Box 128, Cornersville, Tennessee 38047 until , local time, on the , day of , 19 and then at said place publicly opened and read aloud. The work to be done consists of the excavation, bedding and installation of a 36" CMP (or equivalent) drainage culvert with headwalls (riprap alternate) under Maplewood Drive, backfill, pavement replacement and seeding and mulching. No bids will be received or accepted after the above specified time for the opening of Bids. Bids submitted after the designated hour will be deemed invalid and returned unopened to the Bidder. Bids shall be identified on the exterior of the sealed envelop with all the information required by law, including the name of the project and the bidders’s name, address and license number, expiration date and classification (if applicable). Copies of BIDDING DOCUMENTS may be obtained at the Cornersville Town Hall. The successful bidder will not be required to furnish a Performance and Payment Bond. Payment shall be for the entire contract amount after completion and acceptance. The project herein described is to be completed within thirty (30) calendar days from the date of award of contract. No bidder may withdraw his bid within thirty (30) days after the actual bid date of the opening thereof. The OWNER reserves the right to waive any irregularities or reject any or all bids. Box 128 Cornersville, TN 37047 INSTRUCTION TO BIDDERS AND GENERAL CONDITIONS SECTION B BONDS Due to the dollar amount of the contract and time for construction, no bonds will be required for the project. However, no payment shall be made to the contractor until the project is completed and accepted by the Owner. No payment shall be made to the contractor until the contractor provides release of liens. Should the project be delayed for some reason that is not the fault of the Contractor, a performance bond for the remainder of the work may be submitted and payment made. INDEMNITY The contractor will indemnify and save harmless the Town, its officers, agents, servants, and employees from and against any and all suits, actions, legal proceedings, claims, demands, damages, costs, expenses, and attorneys' fees to the extent resulting from a willful or negligent act or omission of the Contractor, its officers, agents, servants, and employees in the performance of this Contract; provided, however, that the Contractor shall not be liable for any suits, actions, legal proceedings, claims, demands, damages, costs, expenses and attorneys' fees arising out of the award of this Contract or a willful or negligent act or omission of the Town, its officers, agents, servants and employees. INSURANCE The Contractor shall at all times during the Contract maintain in full force and effect Employer's Liability, Workmen's Compensation, Public Liability and Property Damage Insurance, including contractual liability coverage for the provisions of Indemnity. All insurance shall be by insurers and for policy limits acceptable to the Town and before commencement of work hereunder the Contractor agrees to furnish the Town certificates of insurance or other evidence satisfactory to the Town to the effect that such insurance has been procured and is in force. The certificates shall contain the following express obligation: "This is to certify that the policies of insurance described herein have been issued to the insured for whom this certificate is executed and are in force at this time. In the event of cancellation or material change in a policy affecting the certificate holder, thirty (30) days prior written notice will be given the certificate holder." Scope of Work 1.1 This works shall include all labor, materials, equipment, tools and such other accessories necessary for the proper and complete execution of the work specified and all incidental and collateral work required. (7) All permits needed, if any, for work in or around the work site will be the responsibility of the contractor. 1.2 The quantities of work identified in section 1.1 above are estimated and may vary with actual field applications. Therefore, contractor payments will be based on the actual quantities of work performed. 2. Specifications 2.1 All work under this contract shall conform to these contract specifications and plans and the applicable Sections of the latest edition of the Tennessee Department of Transportation (TDOT) Standard Specifications for Road and Bridge Construction. 3. Operation, Storage and Working Areas 3.1 The working area for the construction activities shall be limited to the area described in the scope of work. 4. Construction Facilities 4.1 Cleaning and removal of wastes, debris and dust shall be done regularly and frequently by the Contractor. At a minimum, clean-up shall be accomplished once each work day. 4.2 The Contractor shall protect existing vegetation, structures, utilities and equipment from damage by construction activities. Any damage to the vegetation, structures, utilities or equipment shall be restored at the Contractor’s expense. 5. Technical Specifications 5.1 Excavation. Before excavation is started the Town will set stakes locating the placement of the drainage culvert. The drainage culvert is to be located parallel and adjacent to an existing 36" O.D. CMP culvert. All excavation shall be as indicated on the attached detail or as directed by the Town. Only the excavation shown on attached standard detail will be measured for payment. a. The width of the pipe trench shall be sufficient to permit satisfactory jointing of the pipe and thorough tamping of the bedding material under and around the pipe. b. All suitable excavated material shall be utilized as backfill or embankment. Excess or unsuitable material shall be disposed of off site by the contractor. 5.2 Foundation preparation. Bedding for the pipe culvert shall conform to the requirements of Class B bedding. Class B bedding shall be constructed by bedding the pipe culvert in a trench cut in road bed to the depth shown on the plans. The pipe shall be bedded on a 6" thickness of Class B material and sufficient additional Class B material accurately shaped to fit the lower part of the pipe exterior for at least 10% of its overall height. Class B material shall then be rammed and tamped in layers not over 6" in loose thickness around the pipe to a minimum depth of that shown on the attached standard detail. 5.3 Backfilling. After the bedding has been prepared and the culvert installed, the trench shall be backfilled with bedding material and/or soil from excavation. The backfill will be placed along each side of the pipe in layers not over 6" in loose depth. Each layer shall be moistened (or dried if necessary) to near optimum moisture content and thoroughly compacted with mechanical tampers. Special care shall be taken to compact thoroughly the material under the haunches of the pipe and insure that the backfill material is in intimate contact with the side of the pipe. The backfill shall be brought up evenly on both sides of the pipe for the full required length. 5.4 Pipe Culvert and Placement. Pipe Culvert material may consist of either corrugated metal, 36" O.D., equivalent size reinforced concrete pipe or equivalent size high density polyethylene (HDPE). Reinforced concrete pipe and HDPE pipe will meet the requirements set forth in Tennessee Department of Transportation (TDOT) Standard Specifications for Road and Bridge Construction. a. Equipment for placing pipe culvert shall include hoisting equipment capable of handling and placing the pipe in final position without damage to the pipe. Mechanical tamps will be provided. b. The pipe culvert shall be laid beginning at the downstream end of the pipe line. Bell or groove ends of rigid pipe and outside circumferential laps of flexible pipe shall be placed facing upstream. Flexible pipe shall be placed with longitudinal laps of seams at the sides. 5.5 The Bid Form will provide estimated costs for both concrete culvert headwalls and riprap. a. Concrete Culvert Headwall. A double pipe culvert headwall will be placed on the influent and effluent sides of the new culvert covered in this project and the existing culvert. The existing culvert shall be adjusted, cut or other wise modified to accommodate placement of the headwall. Headwall material will consist of reinforced concrete. The headwall may be either cast in place or precast. Headwall construction will be in accordance with the detail shown in Appendix 1. Culvert skew shall be considered. Alternate shop details for double pipe culvert headwalls may be submitted for approval by the Town prior to construction. b. Riprap. As an alternative to Concrete Culvert Headwall, riprap may be used. Machined riprap, Class A-3, 2"-6" in size will be placed on the influent and effluent sides of the new culvert covered in this project and the existing culvert. The existing culvert shall be adjusted, cut or otherwise modified to accommodate placement of the riprap c. Filter Cloth. Filter cloth meeting the requirements of Tennessee Department of Transportation (TDOT) Standard Specifications for Road and Bridge Construction will be placed prior to riprap placement. 5.6 Pavement Patch. All restoration shall result in a work site condition equal to or better than that which existed prior to construction. Once the compacted backfill has been placed, the asphalt cutback shall be made. The cutback will extend 6" minimum on pavement material (2" deep, minimum). All edges of the opening shall be neatly cut with an asphalt saw and uniformly tacked. a. Composition and placement of mix. The hot plant-mix asphalt surface course shall meet all the requirements of Section 411 and 903.11, Grading D or E of the TDOT Standard Specifications for Road and Bridge Construction. The mix shall be compacted immediately after placing. Minimum compaction on the mix will be a ten (10) ton static roller for breakdown and final compaction. 6. Work Zone Traffic Control. Traffic control in accordance with the Manual of Uniform Traffic Control Devices must be maintained during construction. The work site must be properly barricaded. Barrels or other TDOT acceptable barricades with lights, must be in place at night with lights burning. Warning signs must be installed in both approach directions for the duration of the work. During periods when the road must be closed for short (15-20 minute) durations, flagmen must be posted. Since this is a dead-end street with no possible detours, the road must be kept passable for emergency vehicles. Closing the road for long periods of time or during heavy use times (6-8 a.m. and 4-7 p.m.) must not occur. 7. Utilities. Tennessee One Call (1-800-351-1111) must be contacted relative to the location of utility facilities in the area. The water line must be located prior to beginning work. All utility companies involved must be contacted. 8. Safety. Safety precautions hall be used at all times during the progress of the work. As appropriate, workmen shall be furnished with hard hats, safety shoes, asbestos gloves, respirators, and any other safety apparel that will reduce the possibility of accidents. All Occupation Safety and Health Act (OSHA) requirements shall be observed. CONTRACT SECTION E This contract made and entered into this day of 199__, by and between , party of the first part, hereinafter called the "CONTRACTOR," and the Town of Cornersville, through its governing body and authorized representative, party of the second part, hereinafter referred to as the "OWNER." WITNESSETH THAT THE PARTIES HERETO do mutually agree as follows: 1. The CONTRACTOR shall, in a good and workmanlike manner and at his own cost and expense, furnish all labor, materials, plans, equipment, tools and such other accessories necessary for the proper and complete installation of a drainage culvert including any and all incidental and collateral work required. 2. It is expressly understood and agreed by the parties hereto that the Notice to Bidders, General Conditions, Proposal, Contract, Specifications and other items hereto, including any drawings, explanations, and instructions to CONTRACTOR are each and all, herein incorporated by reference and together with this Construction Contract constitute the Contract. 3. The Work shall be completed within thirty (30) calendar days after the date which the CONTRACTOR is to start the Work as provided in the Contract Documents. 4. The Contract Price set forth under Paragraph Five (5) below and subject to adjustment modifications as provided therein, shall represent the total of all sums due the CONTRACTOR for work installed under this Contract. No verbal or written order of the OWNER or any of their employees shall modify or act as a waiver of the Contract Price. 5. In consideration of the faithful performance by the CONTRACTOR of all terms, conditions, and covenants of the Contract to the satisfaction of the OWNER, the OWNER shall pay and the CONTRACTOR shall receive the lump sums and/or unit prices stipulated in the Contractor's Proposal in the total amount of dollars and cents ($ ), which total sum shall be known as full compensation of the Contract Price.
