THE COURT SYSTEM IN MALAWI The court system in Malawi is made up of three major components unlike the English Court system of which it adapted from where the Supreme Court is separate from the court of appeal. It comprises of the following: The Supreme Court of Appeal The High Court The Subordinate Court- comprised of three main compartments as following; The magistrates court; the child justice court and the industrial relations court. The Supreme Court of Appeal This is the superior court in Malawi. This court is a superior court of record that has all powers than any other court in Malawi. The phrase “court of records” means that all acts and proceedings are kept/recorded for perpetual memory and testimony and the court itself holds the power to fine and imprison for contempt for its authority. This court is composed of the chief justice and ant member of the justice appeal as prescribed by the parliament. In any kind of hearing except for interlocutory/intermediate matters the law requires that there should be an uneven number of justices of appeal and they should not be less than 3 members.
