WHEREBY THE PARTIES HEREBY AGREE AS FOLLOWS: 1. Post Held. Your position will be and you will be reporting to the MANAGING DIRECTOR, who will specify your duties up on your commencement of the job. 2. Salary and other payments. The employer shall pay the employee gross salary so long as she shall remain in the service and actually performs her duties per month (See the attachment A). The agreed salary shall be subject to statutory deductions including pay as you earn (PAYE) of the gross salary per month. Other deductions will be made as the need arises in accordance with Tanzania laws. 3. Duration of Engagement. The employee will remain in service of the Shikundi Microfinance Limited for a period of ………………………………………… commencing on …………/…………/……….. and terminating on ………/…………/…………. One month before the expiry of this contract the employee must notify the employer in writing of his/her intention to renew the contract for another period. Upon receipt of the request employer shall have an option to accept or reject the request taking into consideration the prevailing financial position and employee’s performance assessment during the running contractual period. 4. Workstation. The employee’s workstation is Shikundi Microfinance Limited Head Office based at Toangoma, Temeke, Dar es Salaam unless otherwise assigned duties outside the campus as deemed necessary by the employer. 5. Job Description. The employee is employed according to the Shikundi Microfinance Limited objectives to perform the duties as outlined in the established job description attached to this agreement and according to implementation plan to be agreed between the employer and the employee. (See the Attachment B) 6. The Compliance. The employee is subject to statutory Employment regulations as issued and amended from time to time covered by Employment and Labour Relations Act No.6 of 2004 complimented with Human Resource Manual of Shikundi Microfinance Limited. 7. Termination of the Contract. Either party to the contract may give one-month notice in advance to terminate the contract. If the employee cannot discharge her duties as stipulated in the job description or as the profession requires and if there is any reason acceptable in the law, the employer shall be entitled to terminate this contract by giving one (1) calendar month notice as required by ELRA Act No.6, 2004. For a serious cause either party may give notice with immediate effect (24-Hrs notice). In this case a party tendering a notice shall be required to give one month’s gross salary in lieu of notice. 8. Disciplinary Code. The Company code of conduct (See the Attachment C) and disciplinary code (Employment and Labour Relations Act No. 6, 2004) shall be applicable for permissible penalties. 9. Leaves The employee shall be entitled to 28 consecutive days paid leave on an annual basis, other leaves including sick leave, Maternity leave, and Compassionate leave shall be granted as per Shikundi Microfinance Limited Human Resource Manual and the Employment and Labour Relations Act 2014. 10. Confidentiality. Employee is not entitled to either directly or indirectly makes use of confidential Information which has come to her/his knowledge or attention as a result of execution of this agreement. She / He is neither allowed to transmit or disclose any information regarding the Company which may come to her/his third parties at any time during this contract or there after unless otherwise required to do so by duly authorized official of the Company, or by a court of law or at the request of a person to whom such matter relate. 11. Hours of Work. Working hours shall be 08:30 hrs to 16:30 from Monday to Friday and 08:30 hrs to 13:30 hrs on Saturday. However, due to a requirement by particular activity, the days and time can be fixed otherwise save for the purposes of providing services throughout a week and without contravening statutory hours of work.
