Once involved, the Shop Steward will arrange a meeting that includes the involved employee, the first level Manager and the Shop Steward Settled Complaints should be logged by the Steward at the Local Lodge. If the concern is not resolved at this meeting, a written complaint will be completed and signed by the employee, and/or Steward within five (5) working days of the meeting. First Level Managers have five (5) working days to sign Written Complaints Grievance Step 1 The written grievance will list the facts involved, the resolution sought, and a reference to the section of the Collective Bargaining Agreement or Company Policy, that the employee believes has been violated including laws, regulations, working conditions, safety issues or past practices. Any mutual extensions of the time limits set out in this Article must be in writing and be signed by the Union and Company Representative. No retaliation, disciplinary action or discrimination shall occur because of the filing of a complaint under this Article. * Denotes Responsibility to Establish Required Meeting Grievance Procedure Step 1 Grievance Step 1 The written grievance will list the facts involved, the resolution sought, and a reference to the section of the Collective Bargaining Agreement or Company Policy, that the employee believes has been violated including laws, regulations, working conditions, safety issues or past practices. Both Parties agree to disposition grievance within ten (10) working days. * Denotes Responsibility to Establish Required Meeting Grievance Step 1 If agreement is reached, a meeting will be held for signature by both parties. If the matter cannot be resolved at this step, the grievance shall be referred to Step 2 by the In-Plant Representative. The parties attending Step 1 Grievance Meetings shall have full authority to make final and binding settlements. Any mutual extensions of the time limits set out in this Article must be in writing and be signed by the Union and Company Representative. No retaliation, disciplinary action or discrimination shall occur because of the filing of a grievance under this Article. Both Parties agree to disposition grievance within ten (10) working days. Grievances addressing employee terminations and/or suspensions shall automatically begin the process at Step 2. If agreement is reached, a meeting will be held for signature by both parties. If the matter cannot be resolved at this step, the grievance shall be referred to step 3 by the In-Plant Representative. * Denotes Responsibility to Establish Required Meeting Grievance Procedure Step 3 (Pre-Mediation) Grievance Step 3 (Pre-Mediation) Meeting - Within five (5) working days of the step 3 appeal by the In-Plant Representative, a meeting will be held with the Vice President, the HR Director and/or Labor Relations, and the *Business Representative for the Union to discuss the matter. Both Parties agree to disposition grievance within ten (10) working days. If agreement is reached, a meeting will be held for signature by both parties. If the matter cannot be resolved at this step, the grievance shall be referred to step 4 by the Business Representative . * Denotes Responsibility to Establish Required Meeting The parties attending Step 2 and Step 3 Grievance Meetings shall have full authority to make final and binding settlements. Any mutual extensions of the time limits set out in this Article must be in writing and be signed by the Union and Company Representative. No retaliation, disciplinary action or discrimination shall occur because of the filing of a grievance under this Article. Grievance Procedure Grievance Step 4 (Mediation Committee) The Mediation Committee shall consist of the Business Representative and either the Directing Business Representative (DBR) or the Assistant Directing Business Representative (ADBR) for the Union and the Vice President of Human Resources (HRVP) * and either the responsible Vice President General Manager (VPGM) or the Vice President (VP) of the employee. Meeting – The Mediation Committee will meet as soon as possible and will either render a decision, or a report of inability to render a decision, within five (5) business days of the meeting. Step 4 Grievance Step 4 (Mediation Committee) If the Mediation Committee arrives at a majority decision it will constitute final settlement and be binding on all parties. If the Mediation Committee is unable to arrive at a majority decision, either party of this Agreement shall be free at any time within the next twenty (20) days to request Arbitration pursuant to the Arbitration Rules set out in the Collective Agreement. The parties attending Step 2 and Step 3 Grievance Meetings shall have full authority to make final and binding settlements. Any mutual extensions of the time limits set out in this Article must be in writing and be signed by the Union and Company Representative. No retaliation, disciplinary action or discrimination shall occur because of the filing of a grievance under this Article.
