• Feature of Wurundjeri Way
since 2002
• Sculpture is 25m high & weighs
approx. 20 tonnes.
• Sits on a concrete base thought to
weigh 90 tonnes.

• Movement of the Eagle will require
agreement and consent between:

THE PROPOSED DEVELOPMENT BY LEND LEASE
• Lend lease has won the tender to develop the entire site
• The proposed development will include 100,000m² of office space
• 600 Apartments in 7 towers
• Construction of a public plaza
• Approximate construction cost of 1.5 billion dollars

• Approval for the development will be by the Minister for Planning ,

CREATION OF FREEHOLD TITLE TO BE INSERTED
INTO MADIGANS STAGED SUBDIVSION
• Discontinuance of Wurundjeri Way will take place under Section 12 of the
Road Management Act 2004 by notice in the Government Gazette
• Some confusion on who the land vests in after its discontinuance
- Crown has absolute property in Land over which there is an Arterial
Road or Freeway (Schedule 5 (1a) RMA 2004)

- If VicRoads has discontinued the use of a road or part of a road, it may in
accordance with this clause sell the land on which the road or part of the
road was located (Schedule 5 (15)(1) RMA 2004)
• Legal Advice has been sought and the Victorian Government Solicitor has
advised:
- VicRoads can transfer land to a third party purchaser or
- Include this land within a Plan of Subdivision under Section 35 of the
Subdivision Act 1988

FUTURE WORKS – CONSTRUCTION PHASE
• Bridge deck will be constructed to sit within the airspace lot (1.5 billion dollar
development will lie on top of the bridge deck)
• Columns and Pile Caps will have to be sunk and constructed into Wurundjeri Way to
support the bridge deck:
- Who is going to be responsible for them?
- Are titles for the supports required?
• Possible solutions included:
- Leave the columns under the control of VicRoads
- Create a Section 173 agreement that covers maintenance
- Create (In conjunction with the O.S.G.) C.A.’s for the area covered by the deck and
columns.

• The agreed solution:
- The columns and pile caps within the road will be located and
discontinued
- The titles will be inserted into the Madigans Staged Subdivision and
become Common Property along with the deck that they support.
- Owners Corporation will be responsible for maintenance of structure
within Common Property
- Owners Corporation must be fully funded, have the appropriate rules,
regulations, insurance and procedures from its inception

COLLINS STREET BRIDGE DECLARATION
• Collins Street Bridge has been accepted by the public and is on Melbourne City Councils
public register of roads
• The bridge was incorrectly declared as Docklands Hwy (Wurundjeri Way) in 2000

• Declaration Survey of Collins Street Bridge Required:
- Thorough search of Land Status
- As-constructed survey of the bridge deck and piers
- Search of historical design drawings for the bridge

• A best fit of our as-constructed survey with the design drawings for the
bridge revealed that one of the pile caps encroached into Wurundjeri Way
• This is of particular importance as:
- We do not want to discontinue any part
of the Collins Street bridge structure
- We do not want to sink columns
(required for Lend Lease Development)
