Religious Accommodation

At NMSU, the term “reasonable accommodation” can apply to both the academic and work environments.

Reasonable religious accommodations may include any adjustments to the work environment that will allow the individual to practice their religion. An employee who seeks religious accommodation must make the employer aware both of the need for accommodation, and that it is being requested due to a conflict between religion and work.

An interactive process begins once there is notice that a religious accommodation is needed to reasonably accommodate an employee who has a sincerely held religious belief, practice, or observance conflicts with the work requirement. In determining whether a requested accommodation is reasonable, consideration will be given as to whether the accommodation would pose an undue hardship for the employer. Undue hardship exists where the proposed accommodation poses a “more than de minimis” cost or burden.

NMSU will consider religious accommodation requests by granting reasonable accommodations to employees, provided operational problems or hardships within the affected department are not created. Appropriate accommodations are determined through an interactive process between the requester and NMSU representatives

(may include the immediate supervisor, a higher level administrator, and Office of Institutional Equity (OIE) staff).

NMSU employees may be staff, faculty or student employees. An employee seeking a workplace accommodation based on religion will complete the NMSU Request for Religious Accommodation Form and submit the form to the Office of Institutional Equity/EEO (OIE).

Office of Institutional Equity/EEO (OIE) or department’s website eeo.nmsu.edu. The employee is responsible to complete and submit request form to the Office of Institutional Equity/EEO (OIE).

(Whenever possible, such request should be made at least thirty (30) calendar days in advance of the requested.)

The interactive process will be initiated and may involve employee, immediate supervisor, higher level administrator and Office of Institutional Equity/EEO (OIE).

Within ten (10) calendar days of receipt of NMSU Request for Religious accommodation Form the employee will be notified in writing by the immediate supervisor of the decision on accommodation request. (Extenuating circumstances may extend the time-frame beyond the ten (10) calendar days)

Religious Workplace Accommodation Request: A reasonable religious workplace accommodation is a change in the work environment or in the way tasks or responsibilities are done that enables an employee to participate in their religious practice or belief without undue hardship on the conduct of NMSU’s business or operation and that complies with the NMSU Policy Chapter 3.25.
