This administrative regulation has been updated to delete the obsolete list of exempt prescription products in KY, replacing such with language to clarify that all prescription products which have been exempted by the DEA from certain provisions of the Federal Controlled Substances Act are also exempt in KY from the licensing, distribution, 1 of 4 recordkeeping, and reporting requirements of the State’s Controlled Substances Act, KRS Chapter 218A. This administrative regulation establishes risk-based capital requirements for all health maintenance organizations authorized to transact insurance business in Kentucky.
