Owner: Messer Haiphong Gas Products Co., Ltd – Hai Duong branch
The Entrusting Party: (Hereinafter referred to as the “Party A or MHP”)

Party A entrusts Party B to undertake engineering design and sign this contract agreed by
both parties for its 10000 ASU project in Haiduong, Vietnam.

2.1 Design Scope
Design Scope
Supply the necessary manpower, supervision/management, technical expertise, engineering
services, and other requirement related to the preparation of preliminary design, Detail
Engineering Design, and other documentations necessary for construction permit
acquisition, and bidding/request for quotation for the constructions, erection/installation
works which includes Civil Works, Mechanical Works, Electrical and Instrumentations for
the following as stated below.
10000Nm3/h Air Separation Unit(hereinafter referred to as the “ASU”)
Cryogenic liquid storage system 1x50m3 LAR Vacuum Tank
Product gas compression system 1x7000Nm3/h 3.0MPa Turbine oxygen compressor
1x12000Nm3/h 1.2MPa Product nitrogen compressor, 1x3000 Nm3/h O2 piston
compressor
This ASU will be connected to networking of the current product gases ( O2, N2, seal
gas, instrument air) of the 2# ASU
Circulating water system(Processing Capability: 1500T/h )
Power supply and distribution system (6.3KV, 400 VAC, 24 DC Lines), Electrical Room,
Control Room, Etc
Layout within the battery limit(includes: general layout, Road, Integrated pipeline,
Factory greening, Etc)
Delivery points to the pipeline which are out of border area (battery limit)(includes
pipeline underground). The delivery point is located 1 meter away from the Border area.
Power Supply, Lighting, Lightning protection and Grounding
- Pipe rack and Foundation
Fire Protection(or Alarm), network and Telephone wiring in battery limit
Party B will be responsible for the preliminary design and construction drawing design
of all the Items which mentioned hereinbefore. 3D design will be used in the construction
drawing design of main process pipelines which include gas pipe, liquid gas pipe and
cooling water pipe.

Party B shall guarantee the content and profundity of its “Preliminary design” is totally
accordance with National regulation, standard and Industry “Compiling regulation” in
Vietnam, and Party A’s opinion, Principle, detail object and requirement shall be fully
reflected in it. Party B shall also assist Party A and provide the technical report or report file
which is relative to the design. Party B shall guarantee the accuracy of Preliminary design
results and Construction drawing design results exceed 95%.
The Party B shall guarantee that each item “Construction drawing design” file shall be
faithful to carry out the professional design proposal which determined by Preliminary
design and owner’s approval comments. The profundity of the file shall be content to the
requirement of relative equipment and material purchasing order, engineering construction
and installation. (Design, equipment and material provided by the whole set equipment
manufacturer which sign contract with Party A are excepted)
