Contract for the Borrowing of a Moped
This contract (the "Agreement") is entered into on December 18th, 2022, by and between Ethan
McKay ("Borrower") and the Shane Schacter ("Lender").
1. Borrower will pay the Lender 8 dollars per day for the use of the moped.
2. Borrower may sell the moped at any time before the spring season. If the moped is sold,
Borrower will no longer be responsible for any further payments. The moped must be
sold for at least 600 dollars.
3. If the moped is not sold before the spring season, Borrower will have up to 80 days after
the start of the spring season to sell the moped. If the moped is not sold within that time
period, Borrower will be responsible for the full purchase price of the moped.
4. Borrower is responsible for ensuring the moped is kept in good working condition and
will be responsible for any repairs or maintenance needed during the borrowing period.
5. The Lender retains ownership of the moped and has the right to repossess it at any time if
Borrower fails to make payments or breaches any of the terms and conditions of the
agreement.
6. This agreement is governed by the laws of the state in which the moped is located. Any
disputes arising from this agreement will be resolved in the courts of that state.
7. This agreement constitutes the entire agreement between Borrower and Lender and
supersedes any previous agreements or understandings, whether oral or written. No
changes or modifications to this agreement will be valid unless made in writing and
signed by both parties.
