Legislation
Since the publication of the Blue Book 2012 several regulations have come into effect. A further raft of changes that will affect the industry are
in prospect, and these are outlined below with their likely dates of implementation.
New legislation
Green Deal
The Energy Act 2011 made provisions for ‘Green Deal’ – the legal framework is now
in place.
Future legislation
Infrastructure (financial assistance) Bill
Projects must be “nationally significant” and ready to start construction in 12
months. Projects relating to water, electricity, gas, telecommunications, railways,
health, education, court/prison facilities and housing all apply.
Energy Bill
Draft published by DECC on 22 May 2012. The Bill provides a legislative framework
for low carbon energy. Includes provisions for Energy Market Reform (EMR) and
investment in upgrading the grid by 2020.
Water Bill
Draft published by DEFRA on 10 July 2012. Based on the Water White Paper – Water
for Life, the Bill sets out changes including switching suppliers, modernising Ofwat’s
regulatory powers, and reforming connection charges “to help facilitate housing
growth” (DEFRA).

outsourcing is one approach that is perceived to lead to greater
effectiveness.
Outsourced maintenance service providers can bring best practice
to an organisation but a client will need year-on-year demonstration
of improvement. Measurement becomes important and adoption
of KPIs (Key Performance Indicators) is a powerful mechanism to
monitor performance.
BSRIA KPIs
This is the 9th year of BSRIA’s Mechanical & Electrical Maintenance
KPIs (these were revised 2008 to better reflect the M&E maintenance
industry). BSRIA ask building owner occupiers to assess their current
M&E service providers.
The 10 M&E KPIs were:
• Response to reactive/breakdown maintenance
• Quality of planned preventative maintenance
• Effectiveness of communication channels
• Relationship with your organisation
• Level of innovation and proactivity
• Compliance with legislative requirements
• Adherence to the budget
• Management of health and safety
• Management of documentation and site operatives
• Level of overall satisfaction
There was a 62% private to 38% public sector split, a similar response
to previous years. The most responses were from the property
management, financial, charity and education sectors.

Maintenance KPIs
The mean scores have all improved over the last 2 years with many
seeing their best scores to date. Communication has seen the largest
mean score increase of the KPIs. The 10 KPIs are looked at together
over the past five years. Most of the KPIs have improved this year.
However the statutory KPIs have seen little change from last year.
Relationship has the highest percentage score of 8 or more at 56%.
Predictably innovation is the lowest scoring KPI, but this year is at its
highest with 33% of good scores.
Maintenance providers have had to really up their game in order
to hang on to those hard won contracts. Relationships have paid a
big part in this, but it is not a standalone KPI, its score is a reflection
of all the other KPIs e.g. relationships rely profoundly on good
communication.

Useful financial information
What VAT rate applies to you?
As a general rule supplies in the construction industry are subject
to VAT at the standard rate of 20% (since 4 January 2011). However,
certain work is zero rated or is liable to VAT at the reduced rate of 5%.
The construction of new stand alone:
• domestic dwellings,
• qualifying residential accommodation, and
• qualifying charitable buildings,
are all zero rated.
Services supplied to housing associations in converting nonresidential buildings into residential buildings are also zero rated.
No certificate is required in respect of these supplies.
Alteration works (but not repairs) to listed buildings were zero
rated up to 30 September 2012 but are now standard rated. There
are transitional rules allowing zero rating:

where contracts have been signed, or
where listed building consent has been applied for or given*, or
where work has already begun*,
if this took place prior to 21 March 2012. In these limited
circumstances, zero rating can apply up to September 2015.
Qualifying residential accommodation covers buildings such as
residential accommodation for school pupils or students, members of
the armed forces, care homes providing residential accommodation or
any institution which is the sole or main residence of its occupants.

What VAT rate applies to you?
The reduced rate (5%) of VAT still applies to conversion work that
alters the number of “single household dwellings” in a building
(e.g. the conversion of a house to flats), non residential buildings
to residential buildings, etc. It also applies to the renovation and
alteration of household dwellings that have been empty for 2 years
or more.
Change of rate
Special rules (called anti-forestalling measures) apply where the VAT
rate changes, intended to ensure the rate change is not circumvented.
Where the VAT rate changes on a specific date, it is only the works
completed at the date of the rate change that qualify under the
previous standard rate.

Dividends from UK companies receive a 10% non-repayable tax credit.
This also applies in the case of individuals holding less than 10% of the
issued share capital (or 10% of a class of share capital) of a non-UK
resident company.
Individuals holding 10% or more in a foreign company also benefit
from the 10% tax credit where the paying company is located in a
territory with which the UK has an appropriate (non-discriminatory)
double tax agreement, or is an ‘offshore fund’.
Higher rate taxpayers pay a further tax of 22.5% (or 25% of the actual
dividend). From 6 April 2010 there has been an additional higher
rate of income tax of 50% payable by tax payers with taxable income
in excess of £150,000. Dividend income in excess of £150,000 will
incur a further income tax liability at 32.5% (or 36.11% of the actual
dividend).
In the 2012 Finance Act it has been confirmed that from 6 April 2013
the additional rate of income tax will be 45%; as outlined above
for the tax year ended 5 April 2013 this is 50%. Dividend income in
excess of £150,000 will incur a further income tax liability of 27.5%
(or 30.56% of the actual dividend).
For savings income there is a 10% starting rate of tax on up to
£2,710 of income. Savings income in excess of this band is taxable
at the rates above. However non-savings income takes priority over
savings income when using the £2,710 band.

The 2012 Budget confirmed the Government’s intention to continue
reducing these corporation tax rates further so that the main rate will
be 23% from 1 April 2013, this was legislated in Finance Act 2012.
Additionally Budget 2012 announced the Government’s intention

from 1 April 2014. If this change is to be made it will be included in
subsequent legislation.

Finance Act 2011 legislated the announcement at the 2010
‘emergency budget’ to reduce the limit for the 100% tax write
down available for qualifying capital expenditure to £25,000
p.a for expenditure incurred from 1 April 2012 (6 April 2012 for
unincorporated businesses). From April 2010 to 31 March 2012 (5
April 2012 for unincorporated businesses) the limit was £100,000
p.a.
Prior to April 2012 the rate of WDA was 20% for plant and machinery
and 10% for integral features and long life assets.
Legislation will be introduced in the Finance Bill 2013 to extend the
100% first year allowance for low emission cars for two years to 31
March 2015 except for leased cars. The qualifying threshold will also
be reduced to 95g/km of CO2.

Tax relief for building work
1. When refurbishing maximise revenue expenditure (e.g. repairs immediate tax write off) and minimise capital expenditure (but see
point 11 below).
2. If capital expenditure is incurred ensure the claim for capital
allowances is maximised.
3. Incidental costs of installing capital equipment can be added to the
cost of the equipment and capital allowances claimed as appropriate
to the equipment itself.
4. 100% tax write down (the Annual Investment Allowance (AIA)) may
be available for the first £25,000 of capital expenditure per annum
from 6 April 2012 (1 April 2012 for limited companies). Before April
2012 £100,000 may be claimed under AIA (apportioned for accounting
period straddling April 2012). Where businesses are connected this
limit is shared.
5. Finance Act 2011 confirmed the 2010 ‘emergency’ budget
announcement and reduced the maximum AIA to £25,000 per annum
from April 2012. In addition, from the same date the writing down
allowance (WDA) reduced to 18% p.a or 8% p.a for integral features.
7. Capital expenditure on energy efficient and environmentally
friendly assets should qualify for 100% tax relief in the year of
acquisition. This Enhanced Capital Allowance (ECA) is in addition to
the AIA. Check www.eca.gov.uk for qualifying assets.
8. A loss-making company claiming ECA relief can surrender the
associated loss for a tax repayment (clawed back if the asset is
disposed within the next four years).
9. Manufacturers of ‘green’ products may obtain competitive
advantage if they qualify for ECAs. Check www.eca.gov.uk for
qualifying criteria.
10. Expenditure not qualifying for the initial AIA and ECA reliefs, will
only qualify for an annual writing down allowance of 18% (reducing
balance) or 8% if it is an integral feature (prior to April 2012 these
rates were 20% and 10% respectively).
11. Regularly repair and maintain assets which qualify as integral
features because if a one-off repair cost of an asset (or repair costs
aggregated over 12 months) exceeds 50% of the capital cost, the
expenditure will be treated as capital not revenue. This may affect
the timing of tax relief and consequential cashflow.
6. The AIA can be allocated to any qualifying asset (except cars). As
integral features attract a lower rate of WDA it may be advantageous
to allocate it to these assets in priority to other assets.
