CONTRACT OF LEASE
KNOWN TO ALL MEN BY THESE PRESENTS:
This contract is made and entered into this 24th of April 2021 at _____________________ City,
Philippines by and between:
JUAN C. DELA CRUZ, of legal age, Filipino, residing at
10 Azucena Street, Lower Bicutan , Taguig City, Philippines, referred to
as the LESSOR, and
ELAINE KAYE B. SUAREZ, Filipino, of legal
age, Filipino citizens, with address at
#40 Kalayaan B St. Batasan Hills, Quezon City, Philippines,
referred to as the LESSEE.
Terms and Conditions
That the LESSOR leases unto the lessee who accepts in lease as it is: Unit A111, a fully-furnished
one-bedroom condominium unit located at Sunrise Drive, Sea Residences, Mall of Asia Complex,
Pasay City, Philippines, owned by JUAN C. DELA CRUZ.
1. PURPOSES: That the LESSOR hereby agrees and grants to the LESSEE the use of the abovementioned unit A111 located at Sunrise Drive, Sea Residences, Mall of Asia Complex,
Pasay City, Philippines for six (6) months from April 24, 2021 to October 24, 2021;
2. RENTAL RATE: That in consideration of the use by the LESSEE of the condominium unit
B210, the LESSEE shall pay the LESSOR the monthly rental fee of PHP 25,000.00 (TwentyFive Thousand Pesos) INCLUSIVE OF ASSOCIATION DUES;
3. ADVANCED PAYMENT AND DEPOSIT: That upon signing this agreement, the LESSEE
hereby agrees to pay to the LESSOR a one-month deposit of PHP 25,000.00 (Twenty Five
Thousand Pesos) and one-month advance rental fee of PHP 25,000.00 (Twenty Five
Thousand Pesos) cash/bank transfer;
4. That the deposit shall also cover for damages which the LESSEE may sustain by reason of
the non-fulfillment of this agreement such as non-continuation of the lease, and/or to be
used for all repairs necessary after the lease in order to preserve the leased premises in
the same serviceable condition for which they were before the lease; and/or to pay due
or back bills such as light, water, etc. and whatever is the balance, after deducting all
expenses incurred, shall be refunded to the LESSEE. The said deposit will not be applied
to cover back rentals;
5. That all payments shall be made to the bank account of the LESSOR with the following
details:

6. That the first payment shall commence on the 24th of MAY 2021;
7. MONTHLY UTILITY BILLS: That the LESSEE agrees to pay all utilities such as electricity,
water, cable TV, Internet and other services used on the leased premises during existence
of this agreement, EXCEPT THE ASSOCIATION DUES;

8. DEFAULT PAYMENT: In case of default by the LESSEE in the payment of the rent, the
LESSOR at its option may terminate this contract and eject the LESSEE and may forfeit
whatever rental deposit or advances have been given by the LESSEE. There will be
additional 5% penalty of the rental per day as a penalty for delayed payment.
9. FORCE MAJEURE: If whole or any part of the leased premises shall be destroyed
or damaged by fire, flood, lightning, typhoon, earthquake, storm, riot or any other
unforeseen disabling cause of acts of God, as to render the leased premises during
the term substantially unfit for use and occupation of the LESSEE, then this lease
contract may be terminated without compensation by the LESSOR or by the LESSEE by
notice in writing to the other.
10. LESSOR'S RIGHT OF ENTRY: The LESSOR or its authorized agent shall after giving due
notice to the LESSEE shall have the right to enter the premises in the presence of the
LESSEE or its representative at any reasonable hour to examine the unit or to exhibit the
leased premises to prospective LESSEE, or for any other lawful purposes which it may
deem necessary.
11. EXPIRATION OF LEASE: At the expiration of the term of this lease or cancellation thereof,
as herein provided, the LESSEE will promptly deliver to the LESSOR the leased premises
with all corresponding keys and in as good and tenable condition as the same is now,
ordinary wear and tear expected devoid of all occupants, movable furniture, articles and
effects of any kind. Non- compliance with the terms of this clause by the LESSEE will give
the LESSOR the right, at the latter's option, to refuse to accept the delivery of the
premises and compel the LESSEE to pay rent therefrom at the same rate plus Twenty
percent (20 %) thereof as penalty until the LESSEE shall have complied with the terms
hereof. The same penalty shall be imposed in case the LESSEE fails to leave the premises
after the expiration of this Contract of Lease or termination for any reason
whatsoever.
12. That the LESSEE will at his/her expense make all repair necessary to keep said premises
from deteriorating in value or condition during the existence of said lease;
13. That the LESSEE agrees not to paint, make alteration partitions, or changes in the
electrical installation, plumbing, or any other improvements within the leased premises
without the prior written consent and approval of the LESSOR and work of improvements
shall be under the direct supervision of the LESSOR and improvements so introduced by
the LESSEE shall upon completion thereof, form integral part of the leased premises and
shall not be removed there from but shall belong to become exclusive property of the
LESSOR without any right on the part of the LESSEE to reimbursement of the cost or value
thereof;
14. That the LESSEE agrees not to bring unto or store in the said premises inflammable goods,
explosives or other articles which may increase the fire hazard or fire insurance of the
leased premises, nor install there in any apparatus, machinery or equivalent which may
cause obnoxious odors, tremors or noise or any device which the LESSOR may reasonably
prohibit. The LESSEE further agrees not to use firewood or kerosene stove inside the
premises;
15. That the LESSEE shall be responsible at all times for all acts done by any person allowed
access by him to the lease premises;
16. That the LESSEE shall not directly or indirectly sublease, assign, transfer, convey,
mortgage or in any way encumber his/her lease to the whole part of the leased premises
under any circumstances whatsoever;

17. That the LESSEE shall comply with any and all laws and ordinance, regulation or orders of
the National City government authorities arising from, or regarding the use, occupation
and sanitation of the leased premises. Failure to comply shall be exclusive risk and
expense of the LESSEE;
18. That an inventory check shall be done before the commencement of the lease and after
the period of the lease;
19. That the LESSEE shall be responsible for the maintenance of the air-conditioning units;
20. That the renewal of the contract after SIX MONTHS will be subject to a new rate of the
lease.
