GENERAL As part of Nigerian L o c a l Content, Community Relations and Labor plan is drawn on the in-depth experiences and knowledge of both Green Energy International Limited (Herein after Refer to as GEIL) and TREXM Oil and Gas Services Nigeria Limited (Herein after refer to as TREXM) within the Niger Delta region of Nigeria. This plan will address all community relations issues and aspects that may arise during the execution of the project in the complex and challenging environments. Implementation of this plan will require flexibility, good communication and cooperation between GEIL, TREXM and host community. 2. ORGANISATION To achieve the set Community Relations Objectives, TREXM has nominated the SHE Manager to double as the Community Affairs (CA) Rep. The CA shall liaise with GEIL Rep. in engaging community workers and ensuring that TREXM meets all GEIL requirements in Community relations. The community affair Rep CA shall be responsible for the creation of an enabling environment for TREXM to operate and execute the Community Engagement (Relations) Plan in tandem with GEIL. The TREXM CA (Community affair) Rep has the duty to report on a daily basis to GEIL Rep. all Community Issues occurring on the worksite or perceived issues, which have the potential to cause work disruption so that they can be proactively dealt with. 3. HOST COMMUNITIES TREXM i s aware t h a t t h e ho st c o m m u n i t i e s a r e en t i t l ed t o some benefits when contractor companies have a job to execute in such areas. TREXM shall ensure that its Community Relations practice in respect of the project aligns with the implementation process of GEIL. 4. PRE-MOBILISATION MEETING WITH THE PRINCIPAL HOST COMMUNITIES TREXM Community A f f a i r s Rep shall hold a Pre-Mobilization Meeting with GEIL team where TREXM CA will inform GEIL on the details of the job execution plan to enable G E I L to initiate pre-mobilization meeting with the host communities and conclude all Community worker engagement in line with GEIL policies on community subcontracts and supplies. 5. COMMUNITY EXPECTATION (S) TREXM through GEIL, shall discuss on the expectations of the Community in line with GEIL’s requirement and shall draw up a programme on how the expectation(s), can be met within the life of the Project. TREXM will comply as directed by GEIL and within the standards of the project execution procedure so as not to create a conflicting situation. This will include deciding on the Community labor Sub-Contractors and other Community Sub-Contractors that will be involved in the supply or provision of different services as applicable. 6. COMMUNITY RELATIONS MEETING All Community Relations Meeting between TREXM and the Host Communities shall take place at TREXM base office and shall be approved by GEIL. TREXM shall not open up any discussion with any community representative or individual from the community without GEIL Representatives attendance and approval. TREXM shall not make any payment to individuals or groups without GEIL Rep’s knowledge and approval. 7. COMMUNITY DISTURBANCE Reports of Community related Work Stoppages or delays to the Work shall be investigated immediately. Stoppages or delays to the Work during all normal working shifts shall be categorized under community issue and communicated to GEIL CDD site Representative, TREXM shall immediately notify GEIL of any labor disturbances or disputes of any nature and provide follow-up written notification within 24 hours of the beginning of any labor disturbance. ➢ Strike, local or general. ➢ Outbreak of Community Hostilities Unavailability of workforce. ➢ Community Action or threat of action that prevents TREXM from mobilizing or working at the Construction Site(s). ➢ The recording of the actual time of work stoppage will be recorded. ➢ Disputes shall be resolved offsite through the Conflict Resolution Mechanism without disruption to the work. ➢ All industrial related issues and disputes applicable to the entire TREXM workforce shall be the responsibility of TREXM management. 8. REPORTING OF COMMUNITY RELATED ISSUES/PROBLEMS ➢ It is the responsibility of TREXM Construction Manager and/or the Project SHE manager to inform GEIL Representative verbally as soon as there is Work stoppage. ➢ Thereafter, a written notification shall be sent to GEIL’S Representative within three hours of a stoppage. The preformat in shall be used in making this written notification. ➢ For the duration of the Work Stoppage, TREXM shall, on a daily basis, inform GEIL Representative, i n writing, t h e progress being made and efforts being taken or intended or agreed by both TREXM to end the stoppage in line with the Contract requirements. ➢ Within three hours of the end of the stoppage and re-commencement of the Work, TREXM Oil and Gas Services Nigeria Limited. 77, Samuel Adedoyin Street, Off Sinari, Daranijo Street, Victoria Island Lagos - Nigeria Engineering, Procurement, Construction, Installation and Commissioning of Otakikpo PEPF Distribution System Upgrade at Otakikpo Marginal Field DOC CLASS HEALTH SAFETY AND ENVIRONMENTAL MANAGEMENT PLAN Doc Title: COMMUNITY RELATIONS PLAN Doc No.: TRX-HEMS-PLN-0015 Page 5 of 8 TREXM shall inform GEIL Representative in writing stating the date and time of the end of the stoppage and re-commencement of the work. ➢ On a monthly basis, on the tenth working day of each month, or as stipulated by GEIL and TREXM, shall prepare a detailed schedule to show the cumulative total days of stoppages up to the last day of the preceding month attaching copies of all relevant reports to support the schedule. This will provide statistical information, which can be used as a basis to help TREXM and GEIL assess the level of Community Interference on the Project and also help in predicting statistics for future. 9. RESOLUTION OF A COMMUNITY RELATED WORK STOPPAGE The following procedure shall be followed in the resolution of a Community related Work Stoppage: a) Upon the establishment of the fact that a Community related issue has led to a work stoppage, mobilization to or work at the worksite, a meeting shall be convened within 24 hours between TREXM site Management / Community Relations Rep and GEIL Representative, to be attended by: ✓ TREXM’s Construction Manager. ✓ GEIL’s Representative ✓ TREXM’s Community Affair. The main aim of the meeting shall be to determine and agree on possible solutions to end the stoppage of work. The Resolution of the work stoppage shall be the responsibility of TREXM. 10. The Agenda ➢ Discussion of the reports following the work stoppage and any other. available information to establish the reasons why the Community stopped the work. ➢ Proposal of solutions from TREXM and GEIL advise/input. ➢ If the cause of stoppage is because of the action or the threat of action by criminal elements either within or outside the Community, then due consideration shall be given to a request from the relevant Nigerian Authorities, for appropriate intervention. ➢ GEIL approval of the solution to end the Work Stoppage. ➢ Assignment of actions to nominated individuals and time frames in order to expedite the agreed action. ➢ If the agreed solution requires a meeting with the Community, the meeting should be organized by TREXM team with selected key members of the Community and will be convened in TREXM office. TREXM’s Community Affairs Rep. ✓ GEIL’s Community Relations Rep The meetings shall be reconvened regularly until the situation is fully resolved. The minutes of the previous meeting shall form the basis of the agenda and shall be prepared and issued by TREXM. All meetings shall be recorded and actions required of nominated persons shall be indicated. 11. Communicating Community Affairs Issues Community Affairs Issues arising with Host Community shall be communicated to TREXM direct workforce through their supervisors, who shall keep them abreast and direct their responses in the event of unrest from the Community Workers. On a Weekly basis site Management shall review the Community Affairs Issues during the Weekly CA Review Meetings. There shall be regular pro-active visits/meetings by TREXM CA Rep (formal and informal) to brief them on regular basis. 12. COMMUNITY AFFAIRS PERFORMANCE MONITORING Community Affairs Performance will be monitored by comparing actual performance against set targets and objectives and highlighting major Community Affairs Issues in the Monthly CASHES Report. Regular Audits shall be carried out to assess the level of compliance with Contractual provisions. 13. NIGERIAN LOCAL COMMUNITY LABOUR PLAN Nigerian Local Community labor is labor available from local communities especially the Host communities in Nigeria. TREXM shall engage able bodied and ready to work men from the host Communities as skilled and unskilled workers. “Unskilled’ workers are labor workers not possessing any specific craft or trade skills, training and experience, while “Skilled Workers” are labor workers trained and experienced in one of several craft or trade skills including but not limited to:, electricians, painters, mechanics, equipment operators, etc. Special skilled workers include grit blasters and spray painters. TREXM plans to employ approximately 30% of the workforce from the host communities as Skilled and unskilled workers. EMPLOYMENT OF LOCAL COMMUNITY LABOUR TREXM shall hire competent and qualified community workers to work under the supervision of skilled and experienced TREXM’s personnel. These local community workers shall be provided by the RDC/Community and shall be under the community labor subcontractors t o be approved by GEIL TREXM shall complete and submit GEIL Contractor’s brief form 4 - 6 weeks prior to mobilization by contractor. GEIL Project Rep and TREXM meet for internal alignment on community content agree on number of community workers for the project and sub-contracting strategy. The number of workers to be hired must be aligned with the scope of work and solely determined by Company & Contractor and shall not be less than 30% of total local workforce G E I L engages community R e p s on the required labor numbers and skills & sub-contracts with deadline for submission of names. Community candidates shall be interviewed, tested and selected by TREXM. In t h e event of a community w o r k e r being relieved of a job on grounds of misconduct or unsuitability, the community will be given the opportunity to make an acceptable replacement; f a i l i n g which TREXM will fill in the position as desired. TREXM/community labor sub-contractor will issue a contract of employment to each individual Community worker to be employed. The contract of employment shall specify the type of work offered by the TREXM and/or its subcontractors, the work schedule, the work hours, terms of employment, compensation, work codes and practices, safety rules and regulations, including GEIL’s drug and alcohol policy. All Community workers will be required to sign a contract of employment indicating their agreement to the terms and that they are fit to perform the duties specified. TREXM shall implement the prevailing wage regime for community workers in the Erha and Usan Location for skilled and unskilled workers. Specialized skilled workers such as scaffolders, Grit blasters and spray painter shall also be paid salaries that are prevailing in the area. However, such services and Sub-Contracting shall be considered in line with TREXM’s pricing and quality standards for other sub-contracting jobs, while the workers daily rate shall be in line with GEIL approved rate. This daily rate will be reviewed in line with any review as advised by GEIL. 15. SAFETY TRAINING Local Community workers on the Project shall undergo all the prescribed safety training as stipulated in our training matrix. These trainings are pre-requisite to their mobilization to work site. TREXM shall take responsibility for the cost of training, transportation and feeding in all TREXM organized training in line with TREXM training plan. TREXM/GEIL shall conduct orientation for workers to ensure they are briefed on basic procedures, the terms of employment, work codes, security protocols and safe practices maintained at the workplace, including GEIL’s drug and alcohol Search policy. TREXM will provide PPE and safety training for all Community workers though GEIL.
