«property_name» LEASE ASSIGNMENT/ADDITION ADDENDUM (Becomes a part of Lease Agreement) Leased Premises: «unit_address_line1», Columbus, Ohio 43202 Lease Assignment Effective Date: «lease_assignment_effective_date» Lease Agreement End Date: «lease_agreement_end_date» This Agreement is intended upon signing, to modify the original Lease Agreement (referenced as the “Original Lease” or “Lease” which shall include any prior modifications or extensions thereto) between «property_name» and the original Tenants (referenced as “Original Tenants” or “Current Residents”). The modification is due to one or more Original Tenant’s desire to vacate Leased Premises and assign their rights and responsibilities under Lease (“Vacating Resident”) to a new prospective resident (“New Resident”) by the Lease Assignment process. Vacating Resident(s) hereby assigns his/her interest in Leased Premises to all the residents who will now occupy the apartment (“Assignee Residents”).. Vacating Resident(s) releases and waives any interest in or claim to any one-time fees paid at the time of move-in or start of each renewal lease term. a) At the time the Lease Assignment takes effect, the Deposit, or whatever part has not been applied in payment of any Resident obligations under this Lease as set forth in the Lease and/or in compliance with state law, will be returned to the Vacating Resident. b) Vacating Resident(s) and the Assignee Resident(s) must enter into a separate agreement not involving «property_name» if Vacating Resident(s) is to receive any portion of the Deposit. Any exchange of Deposit will occur between the Vacating Resident(s) and the Assignee Resident(s). c) «property_name» will not distribute any portion of the Deposit to the Vacating Resident(s) until all the following have been completed: i) ii) iii) iv) the apartment is vacated (meaning, no persons are residing in the apartment), possession of the apartment is surrendered (meaning, all keys are returned) to «property_name», the apartment is left in a broom-clean condition with only normal wear and tear damage from the original move-in date, and the Assignee Residents provide «property_name» with a new or forwarding address. I/We understand that any one-time charges or pre-paid rent stays with the apartment and will be assigned to the new residents. I/We release and waive any interest in or claim to any one-time charges or pre-paid rent. 1. New Resident(s) must be pre-approved through the leasing office. Approval is obtained by New Resident completing an application to rent, passing the screening process, and signing a lease agreement. An Administration Fee of $«administrative_fee» and a Lease Assignment Fee of $«assignment_fee» per New Resident will be due. A pro-rated Resident Life fee for any New Resident not replacing a Current Resident, will also be due at time of move-in. 2. Apartment is given to New Resident(s) in an AS-IS CONDITION. No alterations, cleaning or improvements will be made to the apartment. Remaining Residents and New Residents acknowledge that all damages currently in existence at the premises are their responsibility at the conclusion of the lease term or any renewal thereof and that they will be charged for all damages above and beyond normal wear and tear that were created from the inception of the original lease agreement forward through the time when all residents vacate the premises. I/we have taken the time to inspect this apartment for any damages. I/we understand any and all damages currently in the apartment will now become my responsibility. 3. The «property_name» Account ledger for the apartment will be checked to ensure that rent is current and there are no outstanding balances. «property_name» will not proceed with any Lease Assignment until any and all outstanding balances are paid on the current account. 4. A Lease Assignment/Addition Addendum will be filled out and signed by all parties; both Current Residents and New Residents. This form is a legally binding addendum to the Original Lease. 5. Vacating Residents will need to return keys, activity cards, ids, parking passes, and provide a forwarding address to the leasing office at or before the signing of this agreement unless otherwise agreed in writing by «property_name». If the items listed above are not returned, Vacating Residents will be charged accordingly. 6. New Residents will pick up keys, activity cards and parking passes on the first day that the Lease Assignment takes effect. 7. Should the New Residents cancel prior to signing the lease, the Original Lease will remain in full force and effect and rent will be due by the Original Tenants pursuant to the terms of the Lease Agreement. 8. This Addendum shall have the same force and effect as if originally made a part of the lease. «property_name» I/We the current lease holders of apartment understand that «property_name» will not modify our Original Lease until all terms and conditions described in the Lease Assignment/Addition Addendum have been satisfied and all parties have signed the Original Lease, as modified. I/We acknowledge I/we have received a copy of the original lease agreement and abide to all terms and conditions.
