ORDINANCE PRESCRIBING GUIDELINES FOR THE GRANT OF
FRANCHISE, AUTHORITY OR LICENSE IN THE ESTABLISHMENT,
OPERATION AND MAINTENANCE OF COCKPIT INCLUDING OTHER
REGULATIONS RELATIVE THERETO IN THE MUNICIPALITY OF

INFORMATION/JUSTIFICATION/REMARKS/FINDINGS:
This Municipal Ordinance of Josefina regulates the establishment, operation,
and maintenance of cockpits, as well as the rules governing cockfighting and the
commercial breeding of gamecocks.
As outlined in this Ordinance:
2.1) Regular cockfighting events are scheduled to take place at licensed cockpits every
Sunday and on special or legal holidays, excluding Holy Thursday, Good Friday, and
Referendum day.
2.2) The franchise shall be in the form of an ordinance approved by the Sangguniang
Bayan and shall have a term of ten (10) years and renewable thereafter which shall be
filed 2 years before the expiration of the franchise.
2.3) The franchise fee is P250,000.00.
2.4) Barangays are also granted the authority to conduct cockfighting events
within their respective areas in accordance with the regulations established in
this Ordinance during their respective “Araw” Celebration .
However, in Provincial Ordinance No. 032-2020, pertaining to the Grant of
Franchise and Operation of Cockpits in the Province of Zamboanga del Sur, the
following provisions are stated:
3.1) Section 4c: A cockpit cannot operate without an annual license or permit
issued by the relevant local government unit for a given calendar year.
3.2) Section 4d: No Cockfighting activities shall be conducted anywhere except
at duly licensed cockpits;
3.3) Section 11: The term of franchise is fixed to five (5) years.
3.4) Section 12c: Franchise fees for fourth (4th) and fifth (5th) class
municipalities are fixed to One Hundred Fifty Thousand Pesos (Php
100,000.00). (Josefina belongs to the 5th Class Municipality).

RECOMMENDATION:
After thorough review and analysis, the Committee hereby recommends the
validity of Municipal Ordinance No. 11th-020-2023 IN THE MUNICIPALITY OF
JOSEFINA, except as to:
Section 5a: The 10-year franchise term.
Section 5b: The franchise fee set at Php 250,000.
Section 9: Provisions related to the conduct of cockfighting in Barangays during the
Araw ng Barangay Celebration.
