargo securement regulations. Forum attendees discussed the issue and although all agreed that this is a perpetual problem, it was difficult to address due to the limitations on a driver’s ability to correct such conditions. Jurisdictions provided examples of how the issue was treated locally, the common denominator was that snow cannot be considered Cargo.

Forum Action: Forum attendees agreed that since the material is not cargo, no action could be taken on the issue request.

A. 09-017-VEH: OOSC, Part II, 7. Securement of Cargo, h. (4) - Remove Defect

Classification Table for Cargo Securement Webbing & 04-014-VEH: Clarification of

OOSC 393.104(b) – Vertical Cuts

FMCSA provided an update on previous cargo securement strap and strap defect testing in

October 2012 utilizing the services of Accutek Laboratories in Ohio. Further testing is planned to determine the ultimate strength of both used and new straps when defects as described in the OOSC Tie down defect table are incorporated into the straps.

Forum Action: Forum attendees support the ongoing testing and expect to receive a copy of the final results.

B. 11-030-VEH: Securing Metal Coils in Sided Vehicles

The issue has previously been taken off the Forum and the Vehicle Committee agendas when a petition was proposed. It was subsequently decided by the CVSA Executive that a letter of interpretation was a more suitable way to resolve the concern. Follow up on the status of that communication will be undertaken by CVSA staff.

Forum Action: Forum attendees support the request for a letter of interpretation for

FMCSA.

C. 11-043-VEH: Marking and Rating of Tiedowns - WLL on Hooks

The National Association of Chain Manufacturers (NACM) continues work to ratify the document that outlines the performance specifications and marking of removable hooks used in tiedown assemblies.

Forum Action: Forum attendees anticipate further progress on document approval.

D. 12-033-VEH - NSC Standard 10 - Section 89(2) Accessory Equipment

This issue sought clarification of the intent of section 89(2) as it applies to bulldozer and grader blades. After identifying that the concern primarily relates to the Canadian Standard (NSC 10),

Forum attendees agreed that since this was an issue in Canada only. No further Forum action of discussion was necessary.

E. 13-024-VEH and 12-010-VEH Belly Straps on Dressed Lumber

This issue seeks to revise the US regulations to harmonize with the model regulation as has been reflected in recent revisions to the Canadian requirements.

Two separate concerns have emerged in these discussions. One is how to treat loads that have essentially the same top height, but have spaces between individual bundles at different locations. The second issue involves loads where there is a difference between the heights of the top of the stacks on each side of a vehicle.

FMCSA has agreed to move forward with an interpretation that will address loads under 6 ft tall, with similar top heights and uneven gaps between the stacks. The Regulators Group will continue to discuss how to address loads with uneven top heights.

Forum Action: Forum attendees anticipate review of the interpretation.

F. 13-041 VEH - Stacks of Slitter Coils with Eyes Vertical on Pallets

This issue sought guidance on proper interpretation and application of the commodity-specific requirements for metal coils. The particular concern raised; is the lack of a way to define when metal coils are to be treated as a “group”, and how individual articles in a group are affected by the securing devices.

Forum Action: Forum attendees agreed that a definition of “grouped” is needed and looking to the Regulators Group to address the matter. Since the particular issue was an isolated case, the correct action had been taken and no further discussion or action is warranted.

9. Reports & Presentations

A. Lieutenant Karl Mittelstadt and Captain Brian Ausloos made a presentation on incidents in Wisconsin and Minnesota involving logs hauled crosswise. They reported a number of incidents of lost cargo and the difficulties they had encountered in convincing carriers to use more effective means for securing these logs.

Joel Turner, of Nova Scotia Vehicle Compliance also reported similar experiences with s hort wood loaded crosswise .

B. Lonny Rollins from Time Bandit LLC made a presentation on the development of a cargo securement tension warning system for flat bed use. There was a request for endorsement of the product and their request for mandatory use of the product. Explanation was given that

CVSA does not endorse products.

C. Marking of friction mats was discussed in terms of some manufacturers selling products using a symbol to indicate the restraint value. Given that the US has a default value in the regulations and markings are only required in Canada, concerns were raised with respect to confusion that could be caused by such marking. According to section 12 (9) of standard 10 the marking has to be in (g’s), The marking shown was a color stripe along the edge of the mat, That colors stripe was presented as a industry standard by the manufacturer but further research came to the conclusion that it is not an industry standard.

D. Peter Fuerst from the Towing and Recovery Association securing vehicles on flatbeds, and wheel lifts. M. Fuerst was not available for the presentation.
