Legislation
Since the publication of the Blue Book 2014 several regulations have come into effect. A further draft of changes that will affect the
industry are in prospect, and these are outlined below with their likely dates of implementation.
New legislation

Construction (Design & Management)
Regulations (CDM)
HSE ran a consultation in 2014 on the revised CDM regulations. With the consultation
results analysed work is soon to be completed in line with normal Government
processes but the plan is to bring them into force in April 2015.
Zero carbon homes
The Government ran a consultation at the end of 2014 seeking views on the government
proposals for small site exemptions for the zero carbon homes policy. With housing
being a key part of the next Government this consultation could have a big impact
Infrastructure Bill
The Infrastructure Bill concluded report stage in November 2014. If the Bill is given
Royal Assent as expected in 2015 then it will include a diverse range of measures
including reform of the planning law as well as giving the right to buy stakes in local
renewable electricity generation facilities.

Overview
The maintenance of a building is essential to supporting the
function of the business. In today’s environment managers are
searching for any edge that can provide them with success, and
maintenance outsourcing is one approach that is perceived to lead
to greater effectiveness.
Outsourced maintenance service providers can bring best practice
to an organisation but a client will need regular demonstration of
improvement. Measurement becomes important and adoption
of KPIs (Key performance indicators) is a powerful mechanism to
monitor performance.
BSRIA KPIs
This is the 11th year of BSRIA’s Mechanical & Electrical Maintenance
KPIs. BSRIA asks building owner occupiers to assess their current
M&E service providers.
The 10 M&E KPIs were:
• Response to reactive/breakdown maintenance
• Quality of planned preventative maintenance
• Effectiveness of communication channels
• Relationship with your organisation
• Level of innovation and proactivity
• Compliance with legislative requirements
• Adherence to the budget
• Management of health and safety
• Management of documentation and site operatives
• Level of overall satisfaction
A scale of 1 to 10 is used to score each question; a score of 8 or
more is a reflection of good performance.

Maintenance KPIs
There were 173 usable responses from 17 different sectors, which
is the largest survey response we have received. There was a 63%
private to 37% public sector split, which is more weighted towards
the private sector than in previous years, but could be due to the
larger survey response. However the most responses to the survey
were from education, financial and property management sectors,
which is similar to previous years.
The M&E Maintenance KPI’s measured are illustrated in chart.
This compares the percentage of good score of 8 or more with last
year’s results. Nearly all the KPI’s have a substantial increase in the
scores this year. Disappointingly, although still the best scoring KPI,
legislative compliance has seen a slight decrease.
Half of the KPI’s have seen an increase in the mean score.
Innovation is typically a lower scoring KPI and has seen a slight
decrease this year, as has site management and overall satisfaction.

What VAT rate applies to you?
As a general rule supplies in the construction industry are subject
to VAT at the standard rate of 20% (since 4 January 2011). However,
certain work is zero rated or is liable to VAT at the reduced rate of
5%.
The construction of the following are all zero rated:
• Stand alone domestic dwellings
• Qualifying residential accommodation
• Qualifying charitable buildings
“Qualifying residential accommodation” covers buildings such
as residential accommodation for school pupils or students,
members of the armed forces, care homes providing residential
accommodation or any institution which is the sole or main
residence of its occupants.
“Qualifying charitable buildings” are those that will be used for a
charity only for its non- business purposes or as a village hall. Main
contractors involved in such projects should ensure that they obtain
a VAT certificate confirming the intended use of such buildings from
the customer before zero rating the services supplied. As such a
certificate applies only to the person making the direct supply to the
customer, sub-contractors should charge VAT on these projects.
Services supplied to housing associations in converting nonresidential buildings into residential buildings are also zero rated.
No certificate is required in respect of these supplies.
Alteration works (but not repairs) to listed buildings were zero
rated up to 30 th September 2012 but are now standard rated.
There are transitional rules allowing zero rating:
• where contracts have been signed, or
• where listed building consent has been applied for or given*, or
• where work has already begun*,
if this took place prior to 21st March 2012. In these limited
circumstances, zero rating can apply up to September 2015.
This zero rating in any case only applied to domestic, residential
and charitable buildings as above (or buildings that will qualify as
such after the alterations).
* Contractors must have ensured that the relevant consents for the
work had been obtained prior to the commencement of any work.

What VAT rate applies to you?
The reduced rate (5%) of VAT still applies to conversion work that
alters the number of “single household dwellings” in a building
(e.g. the conversion of a house to flats), non-residential buildings
to residential buildings, etc. It also applies to the renovation and
alteration of household dwellings that have been empty for 2 years
or more.
Change of rate
Special rules (called anti-forestalling measures) apply where
the VAT rate changes, intended to ensure the rate change is not
circumvented. Where the VAT rate changes on a specific date, it is
only the works completed at the date of the rate change that qualify
under the previous standard rate.

This ignores the impact of the loss of the personal allowance for
individuals with income in excess of £100,000.
Individuals who receive dividends from UK companies receive a 10%
non-repayable tax credit. This also applies in the case of individuals
holding less than 10% of the issued share capital (or 10% of a class of
share capital) of a non-UK resident company.
For savings income there is a 10% starting rate of tax on up to,
£2,880 of income. Savings income in excess of this band is taxable
at the rates above. However non-savings income takes priority
over savings income when using the £2,880 band.

Individuals holding 10% or more in a foreign company also benefit
from the 10% tax credit where the paying company is located in a
territory with which the UK has an appropriate (non-discriminatory)
double tax agreement, or is an ‘offshore fund’.
Company profits arising from development of specific patents may
qualify for ‘patent box’ treatment and subject to corporation tax at
10%. This is being phased in from 1 April 2013 and the low rate of
10% will apply from April 2017.
Higher rate taxpayers pay a further tax of 22.5% (or 25% of the
actual dividend). The additional rate of income tax is 45%. Dividend
income in excess of £150,000 incurs a further income tax liability of
27.5% (or 30.56% of the actual dividend).
The 2013 Budget announced the Government’s intention to
continue reducing these rates further so that the main rate will be
20% from 1 April 2015 resulting in a single rate.

Finance Act 2014 legislated to temporarily increase the limit for the
100% tax write down available for qualifying capital expenditure
to £500,000 p.a. for expenditure incurred during the period from
1 April 2014 to 31 December 2015. Prior to this, the 100% relief
applied to qualifying capital expenditure of up to £250,000 p.a.
incurred in the period from 1 January 2013 to 31 March 2014.
This limit is expected to reduce to £25,000 p.a. with effect from 1

With effect from 19 July 2011 where a residential property purchaser
(or a connected person) acquires more than one dwelling from the
same vendor (or a connected person) and makes a claim, the rate of
SDLT will be calculated based on the average consideration for each
property, subject to a minimum rate of 1%.
Annual Tax on Enveloped Dwellings (ATED)
From 1 April 2013, certain non-natural persons who hold UK
residential dwellings valued at more than £2m on specified valuation
dates are subject to an annual tax charge. Various reliefs and
exemptions can apply. An annual tax return needs to be completed
by 30 April each year, even if a relief applies, with payment due by 30
April each year, if applicable.

Finance Act 2014 introduced new bands which are due to apply
within the ATED scheme. With effect from 1 April 2015, properties
worth more than £1m but not more than £2m will incur an annual
charge of £7,000. This will be further extended to properties worth
more than £500,000 but not more than £1m with effect from 1
April 2016, giving rise to an annual charge of £3,500.
Where the ATED charge applies, capital gains tax arises on the
disposal of UK residential property held by UK and non-UK nonnatural persons.
Short Term Business Visitors
Any employer with non-UK employees performing non-incidental
duties in the UK even for one day needs to have an agreement with
HMRC that no PAYE is required or else they risk potential PAYE
penalties.
HMRC are taking a zero tolerance approach to organisations that
do not have a short term business agreement.

Tax relief for building work
1. When refurbishing, maximise revenue expenditure (e.g. repairs
- immediate tax write off) and minimise capital expenditure (but
see point 11 below).
2. If capital expenditure is incurred, ensure the claim for capital
allowances is maximised.
3. Incidental costs of installing capital equipment can be added to
the cost of the equipment, and capital allowances claimed as
appropriate to the equipment itself.
4. 100% tax write down (the Annual Investment Allowance (AIA))
may be available for the first £250,000 of capital expenditure per
annum for two years from 1st January 2013. Between April 2012
and January 2013, £250,000 per annum may be claimed under
AIA (apportioned for accounting period straddling January 2013).
Where businesses are connected this limit is shared.
5. Finance Act 2013 confirmed the 2012 Autumn Statement
announcement and increased the maximum AIA to £250,000 per
annum for two years from January 2013. In addition, from April
2012 the writing down allowance (WDA) reduced to 18% per
annum or 8% per annum for integral features.
6. The AIA can be allocated to any qualifying asset (except cars).
As integral features attract a lower rate of WDA it may be
advantageous to allocate it to these assets in priority to other
assets.

7. Capital expenditure on energy saving assets should qualify
for 100% tax relief in the year of acquisition. This Enhanced
Capital Allowance (ECA) is in addition to the AIA. Check
www.eca.gov.uk for qualifying assets.
8. A loss-making company claiming ECA relief can surrender the
associated loss for a tax repayment (clawed back if the asset is
disposed within the next four years).
9. Manufacturers of ‘green’ products may obtain competitive
advantage if they qualify for ECAs. Check www.eca.gov.uk for
qualifying criteria.
10. Expenditure not qualifying for the initial AIA and ECA reliefs,
will only qualify for an annual writing down allowance of 18%
(reducing balance) or 8% if it is an integral feature (prior to
April 2012 these rates were 20% and 10% respectively).
11. Regularly repair and maintain assets which qualify as integral
features because if a one-off repair cost of an asset (or repair
costs aggregated over 12 months) exceeds 50% of the capital
cost, the expenditure will be treated as capital not revenue.
This may affect the timing of tax relief and consequential
cashflow.
