We refer to your Detailed Design submission registered on 19 Jan 2023 regarding the
abovementioned plot and accompanying Architectural and landscape drawings
Your Detailed Design submission is considered to be in general compliance with the DCR [Al
Furjan], and is therefore APPROVED with the conditions below that must be fulfilled prior to the
application for Nakheel compliance certificate.
With this letter we confirm handing
over one drawing set duly stamped as
approved and signed for your use and
record.
Design Variations
Any significant changes occurring
subsequent to the stamped approved
drawings due to purchasers’ decision
or comments and remarks from local
authorities, or any other reasons must
be duly notified to Nakheel and
approved before any incorporation into
the development irrespective of the
status of the development.
Particular Conditions
Overriding development criteria
Nakheel may change the criteria of its
development from time to time to
optimize development potential. The
Purchasers are deemed to agree and
abide to Nakheel policies on an
ongoing basis and are required to
conform to Nakheel future submission
requirements and the requirements of
all the local Authorities and the utility
services.
Limitation of liability:
NOC issuance from Nakheel does not
relieve the Purchasers or their
representatives from their obligation to
comply with the requirements of all
applicable Authorities and Utilities and
of their responsibilities for any errors
or discrepancies in their design, for
which the purchasers shall be
responsible for the rectification of such
errors at any time they become
apparent.
Trakhees approval:
Trakhees APPROVAL is a must.
Prior to the expiration of this NOC,
Purchasers shall apply for Trakhees
approval along with Nakheel stamped
drawings.
All amounts stated in this Agreement
are exclusive of any value added tax
(“VAT”), sales tax or equivalent tax. To
the extent that the VAT at standard
rate as prescribed in the VAT laws and
regulations
(“VAT
Amount”)
is
applicable at the time that the amount
payable is chargeable, it shall be
added to the amounts payable. If other
taxes become applicable to any
amounts payable, as a result of a
change in legislation applicable in
Dubai, this shall be added to the
amounts payable at the applicable
rates.
Disclaimer: This NOC is strictly designfocused and is limited to the elements of
the proposal and as they relate to the
applicable DCR. It is for the purposes of
acknowledging
in-principle
the
compliance of the submitted proposal and
by no means absolves Developer/
purchaser from any breach to the controls.
Accuracy
of
measurements
and
calculations and all Engineering and
technical solutions are not part of this
NOC. Developer/ purchaser remains
subject in full to all contractually binding
conditions stipulated in the Sales and
Purchase Agreement of the subject plot.
Developer/ purchaser also indemnifies
Master Developer and his employees
from any damage, risk or loss, or legal and
financial responsibility that may be borne
at any stage in relation to this
development.

Relocation of existing lamp post, traffic signs, gullies, manholes and any street furniture to be at plot owner cost.
No works shall be allowed outside plot limits or above maximum allowed height.
All roof’s MEP shall be screened and shall abide by the minimum setback 5.0m from last floor outer limits.
Plot Rainwater free discharge is not permitted outside the plot. It’s the plot developer / consultant / contractor responsibility to
contain the plot storm water for landscape or reservoir tank within the plot.
All existing and proposed gate levels and utilities connection shall be constructed in accordance to Nakheel infrastructure
drawings. Tie-in levels with external roads shall be considered.
It is the consultant / contractor responsibility to verify the site levels and to match with existing road levels in terms of -and not
limited to- gate levels, car accesses, FIC cover level, location and connection and any other connections that might be under
design by Nakheel infra-structure within subject development.
General Conditions:
1. This NOC is valid for a maximum period of 6 months and subject to SPA conditions, which commences from the date highlighted
as (Issue Date) and expires on the date highlighted as (Expiry Date) unless otherwise extended in writing by the Master Developer.
During this time, the developer/purchaser must apply for building permit to M/s Trakhees.
2. The developer/ purchaser is required to obtain shoring & piling approval NOC from M/s Trakhees and other relevant Authorities (if
applicable) in consideration of the gate level and Infrastructure development.
3. The Developer/Purchaser shall strictly comply with Nakheel requirements during construction & site mobilization (i.e. fence color
shall be white/Nakheel Blue & inside the plot limit).
4. The Developer/Purchaser shall obtain Nakheel NOC for advertising/branding on site fencing (if applicable).
5. It is mandatory to place Nakheel logo on any tower cranes during construction and the Developer/Purchaser shall obtain Nakheel
NOC prior installation of any artwork/advertisement on tower cranes or site fencing.
6. The developer/ purchaser shall enter into agreements with the relevant Utility Service Providers and documentary evidence shall
be submitted upon request and prior to construction.
7. Notwithstanding this NOC, the developer/purchaser is required to obtain all applicable NOC's from other relevant Authorities,
including but not limited to DEWA, DCA, Trakhees, Roads and Transport Authority, DU, Etisalat, District Cooling, GAS from Nakheel
Concessions Department-NAMI (Please note that Palm Jumeirah is different than other developments, GAS NOC to be obtained
from Lootah BC Gas).
8. Technical and financial implications of changing any service connections resulting from relocation of the connection points in
variation to the originally provided drawings must be paid for by the developer/purchaser. Any changes must first be approved in
writing by the Master Developer.
9. The total power demand load shall comply with the maximum allocated load for the mentioned plot(s) as approved by Master
Developer. No additional load will be allocated.
10. Obtain relevant NOCs from Nakheel infrastructure for connections and road tie-ins and plot entry points. Any changes to the existing
as built road and sidewalk shall be completed at purchaser’s own expenses.
11. If Building Permit expires and needs renewal or re-validation by TRAKHEES, the developer/ purchaser must obtain Nakheel
approval first.
12. This NOC is personal to the above referenced purchaser(s)/ developer of this property. It is not automatically transferable to new
property purchaser on sale of the property or any third party, if the NOC has not been implemented prior to sale, and is still valid. In
such circumstances this NOC will be deemed to be invalid and of no further force and effect. Should any new property purchaser
wish to proceed on the basis of the previously approved plans and drawings and NOC, the new purchaser will be required to either
make a fresh submission if the NOC has expired or apply to transfer the NOC to their name if extant.
13. Developer/ purchaser (including all his affiliates and associated legal entities, his and their personnel, subcontractors, consultants,
representatives, and agents), must indemnify and hold harmless Nakheel and all its affiliates and any associated legal entities from
and against any claims, losses, expenses, costs, actions, demands, damages and/or liabilities that may arise in connection with or
pursuant to the operations including any future liability that may arise as a result of the aforementioned operations, including but not
limited to injury or death of any person or damage or loss to any property of any party.
14. For Palm Jumeirah (only), Hoarding Fence is required to be made of PVC, white color with skinned surface following Nakheel
Standards.
15. Temporary Site Fencing (if required) must be in PVC material and shall be installed and maintained during construction and/or
modification works period exclusively by hoarding contractors that are listed by the Master Developer. PVC hoarding is a must within
Palm Jumeirah, Jumeirah Islands, Jumeirah Park, and Nad Al Sheba developments

NOC holder shall adhere to the safety and protection requirements of Railway
Protection Code of Practice and shall effectively follow all control measures related
to the restricted activities as specified in Railway Protection Code of Practice (CoP).

The NOC holder shall notify Rail Right of Way (RROW) Department prior to start of
activity on site through e-mail: RROW.WN@rta.ae or through phone (04 290 2265).
NOC revalidation application shall be submitted at least 2 weeks before the NOC
expiry date if extra period is required to complete the work. Otherwise, the applicant
shall apply for new NOC application in case if they fail to apply on time.
Copy of this NOC, drawings, method statements, risk assessments and any other
document that is part of this NOC shall be available on site.
The Applicant shall adhere to the NOC. Non-compliance to any of NOC conditions is
constitute as breach to Railway legalisation in Dubai. If additional work is required,
the applicant shall obtain new NOC for the additional scope of work.
For trial trench NOC, the opened trenches shall be backfilled and area shall be
reinstated within 2 weeks only from the commencement date of excavation.
The Applicant shall obtain NOC from Tabreed (National Central Cooling Company
PJSC), in case if work is interfaced with Tabreed network and plants.
The NOC holder shall notify RROW in case if project/activity is stopped or placed on
hold.
Where applicable, the applicant shall coordinate with Railway operator and/or
Maintainer and obtain the required permits to allow the work.
The NOC holder shall be entirely responsible to discharge all safety and legal
obligations as per relevant standards, codes and regulations.
In case of powering off Tram Traffic Signal is required, the NOC holder shall obtain
separate NOC for powering off the traffic Signal. Otherwise, it is considered as
breach of Railway Regulation 1-2017 and penalty could be applied due to work
without NOC for powering off traffic signal.
Reinstatement of Railway infrastructure affected by the work permitted under this
NOC shall be completed to the satisfaction of the Roads and Transport Authority,
Dubai. The area shall be left in neat and clean status and no surplus material shall
be left in Railway Protection Zones.
Signboards shall be displayed in Arabic and English languages providing
emergency contact numbers. The installation of sign boards shall not block the
visibility of RTA client’s advertisements. If signboard erection requires lifting
equipment (mobile crane), approval from RROW shall be sought before it is erected
at site.

The NOC holder shall be held responsible to submit incident or near miss report to
RROW and nearest Railway station. If the nature of incident has effect on railway
operation, the reporting should be made “immediately”. For all other cases it should
be within 24 hours of incident occurrence.
The NOC holder shall directly contact RTA Emergency Office on 8009090 for all
emergency cases.
Stopping, obstructing or disobeying Rail Agency Inspector during site inspection visit
is an offence and can be subject to fines in accordance with Railway Regulation
1/2017.
It is the NOC holder obligation to obtain NOC from Dubai Municipality (DM)
Environmental Section for any work in Creek area prior to commencement of work
on site. If the NOC holder failed to obtain NOC from DM Environmental Section the
NOC is considered as invalid.
Where applicable the NOC holder must coordinate with staff of the nearest Metro
station or Tram OCC.
Access to Railway facilities, not limited to, station, entrance pods, EEP, maintenance
access, evacuation and assembly points, and any other access to railway assets
shall be free from any obstacles during performing the restricted activity of this NOC.
The NOC holder shall provide and maintain physical separation between public and
worksite at all times during the duration of the activity.
No Flammable material storage is permitted under this NOC within railway critical
zone unless otherwise is explicitly mentioned and approved.
If this NOC is issued for house connection that is located within Railway Critical
Zone (5m measured from the edge of Railway Infrastructure), the Applicant shall
obtain separate NOC from Rail Agency prior to carrying out the work on site.
Parking of construction equipment or vehicles under the viaduct is prohibited unless
approved in the NOC.
