DEED OF DONATION AND ACCEPTANCE
KNOW ALL MEN BY THESE PRESENTS
This Deed of Donation and Acceptance (the “Deed”) is made and executed by and
between:
The ADVOCATES FOR INTENSIVE RECONSTRUCTION OF MINDANAO
FOUNDATION (AFIRM FOUNDATION), INC., a foundation duly
organized, registered and existing under the laws of the Republic of the
Philippines, with principal office address at Metro Manila, Philippines,
represented in this act by its Treasurer, Charles Bradley Eivens, and
whose institution hereinafter referred to as “DONOR” 1 through a secretary
certificate ;
-in favor of The ASIAN RURAL LIFE DEVELOPMENT FOUNDATION, INC.
(ARLDF) a corporate foundation duly organized, registered and existing
under the laws of the Philippines, with principal office address at
Kinuskusan, Bansalan, Davao Del Sur, Philippines, represented in this act
by its corporate treasurer, Cherry Ogatis, and whose institution
hereinafter referred to as the “DONEE"2;
-WITNESSETH That1. That the DONOR is a foundation created to facilitate community development
efforts in communities of indigenous peoples in Mindanao and beyond. This
involves assisting communities in identifying, assessing and prioritizing needs.
AFIRM is also engaged in helping communities in development and
implementation of plans to address the needs that are prioritized by the residents.
2. That the DONEE is a foundation created to train poor farmers and technicians and
to expose government and other organizational leadership to upland farming
technology and serve as a catalyst in the application of sustainable agriculture and
health care. In addition, ARLDF also seeks to increase awareness of ecological and
sociological problems while focusing on food production, reforestation and family
health care, implementing projects to model sustainable systems in the most
critical areas of Asia.
3. That the DONOR is the registered owner of THREE (3) units of vehicles
particularly described as:

4. That the DONOR, for and in consideration of its desire to assist the DONEE in the
achievement of its objectives which are in line and supportive of the DONOR's
vision and mission, by these presents transfers and conveys, by way of
DONATION, unto the said DONEE, or its assigns, the aforementioned THREE
vehicles to be used by the DONEE'S various programs and projects.
5. That the DONEE hereby accepts said donation of the THREE VEHICLES
abovementioned, and does hereby express gratitude for the support and kindness
of the DONOR and commits that the said vehicles shall be utilized for the various
programs and projects of the Foundation.
6. That the DONOR represents and warrants to the DONEE that it has the corporate
power and authority to execute and deliver this Deed and to perform all the terms
and conditions hereof.
7. This Deed shall be governed by and interpreted in accordance with the laws of the
Philippines.
8. In case any one or more of the provisions contained herein shall, for any reason,
be held to be invalid, illegal or unenforceable in any respect, such invalidity,
illegality or unforce ability shall not affect any other provision of this Deed, and the
remaining valid provisions shall be valid and enforceable to the fullest extent.
IN WITNESS WHEREOF, the DONOR and the DONEE have hereunto set
their hands this __________ day of 2023 in CITY OF DAVAO, Philippines.
