THE NATURAL GAS UTILITY (WORK PLAN FOR
DISTRIBUTION NETWORK) REGULATIONS, 5767-2006
By virtue of the power vested in me under Section 25 of the Natural Gas Utility
Law, 5762-2002 (hereinafter - the Law), and with the approval of the
Economics Committee of the Knesset, I make the following Regulations:
Definitions
1.
In these Regulations "Qualified Surveyor" - means the holder of a licence
under the Surveyor's Ordinance;
"Defence Installation" - as defined in Section 159 of the
Planning and Building Law, 5725-1965 (hereinafter The Planning and Building Law)
"Infrastructure Installations"- roads and railways of all
kinds, infrastructure lines and including electricity
lines, lines for hydrocarbon gases, or for chemicals and
fuel
of
all
kinds,
dangerous
substances,
communications lines, water pipes, sewage and
drainage pipes and installations serving them;
"Combustion source"- an act that is likely to cause the
ignition of a natural gas cloud, including overhead
electricity installations, combustion engines and surface
areas whose internal temperature exceeds 300 degrees
centigrade;
"District Planner" - as defined in Section 8 of the
Planning and Building Law (hereinafter - the Planning
and Building Law);
"The Safety Order" - the Gas (Safety and Licensing)
(Installations for the Distribution of Natural Gas) Order,
5759-1999;
"The Natural Gas Authority"- as such is defined in Part
6 of the Law;
"The Gas Licensing Authority" - the authority for the
licensing of natural gas installations, as defined in
Section 119F of the Planning and Building Law;
"Streams Authority" - as defined in Section 2 of the
Streams and Springs Authorities Law. 5725-1965;
"Drainage Authority" - as defined in the Drainage and
Flood Control Law, 5718-1957;
"Scheme" - as such is defined in the Planning and
Building Law;
"Local Scheme" - a local outline scheme or detailed
scheme or scheme including provisions of such a
scheme.
Submission of 2.

A work plan shall be submitted to the Licensing
Authority by one of the following:
(1) The State of Israel, or whoever is appointed for
such purpose on its behalf;
(2) A license holder;
(3) A natural gas consumer, in respect of a gas
installation for personal consumption;
Scale and
survey map

(a) A drawing of a working plan shall be submitted in a
scale of not less than 1:250; provided that the Licensing
Authority may fix a different scale, having regard to
local conditions and the level of detail required, in its
opinion.
(b) The work plan drawing shall be prepared on a
situation map prepared by a qualified Surveyor; the
Surveyor may certify on the plan that the details
contained in it, were examined by him six months, at
the earliest, prior to submission of it to the Gas
Authority.
Area covered
by work plan
4.
A work plan shall apply to an area that shall not be less
than the area in respect of which limitations are placed
on the use of the land as provided in Regulation 6 (2).
Zoning
marking of the
land and
limitations
5.
In a work plan, the zoning of the land comprised within
it shall be marked as detailed hereinafter:
(1) The area designated for the gas pipeline strip for the
distribution network shall be marked in yellow and its
width shall be noted in the plan;
(2) The area that is subject to limitations as to use of the
land as provided in Regulation 6 (2) shall be marked by
a broken red line; circles shall also be marked on the
work plan divided into four parts (rosettes) on which
the distance shall be marked from the edge of the gas
pipeline strip to the edge of the area that is subject to
limitations as aforesaid.
Provisions of
6.
The drawing and provisions of the work plan shall

include all the following:
(1) The permitted usages in the area designated for the
gas pipeline strip;
(2) Limitations under any law on uses of land that are
imposed because of the work plan on the areas marked
on it including the limitations imposed on a defence
installation, and the steps taken to minimize the
limitations;
(3) The conditions for the grant of building permits for
the establishment of the distribution network as stated
in Regulation 9;
(4) Provisions as to protection of the system as stated in
Regulation 10.
(5) Provisions concerning the prescribing of operating
procedures and emergency procedures approved in
accordance with the Natural Gas Authority's
requirements as a condition for the issue of the building
permit or as a condition in the building permit;
(6) Provisions regarding restoration of landscape as
stated in Regulation 11;
(7) Provisions with regard to signboards and marking of
the distribution network;
(8) Provisions concerning safety and reduction of
environmental and scenic nuisances as a result of the
establishment of the distribution system;
(9) Provisions of the specification as approved under
Section 24 of the Law.

All the following shall be marked on the drawing
referred to in Regulation 3 or on a separate drawing that
shall be prepared as part of the work plan;
(1) All the sources of combustion within an area of 10
meters from the distribution system; the District Planner
may require, for special safety reasons, that marking of
sources of combustion shall be made in respect of a
larger area; where no sources of combustion have been
found in an area as aforesaid, an expert opinion of the
person who prepared the working plan shall be
submitted to the Gas Authority, certifying that no
sources of combustion exist within the said area; 'the
Distribution System'- for the purposes of this section,
means with the exception of pipelines for the
transmission of natural gas by low pressure;
(2) All existing usages of the land within a radius of 10
meters from the distribution network, which are
permitted within the area thereof under approved local
schemes; where there are no approved local schemes in
respect of the said area, uses of the land as aforesaid
shall be noted in accordance with district and national
approved outline schemes in respect of that area; the
District Planner may require, for special reasons of
safety, planning or engineering, that a note of uses of
the land shall be prepared in respect of a larger area;
(3) A survey of natural landmarks and landscape within
the area of the work plan;
(4) Marking of infrastructure installations and the water
wells within the area of the work plan, including
infrastructure installations whose relocation is
necessary as a result of establishment of the distribution
system;
(5) Approval of the Commissioner, as he is defined in
Section 61 of the Law, to the effect that the engineering
and safety characteristics of the distribution network
proposed in the work plan meet the requirements of the
Safety Order.

(a) Where one of the matters specified in Column A of
the table set out below has been included in one of the
drawings as stated in Regulation 7, the plan shall be
submitted with the addition of the comments of the
body specified alongside it, in Column B.

(b) Where a body has not made any comments within
30 days of the date of receipt of the work plan, the plan
shall also be submitted to the Gas Licensing Authority
without any comments.
(c) Where the Party submitting the plan has forwarded
the plan for the comments of the bodies as detailed in
sub-regulation (a) the Gas Licensing Authority shall
submit with the work plan, a copy of the referral to such
bodies and their comments, in so far as any have been
received.
(d) The Licensing Authority's decision shall be sent to
all those bodies whose comments were required as
detailed in sub-regulation (a)
Conditions for
grant of
building
permits

(a) The work plan shall include provisions and in
accordance with them, the application for a permit for
the erection of the gas installation as provided in the
Planning and Building Regulations (Licensing of
Natural Gas Installations) 5763-2003 (hereinafter - the
Natural Gas Installations Licensing Regulations)
accompanied by a detail specification of the work in
which all the following shall be stated:
(1) The work site;
(2) The manner of construction of the distribution
system;
(3) The means of reducing nuisances and harm to
natural landmarks and landscape at the time of
construction;
(4) The means of access, to the effect that use will be
made in so far as is possible, of existing roads; in the
absence of such existing roads, roads will be surfaced
governing means of access in a manner that will
minimize, as far as is possible, damage to the
environment and to the landscape;
(5) The organization area of the operating contractor;
(6) The available areas for the storage of equipment and
working materials;
(7) The area in which the distribution system will be
laid;
(8) Reference to the method of excavation and the depth
thereof, the materials covering the site following the
laying of the system and removal of surplus material
from the excavation works
(b) The work specification including the section in
respect of which the work plan has been forwarded for
the comments of any body as stated in Regulation 8,
will require coordination with such body before the
work in that section is carried out.
Protection of
the system
10. A work plan shall include provisions as to the
examinations that must be carried out on the subject of
the establishment of the distribution system, in
accordance with the Standards specified in Section 2 of
the Safety Order, including inspection on the subject of
stability of the land, as a condition for the grant of a
permit for the laying of the distribution system.
Landscape
restoration
11. A work plan shall include provisions for landscape
restoration of the area covered by the plan following
construction of the distribution system; these provisions
shall be prescribed having regard to the natural
landmarks and landscape that exist within the area
covered by the work plan and shall make reference,
inter alia, to the following matters;
(1) Drainage of the land in order to prevent flooding;
(2) Flow channels of streams above and below ground
level;
(3) Recycling of ground level and its restoration, as far
as is possible, to its original state.
(4) Rehabilitation of plant life, including by means of
cultivation befitting the original environment.

The Gas Licensing Authority may require from the
Parties submitting the work plan, further information
and documents in so far as they are required by it for
the purposes of examination of the work plan and
making a decision on it.
Saving of Laws 13
Nothing in the provisions of these regulations shall
prejudice other laws including the obligation of
obtaining a permit under the Natural Gas Installations
Licensing Regulations, or the duty to act in accordance
with the specification under Section 24 of the Law.
