UNIT 202 RENTAL AGREEMENT Background A. This is an agreement (‘The Agreement’) for a Long-Term Lease according to the terms set out below. B. The Landlords, the Tenants and the Premises are as set out in Schedule 1 of this Agreement. C. Collectively, the Landlords and Tenants will be referred to as ‘The Parties’. IN CONSIDERATION OF the Landlords letting and the Tenants renting the Premises, both parties agree to keep, perform and fulfil the following promises, conditions and agreements: Period and Terms 1. The Total Number of People in Renting Party is set out in Schedule 1. 2. The Renting Party is set out in Schedule 1. 3. The Rental Period begins at the Move In Date specified in Schedule 1. It will end at the Move Out Date specified in Schedule 1. Upon its expiration, this agreement may be renewed under such terms and conditions as may be mutually agreed upon by both parties. Rental Amount 4. The Monthly Rental Amount for the period is set out in Schedule 1. 5. The Reservation Fee is also set out in Schedule 1. Fees and Deposit 6. The Tenants undertakes to pay, to the Landlords, the required fees, and deposit as set out in Schedule 1 by the Date of Agreement unless otherwise agreed with the Landlords. Default Payment 7. The Tenants shall be given a grace period of seven (7) days, after the Monthly Payment Date, as set out in Schedule 1, to fulfill the Monthly Rental Amount to the Landlords. Termination 8. The Landlords have the right to inspect the premises with prior notice. Should the Tenants violate any of the terms of this agreement, the rental period shall be terminated immediately. The Tenants waive all rights to process if they fail to vacate the premises upon termination of the rental period. The Tenants shall vacate the premises at the Move Out Date. Public Utilities 9. Electric and Water Bills, excluding Association Bills, shall be billed to the Tenants and must be paid on Admin Office at 2nd floor on/before the due date. Electric and Water Bills on the month of the Move Out Date, as set out in Schedule 1, shall be deducted from the Tenant’s Security Deposit. Maintenance and Repairs 10. The Tenants shall maintain the premises in a good, clean, and ready to rent condition, and use the premises only in a careful and lawful manner. The Tenants shall vacate the premises in a ready to rent condition at the expiration of the rental agreement, defined by the Landlords as being immediately habitable by the next tenants. Tenants shall pay for maintenance and repairs should the premises be left in a lesser condition. The Tenants agree that the Landlords Page 1 of 4 shall deduct costs of said services from the security deposit prior to refund if Tenants cause damage to the premises or its furnishings. Trash 11. The Tenants shall dispose of all waste material generated during the rental period that the Landlords shall reasonably instruct them to in line with the Condominium Rules and Policies. Pets 12. The Tenants will bring no animals or pets of any kind onto the Premises without the permission of the Landlords. Subletting 13. The Tenants will not sublet the Premises without the express written permission of the Landlords. 14. The Landlords will be treated as giving express written permission, for the purposes of Clause 13 of this Agreement. Quiet Enjoyment 15. The Tenants shall behave in a civilized manner and shall be good neighbours respecting the rights of the surrounding property owners. The Tenants shall not create noise or disturbances likely to disturb or annoy the surrounding property owners. Rental Security Deposit 16. The Tenants shall deposit to the Landlords upon signing of this agreement an amount equivalent to the rent for one (1) month, as set out in Schedule 1. The Landlords shall refund the security deposit after deducting the Public Utilities stated in Clause 9, and the Maintenance and Repairs stated in Clause 10, if any. Attorney’s Fees 17. Tenants agree to pay all reasonable costs, attorney's fees and expenses that shall be made or incurred by Landlords enforcing this agreement. Use of Property 18. Tenants expressly acknowledge and agree that this Agreement is for residential purposes only and shall not be diverted to other uses. Illegal Use 19. Tenants shall use the property for legal purposes only and other use, such as but not limited to, illegal drug use, abuse of any person, harbouring fugitives, etc. shall cause termination of this agreement with no refund of rents or deposits. Possessions 20. Valuable items left behind by Tenants will be held for the tenant and every reasonable effort will be made to contact the tenant for return. If items are not claimed for longer than 6 months, they shall become the property of the Landlords. The Landlords shall not be held liable for condition of said items. Landlord Contact Details 21.
