Assignment 1 Case 1: 1. Name of the Case/Lawsuit or name of the individual or group who filed the complaint of discrimination. 2. Year when the incident took place. 3. When the residents brought it up with the state, the state supreme court enforced the covenant and the Shelley’s were unable to move on there property. Fortunately, the Shelley’s appealed the case which ultimately went to the Supreme Court. The Supreme Court ruled in favor of the Shelley’s who were able to move back to there house. Which law or title prohibits this form of discrimination? 7. An African American family named the Shelley’s bought a house and moved into a neighborhood in St. Louis Missouri. But the property that the house was bought on enacted a racially restrictive covenant. The residents of the neighborhood knew about this and decided to use it against the Shelley’s to prevent them from moving into this neighborhood. The residents brought it up with the state which they had to decide whether the Shelley’s were able to live in this neighborhood. What was the outcome of the case? 6. Shelley vs. Kraemer It was in violation of the Equal Protection Clause of the Fourteenth Amendment. “No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws” (Equal Protection Clause, 14th Amendment). The statement in this clause that supports the Shelleys is no shall deprive any person of property. The Shelley’s legally bought this house and piece of land and it should not have been taken away to them in the first place. While there are laws or titles that provide protection from discrimination, depending on your particular case, what additional steps would you recommend the organization/entity take to crease an inclusive environment? I would suggest that racial discrimination laws should not have ever been created. Or since the environment the Shelley’s moved in is very discriminative, provide educational classes to the people in the neighborhood to realize that there is no reason to discriminate against other people because of there skin. In addition, the idea of a racially restrictive covenant is completely uncalled for and should have never been brought into this world. Case 2 1. USWNT vs U.S Soccer The lawsuit took place in 2019 Location where the incident took place The lawsuit was due to gender discrimination in the salaries between the men’s and women’s national soccer teams. 4. Provide details of the discrimination/incident The USWNT is the National Soccer team for the United States that represents the country in events like The Olympics Games, FIFA World Cup and tournaments on that scale. In years prior the men were being supplied more income for there participation on the team that the women. But this did not make sense, the Washington post stated that “The women’s team contributed close or more than half of the federations revenue from games since 2016” (Kelly, 2). They also stated that the women would earn on average per man would earn $164,320 less or 38%. This shows a drastic difference in pay easily based on gender due to the evidence in how they are earning the same if not more than the males. 5. What was the outcome of the case? The women who were rightfully outraged about this discrimination sued the U.S Soccer Federation and fortunately settled on an agreement. The 61 women who were apart of the gender discrimination pay gap were awarded $24 million. They also agreed to “commit to providing an equal rate of pay going forward for the Women’s and Men’s National Soccer Teams.” One of the players on the US national team, Megan Rapinoe reported the outcome as a “huge win” in regard to women in soccer. 6. Which law or title prohibits this form of discrimination? The law that prohibits unequal pay based on gender is The Equal Pay Act of 1963. The law protects people for pay discrimination based on their sex. This law definitely supports the USWNT because they have the evidence on numbers that they are being underpaid and there is no excuse based on performance and revenue to back of the U.S Soccer Federation. 7. While there are laws or titles that provide protection from discrimination, depending on your particular case, what additional steps would you recommend the organization/entity take to crease an inclusive environment? If I was the head of the U.S Soccer Federation I would implement mandatory pay equality based on sex, racial/ethnic minorities, gender identity, disability or members of the LGBTQ+ community. Also, to ensure all voices are being heard I would hire a group of people who their main priority is to meet with the players, and workers and hear any recommendations, complains or answer any questions that the people have.
