MEMORANDUM OF AGREEMENT KNOW ALL MEN BY THESE PRESENTS: This Memorandum of Agreement made and entered into by and between: The LAWANG BATO NATIONAL HIGH SCHOOL – SENIOR HIGH, a public high school created and existing under the laws of the Philippines, with the principal address at Mulawinan St., Lawang Bato, Valenzuela City, and represented by its Principal, JONATHAN O. LAGDAMEN, and hereinafter referred to as the “PUBLIC HIGH SCHOOL”; -andThe__________________________________________, a duly registered HTE/corporation created and existing under the laws of the Republic of the Philippines, with address at _________________________________________, herein represented by its HR Director/Manager, ________________________, hereinafter referred to as the “HOST TRAINING ESTABLISHMENT (HTE)” WITNESSETH THAT: WHEREAS, the LAWANG BATO NATIONAL HIGH SCHOOL – SENIOR HIGH is a duly recognized government high school, which offers,, a Senior High School program, with a curriculum requirement that the students enrolled therein undergo an 80 Hour Immersion program where qualified students will undergo industry exposure prior to their graduation in order to become adequately familiar to the actual industrial operations and management, thereby augmenting their formal training; WHEREAS, the HTE supports the Immersion Program of the public high school, and agrees to accept and accommodate the qualified students of LAWANG BATO NATIONAL HIGH SCHOOL – SENIOR HIGH; and WHEREAS, the LAWANG BATO NATIONAL HIGH SCHOOL – SENIOR HIGH and the HTE shall endeavor to ensure that the Immersion Program will forge strong academic-industry linkage between them, and that it will complement existing course curricula to match industry demand. NOW, THEREFORE, for and in consideration of the foregoing premises, the LAWANG BATO NATIONAL HIGH SCHOOL – SENIOR HIGH and the HTE do hereby agree and stipulate on the following: A. The LAWANG BATO NATIONAL HIGH SCHOOL – SENIOR HIGH shall: 1. Recommend qualified students who will undergo the Immersion Program taking into consideration the requirements of the HTE in terms of qualifications and number of students; 2. Submit the documents required to the Immersion Program to the HTE; and 3. Together with the students and parents concerned, renounce and waive any claim against the HTE for any injury that the students-trainees may sustain or any loss that they may suffer, personal, or pecuniary, arising from the negligence in the performance of their duties and functions while under training, except those which may arise from willful or negligent act or omission of the HTE, its officials, employees, representatives or agents. B. The HTE shall: 1. Deploy the student-trainees to the different operating units of the HTE (as stated in the Recommendation Letter) for the period of 80 hours. 2. Assign personnel who shall orient the student-trainees on the rules and regulations of the HTE, especially on such matters which pertain to safety and security precautions, and who shall monitor and supervise the student-trainees; 3. Involve the student-trainees in activities and tasks to develop their work attitude and creative abilities to become a professional employee based on the areas stated in the Recommendation Letter; 4. Enforce such rules and regulation that will apply in the conduct of the Immersion Program within its premises. These rules and regulations shall be made known to the LAWANG BATO NATIONAL HIGH SCHOOL – SENIOR HIGH and to the student-trainees. 5. Accomplish the necessary forms (e.g. Acceptance Form, Performance Evaluation Report) required by the LAWANG BATO NATIONAL HIGH SCHOOL – SENIOR HIGH, in connection with the training requirements of the student-trainees. 6. Issue a Certificate of Completion to each student-trainee upon fulfillment of all the training requirements. C. OTHER TERMS AND CONDITIONS. 1. It is expressly understood that there will be no employer-employee relationship between the HTE and the student-trainee of LAWANG BATO NATIONAL HIGH SCHOOL – SENIOR HIGH. 2. The student-trainee shall abide by the HTE’s rules and regulations and those imposed under the Immersion Program; otherwise, he/she shall be excluded from further participation. 3. The HTE reserves the right to discontinue the training of any student-trainee on reasonable ground/s upon a 30-day written notice to LAWANG BATO NATIONAL HIGH SCHOOL – SENIOR HIGH. 4. The LAWANG BATO NATIONAL HIGH SCHOOL – SENIOR HIGH, may discontinue the training of any student-trainee from the HTE on reasonable grounds after a 30-day written notice to the HTE. 5. This agreement shall be effective immediately upon the signing hereof and shall continue to be effective until the accomplishment of the purpose stated herein, provided however that any of the terms and conditions in this Agreement may be amended through a written agreement mutually consented and agreed upon by both parties; Provided further that, the HTE and LAWANG BATO NATIONAL HIGH SCHOOL – SENIOR HIGH reserve their right to withdraw their participation in this Agreement upon a written notice to the other, and upon mutual terms and conditions agreed upon by both parties herein.
