Although Alan initially wanted RM10,500, the conversation ended after Alan agreed to sell and Rozana agreed to purchase the truck for RM10,000, with a RM1,000 down payment and the balance on delivery. The next day, Rozana sent Alan a cheque for RM1,000, which Alan promptly cashed. One week later, when Rozana called Alan and inquired about the truck, Alan informed Rozana he had several prospects looking at the truck and would not sell for less than RM10,500. The following day Alan sent Rozana a properly executed cheque for RM1,000 with the following notation thereon: “Return of down payment on sale of the truck.” After notifying Alan that she will not cash the cheque, Rozana sues Alan for damages. Alan believes that he has a right not to have a contract with Rozana and he seeks advice from his lawyer Megat. Megat who is Alan’s family lawyer advise him that Alan can terminate the contract at any time he will because the truck belongs to Alan. Megat also promise that he will solve Alan’s problem if Alan sold his plantation located in Senawang below the market price. Alan agreed and he sign a conveyance contract without further reading the terms in the contract. One month later, as agreed Alan does not receive any money from Megat and Alan remind Megat about the due payment. Megat told Alan that there will be no money shall be paid to Alan because Alan agreed to transfer the title of the land as an exchange to Megat’s services on solving Alan’s problem with Rozana. Alan was very shocked and upset. He told this to Anita who is his sister. Anita suggested Alan get advice from her friend Muthu. In the meantime, Alan received a summon from Rozana. While Alan’s wife notified Alan that the prospect named Zack informed her that he cannot make payment immediately to Alan because his book cheque and all necessary document was wet due to a flooded incident at his office area. Alan was frustrated because he needs the money to pay his office utilities bills which was not paid for two months due to the pandemic covid19. Discuss.
