The City Council of Liverpool (hereinafter referred to as " the Council ") in exercise of its powers under

Section 9 to The Road Traffic Regulation Act 1984 (which said Act of 1984 is hereinafter referred to as

" the Act of 1984 ") and of all other enabling powers and after consultation with the chief officer of police in accordance with Part III of Schedule 9 to the Act of 1984, hereby makes the following Order:-

Section One – Commencement, Citation, Intrepretations, General Articles and Power To Suspend

Or Modify This Experimental Order (If Necessary)

1A. This Experimental Traffic Regulation Order shall come into operation on the 24 th day of

November 2014 and may be cited as: The City Council Of Liverpool (Lime Street, London Road,

Seymour Street, Skelhorne Street Area) (Revocation, Prohibition Of Right Turn, Prohibition Of

Driving, Prohibition Of “U”-Turn, One-Way Traffic and Contra-flow Bus Lane) (Order, 2006)

(Experimental Amendment) Order, 2014 .

1B. This Experimental Traffic Regulation Order shall remain in force for a maximum period of up to eighteen months expiring on the 23 rd day of May 2016 .

2. (1) In this Experimental Traffic Regulation Order , save as otherwise defined within this Order, each and every expression shall have the meaning assigned to it by The Traffic Signs Regulations and

General Directions 2002 : -

" Order of 2006 " means The City Council Of Liverpool (Lime Street, London Road, Seymour Street,

Skelhorne Street Area) (Revocation, Prohibition Of Right Turn, Prohibition Of Driving,

Prohibition Of “U”-Turn, One-Way Traffic and Contra-flow Bus Lane) Order, 2006 ;

2. (2) Except where otherwise stated, any reference in this Experimental Traffic Regulation Order to a numbered Article is a reference to the Article bearing that number in this Order.

3. The prohibition and restrictions imposed by this Experimental Traffic Regulation Order shall be in addition to and not in derogation from any restriction or requirement imposed by any regulations made or having effect as if made under the Act of 1984 or by or under any other enactment.

4. As provided by Section 10(2) (Supplementary Provisions As To Experimental Traffic Orders) of the Act of 1984 this Experimental Traffic Regulation Order includes the provision to empower the

Divisional Manager (Highways & Transportation) of the Council , or a person authorised by the

Divisional Manager, to modify or suspend the operation of this Experimental Traffic Regulation Order or any provision of it if it appears to him essential: - (a) in the interests of the expeditious, convenient and safe movement of traffic; (b) in the interests of providing suitable and adequate on-street parking facilities; or (c) for preserving or improving the amenities of the area through which any road affected by the Experimental Traffic Regulation Order runs. The power conferred by such this provision shall be exercised only after consulting the appropriate Chief Officer of Police and giving such public notice as the Secretary of State may direct.

Section Two – The Amendments To The Order Of 2006

5. The Order of 2006 is hereby amended by the substitution of the existing Article 8(c) and Article 11 by the new Article 8(c) and Article 11 as specified below in this Order: -

8. No person shall cause or permit any vehicle to proceed on: - (a) Skelhorne Street, other than in a westerly direction; (b) St. George’s Place (gap in the central reservation), other than in a westerly direction; and (c) Lime Street (from its junction with Elliot Street to its junction with Ranelagh Place)

other than in a southerly direction.

11. No person shall cause or permit any vehicle, other than a public service vehicle, coach, pedal cycle, hackney carriage, licensed private hire vehicle, a vehicle being used by the Police, Ambulance, Fire

Service or Statutory Services, Postal Operator and Local Authority in pursuance with their essential duties, or a vehicle accessing the St. John’s Centre Car Park, to proceed in Lime Street between the west side kerb line and Traffic Sign to diagram 1049 and from its junction with Ranelagh Place to its junction with Elliot Street, other than for the purposes of crossing it, between the hours of 12.00 noon to

6.00 p.m. on Mondays to Saturdays inclusive, unless that vehicle is proceeding north bound in the contra-flow bus lane.

Section Three – Contravention Of The Experimental Traffic Regulation Order

8. Any person who contravenes the new Article 8(c) and Article 11 of the Order of 2006 within this

Experimental Traffic Regulation Order , or who uses a vehicle, or causes or permits a vehicle to be used in contravention of the new Article 8(c) and Article 11 of the Order of 2006 within this

Experimental Traffic Regulation Order , shall be guilty of an offence.

Notice is hereby given that on the 14 th November 2014 , the Council made the above-mentioned Experimental

Traffic Regulation Order (ETRO) under Section 9 of The Road Traffic Regulation Act 1984 , which will become operative on the 24 th November 2014 and remain in force for a maximum period of up to 18 months expiring on the 23 rd May 2016 , the effect of which will be: -

To amend of Article 8(c) and Article 11 , of The City Council Of Liverpool (Lime Street, London Road,

Seymour Street, Skelhorne Street Area) (Revocation, Prohibition Of Right Turn, Prohibition Of Driving,

Prohibition Of “U”-Turn, One-Way Traffic and Contra-flow Bus Lane) Order, 2006 , so that they now effectively read as follows:-

8. No person shall cause or permit any vehicle to proceed on: - … (c) Lime Street (from its junction with Elliot

Street to its junction with Ranelagh Place) other than in a southerly direction.

11. No person shall cause or permit any vehicle, other than a public service vehicle, coach, pedal cycle, hackney carriage, licensed private hire vehicle, a vehicle being used by the Police, Ambulance, Fire Service or Statutory

Services, Postal Operator and Local Authority in pursuance with their essential duties, or a vehicle accessing the

St. John’s Centre Car Park, to proceed in Lime Street between the west side kerb line and Traffic Sign to diagram

A copy of the ETRO , and statement of the Council's reasons for making the same may be inspected at The

Planning & Environment Unit, Room 209, 2 nd Floor, Legal Services, Municipal Buildings, Dale Street,

Liverpool, L2 2DH, between the hours of 9.15 a.m.

and 4.00 p.m.

on Mondays to Fridays inclusive. The Council will be considering in due course whether the provisions of the ETRO should continue in force indefinitely.

As provided by Section 10(2) of The Road Traffic Regulation Act 1984 the ETRO includes a provision to empower the Divisional Manager of Highways & Transportation of the Council , or a person authorised by the

The power conferred by such this provision shall be exercised only after consulting the appropriate Chief Officer of Police and giving such public notice as the

Secretary of State may direct.

That within a period of six months : - (a) beginning on the 24 th November 2014 when the ETRO comes into force; or (b) if the ETRO is varied by another Order or modified/suspended pursuant to Section 10(2) of The Road

Traffic Regulation Act 1984 , beginning with the day on which the variation or modification or the latest variation or modification came into force, any person may object to the making of the ETRO for the purpose of such indefinite continuation. You should send the grounds for your objection or support, in writing to the under signed on or before the 25 th May 2015 . Council’s Divisional Manager (Highways & Transportation) will begin to review the monitoring of the ETRO after it is implemented on the 24 th November 2014 with a view to determining after the 12 month review period has expired on the 23 rd November 2015 whether or not the provisions of these ETROs should be made permanent.

In the event of there being objections received to the ETRO , which remain un-withdrawn, they will be referred to the meeting of The Traffic and Highways Representations Committee to determine. Objectors and supporters will be notified in writing as to the date, time and location of the Committee meeting should they wish to attend.
