Memorandum of Understanding
Names of the parties to this agreement
This memorandum of understanding is between The Artist
Development Agency (ADA) and the School as outlined on page 1
of this document.
Duration of agreement
This agreement shall be effective on the date of execution and
continue for the duration of the ‘Making Art Work’ programme.
Booking confirmation
Once ADA has received the Schools booking form, ADA will be in
touch to confirm available dates and times to deliver the
workshop. ADA will then send the School a confirmation email
with an invoice.
Programme delivery
All ‘Making Art Work’ programme workshops will be delivered by
Antony Deaker,
Manager of ADA.
Programme content
The content of ‘Making Art Work’ is the property of ADA and is
not to be replicated without the express permission of ADA.
Programme fees
Each ‘Making Art Work’ programme component is 1 hour long and
is charged at $240 (GST Excl). This fee includes all time
spent on preparation of documentation for each participants’
Career and Learning Plan, and there will be no other costs to
the School in terms of copying, resource design, toll calls
etc.
Travel fees
Travel beyond the wider Dunedin area will be charged at 75c
p/km.
Payment
Payment must be received within the 20th of the Month following
the invoice date.

‘Making Art Work’ is eligible to be funded through the STAR
programme and aligns with STAR aims and objectives.
Rescheduling and cancellations
Each ‘Making Art Work’ programme component can be rescheduled
up 48 hours before the commencement date of that component
without any additional charge. Components rescheduled within
the 48 hour period will incur an administration fee of $50
(plus GST).
To cancel a component, the School is expected to notify ADA in
writing (via letter, email or fax) up to 14 days before the
start date of the component. Providing more than 14 days
notice has been given, the School will receive a full refund
less an administration fee of $50 (plus GST). If the School
withdraws for whatever reason within the 14 day period, the
full fee will remain payable.
Student enrolment
The School is responsible for selecting and enrolling eligible
students onto the ‘Making Art Work’ programme.
Student welfare services
The School is responsible for provision of student welfare
services
Progress through the course, assessment and
reporting student results
ADA is responsible for the assessment of students progress
with an expectation that all participants produce an
Individual Career and Learning Plan on completion of the
‘Making Art Work’ programme.
Attendance and reporting absences
ADA is responsible for monitoring students’ attendance and
reporting absences to the School. All students are expected to
sign an agreement that outlines the attendance requirements
and provides an explanation of the procedures to follow in the
event of an unavoidable absence when enrolling on the ‘Making
Art Work’ programme.
Health and safety arrangements

The venue is responsible for ensuring practicable health and
safety measures are in place and communicated to the students
before the commencement of the workshop.
Dispute resolution
Any dispute, difference or claim arising out of or in
connection with this agreement, or the subject matter of this
agreement, will be referred to and finally resolved by
arbitration in accordance with AMINZ rules. The tribunal will
consist of a sole arbitrator appointed in accordance with
AMINZ rules.
Student evaluations
On completion of the ‘Making Art Work’ programme, students are
invited to complete an evaluation form. The results of all
students’ evaluation forms are the property of ADA and will be
shared with the School on request.
Bespoke training
ADA is available to work with the School to design programmes,
workshops or presentations to meet the needs of staff and students.
If the School would like to design a bespoke programme or
workshop, please contact ADA directly to discuss this further.
Confirmation of agreement
