w o r k each night. Zonta, Nebraska, was a t o w n whose

named it that. Job told h e r this as they sped over

M a n y w o m e n o f my generation believed that
separateness undermined equality, and we sought
integration. I have never referred to myself, f o r
Une example, as a w o m a n lawyer o r a w o m a n judge
because I have always believed that those were not
categories. That is, people are undoubtedly men and
women, but lawyers and judges do not have genders.
This is a viewpoint that is n o w controversial, and is
under attack by some feminist theorists who

propound the idea that w o m e n t h i n k differently from
men, and that there are gender-based intellectual
differences that should be recognized i n the work
place...
Although undoubtedly we are all affected by our

individual experiences and acculturation, our
common legal education has ingrained in us the
enormous importance in our democratic society of
tradition of independent and impartial judges. The
preservation of this tradition depends on judicial

20 integrity, which is the ability and willingness o f
upright judges to set aside, to the extent possible,
their personal sympathies and prejudices i n deciding

legal disputes. This i n t u r n requires o f judges honest
self-appraisal and the recognition and acceptance o f
one?s own fallibility. In some cases, this ideal may be
more easily said than accomplished. But, after more
than six years as a federal trial judge, I have not seen
any basis f o r believing that gender plays a role one
way o r the other in any particular judge's ability or
30 willingness to exercise self-restraint.
Talso believe that a good judge should recognize as
to all litigants, but especially as to c r i m i n a l
defendants, that ?[t]here but f o r the grace o f God go

Whether we call it humility, humanity, or
compassion, I have not observed differences in this

individual experiences on perception, Judge
Cedarbaum nevertheless believes that judges must
transcend their personal sympathies and prejudices
and aspire to achieve a greater degree of fairness and

with and attempt to work toward Judge Cedarbaum?s
aspiration, I wonder whether achieving that goal is
possible in all o r even in most cases. A n d I wonder

society. . . .

physiological o r cultural differences, a possibility I

market. Ken Rogoff, an economist at Harvard, argues

workers rises, firms will have a greater incentive to

unskilled labourers has been fairly stable, save for two
sharp declines.
The first drop came in the 14th century, and had
