LEGAL FRAMEWORK :
With reference to the article (5) of the UAE
Cabinet Resolution No.(10) / 2014 “UAE Regulation
for control on Halal Products” in which :
1)
ESMA issues the necessary resolution to
determine the shape of the national mark of
Halal and Halal Certificate, so that this
resolution contains the procedures for obtaining
the mark and conditions of use and all the
provisions and procedures related there to.
2) ESMA is considered the exclusive owner of the
intellectual property rights of national Halal
(emblem) mark, and the form of the Halal
Certificate.
LEGAL FRAMEWORK :
ESMA board has approved “National
Halal Mark
&Licensing Requirements”
under ESMA Board Resolution No.
(36)/2014.
Scope of the Regulation :
The provisions of this Regulation shall
apply to products, services or eligible
production systems that are applying for
a license using the national mark of halal.
DEFINITIONS :
The Halal National Mark (HNM) :
The mark approved by ESMA board to be granted to a
certain product to confirm the conformity of a product,
service and production system to the halal requirements.
Licensing To use HNM :
Certificate granted by ESMA to authorize the use of Halal
National Mark to be placed on products, facilities or
production systems conforming to the requirements of
halal requirements.
PROCEDURE FOR OBTAINING HNM :
1. Application Submission:
Manufacturers/Traders shall submit on line
application through ESMA website with the
following:
- Valid Industry/Trade License.
- Declaration of Conformity.
- Proof of effective implementation of FSMS/GMP/
GHP or QMS.
- Fees.
PROCEDURE FOR OBTAINING HNM :
2. On-Site Assessment:
- After the document review of the application,
ESMA conducts on site assessment to verify the
compliance of the facility & products with the
related UAE standards.
- ESMA and applicant agrees on the corrective
action and the period to close it.
- Applicant submits correction action to ESMA for
their review.
PROCEDURE FOR OBTAINING HNM :
3. Issuance of Certificate and license to use HNM:
- After fully compliance with UAE regulation for
halal products and its requirements, ESMA grants
Halal National Mark to the factory and issue
Halal certificate for registered products.
- Certified factories are required to put the HNM
on their products.
- Surveillance assessment are conducted either by
market monitoring OR factory audit.
- Certificate validity is 3 years.
