Remedial Acquisition Framework Webinar PRESENTED BY: Barbara McDonough Chief, Contracts Management Branch, OSRTI Kate Garufi Superfund Technical Lead, OSRTI Jeanne Poovey Manager, Program Management & Regional Coordination Service Center, OAM 1 Agenda • Introduction – Robin Richardson, OSRTI – Raoul Scott, OAM • Logistics – Jean Balent • Presentation • Questions 2 Current Superfund Remedial Acquisition Model • Full Service Remedial Action Contracts (RACs) – Provides services to conduct site investigation through design, construction and oversight • Site Specific Contracts • Interagency Agreements with USACE or other Federal Agencies • State or Tribe run projects through Cooperative Agreements 3 Why Change? • Recognized overall acquisition approach is more than 20 years old • Implementing OMB and FAR requirements, e.g., – Reducing High Risk Contracts – Using Fair Opportunity – Strategic Sourcing • Provides for competition throughout the life of the contracts • Reduced resources (dollars & FTE) • Continue to promote Small Business Participation • Provides for ability to leverage Performance Based Acquisition 4 Remedial Acquisition Framework (RAF) – Overview Number of contracts and small business set asides to be determined by industry responses to the Sources Sought/Request for Information notices posted for RES and ESO that are due on November 7. 5 What exactly is changing? • Remedial Action Contracts (RACs) are being split into three suites of contracts: – Design and Engineering Services (DES) – Remediation Environmental Services (RES) – Environmental Services & Operation (ESO) • Contracts will be multiple awards (MACs), indefinite delivery/ indefinite quantity (ID/IQ) • Minimum guarantee of $25,000 per CLIN awarded under a single contract (the CLIN structure is explained on the following slides) • Contractors will compete for projects at the task order level pursuant to the fair opportunity process of FAR 16.505 6 Overarching Acquisition Strategy Note: Due to continuous work on these solicitations, as well as the results of our market research, the information on the following slides are subject to change. • • • • One solicitation per suite NAICS Code 562910 Multiple contracts will be awarded for each suite Each contract will be composed of Contract Line Item Numbers (CLINs) • Each CLIN will represent a certain geographic area (e.g. State, multiple states, region, multiple regions or national) • We will discuss the specifics of each suite in the following slides 7 Who Can Participate in the RAF? • Contractors may bid on one or more CLINs • A contractor may hold a contract as a prime and participate as a subcontractor within each suite • Joint Venture partners are considered primes • RES and ESO may be small business set aside (pending market research) • the Limitation of Future Contracting (LOFC) clause under the current RAC contracts remain unchanged 8 Design and Engineering Services (DES) Suite • Acquire professional services of a scientific, architecture and engineering nature to support the EPA’s cleanup programs. Tasks include: – – – – – – Remedial investigations/feasibility studies (RI/FS) Field work and analytical support Remedial design (RD) Engineering evaluation/cost analysis (EE/CA) Technical assistance (TA) To a lesser extent, support for other EPA programs or Agencies 9 DES Structure • FAR Part 36.6 – Brooks Act Procurement • Request for Standard Form 330 (SF-330) • EPA will maintain SF-330s in a database for use when evaluating firms for award of task orders 10 So what does this look like? DES CLIN STRUCTURE • • • • Single Request for SF-330s CLIN by geographical area (to be determined) Small Business Awards Full and Open Awards CLIN 1 CLIN 2 CLIN 3… CLIN 1 CLIN 2 CLIN 3… Contract Contract Contract Contract Contract Contract 1 1 1 1 1 1 Contract Contract Contract Contract Contract Contract 2 2 2 2 2 2 Contract Contract Contract Contract Contract Contract 3… 3… 3… 3… 3… 3… • • • Full and Open with reserves to small business Full and Open covers all 10 Regions CLIN geographical structure to be determined Anticipate 2-6 awards per individual CLIN, with a number of those awards to be reserved for small businesses Based on EPA spend, goal is to award an appropriate number of contracts to small business concerns. Expectation is that we will award enough contracts to small business concerns to ensure that at least 15-30% of the work is performed by small businesses at the task order level (at least 2 small business awards for each Region) Firms may propose on as many individual CLINs as they wish (just 1 CLIN or up to all 10 CLINs) Firms will not be rated more or less highly based on how many SF-330s they submit 11 How will task orders be awarded under DES? • CLIN selection for fair opportunity process – EPA reserves the right to compete task orders exclusively among the small business CLIN and will evaluate their technical qualifications from existing SF-330 and other agency information. • Firm Selection – EPA has the discretion to request additional information/technical qualifications from contractors – EPA will evaluate existing information (SF 330s, past performance) – EPA will evaluate and rank firms based on FAR Part 36 evaluation criteria – EPA will request proposal and begin negotiations with top ranked firm 12 SF-330 Electronic Form Update Comments received thus far and addressed now on SF-330: • • • • • • Increasing page limit Ability to format text has been added – bold, underline, italics, bullets and numbering, font color, highlighting, ‘hard’ enter Added attachment function in Section H that supports multiple file types – All attachments now printing with ‘Close and Print’ button Text not appearing in the printer version is now corrected – Text boxes can increase / decrease in size, depending on vendor entry EPA will be using the electronic Microsoft Access SF-330; no alternative versions will be accepted, to include hard copies, PDFs, Word, etc. Planning to provide a submittal confirmation to offerors for the final SF-330 A revised version of the SF-330 form and instructions will be posted for a second round of industry comments. A Q&A document will also be posted shortly to address all comments received on the SF-330 form to-date. 13 Remediation Environmental Services (RES) Suite • Provides a capability to acquire remedial and removal action services to support the EPA’s cleanup programs including: – Remedial/removal action implementation • Emergency response will generally not be conducted under these contracts – Long term response (LTRA)/Remedy Operations – Cleanup Validation – Design support Note: The RES CLIN and set aside structure will be determined after the results of the current market research being conducted through the Request for Information due November 7, 2014. 14 Environmental Services and Operation (ESO) Suite • Provides a capability to acquire professional services to support the EPA’s cleanup programs including: – Primarily provide support to implement long-term response action/remedy operations at Superfund sites – Technical support to the EPA project manager(s) in the oversight of the EPA contractor implementing the remedial action or a removal action under the RES contract – Technical oversight of the environmental remediation work being financed and performed by another Federal Agency, state, tribe, or potentially responsible parties – Preliminary assessment/site investigation activities.
