RETHINKING THE COLOR LINE CHAPTER 28
QUESTIONS FROM THE NEW JIM CROW: INCLUDE PAGE NUMBERS
1. HOW DOES MICHELLE ALEXANDER DESCRIBE THE BIRTH OF THE NEW
JIM CROW? WHAT CONTRIBUTED TO BIRTH OF THE NEW JIM CROW?
Michelle Alexander says it is perfectly legal to discriminate against convicted criminals in nearly all the
ways in which it was once legal to discriminate against African Americans. Once labeled a felon, even for
a minor drug crime, the old forms of discrimination are suddenly legal again. In her words, “we have not
ended racial caste in America; we have merely redesigned it.” // When Obama was elected.
2. EXPLAIN AND PROVIDE DETAILS OF “OPERATION VALKYRIE.”
“The plan was known as Operation Valkyrie. The idea was that, once Hitler was dead, the military would
claim that the assassination was part of an attempted coup by the Nazi Party and the Reserve Army
would seize key installations in Berlin and arrest high-ranking Nazi leadership.”
3. SUMMARIZE THE RACIAL DISPARITIES IN OUR CRIMINAL JUSTICE
SYSTEM. INCLUDE HOW SOME DEFENDERS BELIEVE THAT THE
CRIMINAL JUSTICE SYSTEM IS FAIR AND NONDISCRIMINATORY.
African Americans are incarcerated in state prisons at five times the rate of whites. Black men face
disproportionately harsh incarceration experiences as compared with prisoners of other races.
4. WHAT WAS THE “UNITED STATES V. BRIGNONI-PONCE COURT RULING?
EXPLAIN.
“The Fourth Amendment held not to allow a roving patrol of the Border Patrol to stop a vehicle near the
Mexican border and question its occupants about their citizenship and immigration status, when the
only ground for suspicion is that the occupants appear to be of Mexican ancestry. Except at the border
and its functional equivalents, patrolling officers may stop vehicles only if they are aware of specific
articulable facts.” Because of their interest in preventing the illegal entry of aliens at the border, the
minimal intrusion of a brief stop if an officer suspects that a particular vehicle may contain aliens who
are illegally in the country may stop the car briefly, question the driver and passengers about their
citizenship and immigration status, and ask them to explain suspicious circumstances.
5. EXPLAIN THE ACLU’S BLACK LIST ASSOCIATED WITH THE LOS
ANGELES POLICE DEPARTMENT.
