An Act of Parliament that was legislated by the Malaysian government that was approved by the king on 27 April 1971. 2. This Act is to provide for the establishment, organization and management of Universities and Public University Colleges and for matters connected herewith. 3. This act was amended several times, as follows : 24 September 1971 13 May 1975 20 February 1983 1 October 1996 8 January 2009 22 June 2012. 18 January 2019 APPLICATION OF AKTA UNIVERSITI DAN KOLEJ UNIVERSITI 1971(PINDAAN 2019) 1. AUKU is applicable to all public Universities established under AUKU 1971. 2. For example: a) UNIVERSITI MALAYSIA SARAWAK b) UNIVERSITI SAINS MALAYSIA c) UNIVERSITI MALAYA d) UNIVERSITI KEBANGSAAN MALAYSIA e) UNIVERSITI MALAYSIA SABAH UNIVERSITI MALAYSIA SARAWAK (UNIMAS) 1. UNIMAS is established under AUKU on 24th December 1992, by virtue of Section 6 (1) of the AUKU 1971. (P.U.(A) 543). 2. Thus, all provisions in the AUKU is implemented and applicable to UNIMAS, and its Constitution. Definition & Interpretation Student: means a registered student, other than a student at an institution allied to the university or University College, who is following a course of study, instruction, training or research of any description at the preparatory, under-graduate, postgraduate or post-doctoral level on a full time or part-time basis in, by or from the university or University College, and includes a distance-learning, off-campus, exchange non-graduating student. Student right and limitation Section 15 of the AUKU (amended) – provision that prohibited student from participating in politic:Section 15(2)(c): A student of the University shall not be involved in political party activities within the Campus. Section 15(5): The University shall regulate the activities of students and a society, an organization, a body or group of students of the University within the Campus. Student right and limitation 1. Student may become a member of any political party but subjected to the procedure as determined by the University. 2. Code of Conduct for Political Activities Campus (Kod Tatakelakuan AktivitiAktiviti Politik Dalam Kampus) Code of Conduct for Political Activities Campus (Kod Tatakelakuan Aktiviti-Aktiviti Politik Dalam Kampus) 1. The Code of Conduct explain and list down about the political activities that are allowed and prohibited inside and outside campus. 2. Example : Activities allowed outside the campus a) be a politician b) hold a post in political party c) participate in election as candidate d) being an agent of a political party candidate e) engage in electioneering Code of Conduct for Political Activities Campus (Kod Tatakelakuan Aktiviti-Aktiviti Politik Dalam Kampus) 1. Example: Activities allowed inside campus a) Hold a post in campus including student organization, college, MPP and any student organization and in the same time hold a post in politician. b) Participate in political seminar or symposium organised by UNIMAS and approved by the VC. c) Published press release on political matter relating to education and research. d) Organise political academic activity involving politician with UNIMAS approval. e) Invite any person (not student) or university employee for meeting, seminar, class, tutorial, workshop or programme base on VC approval. Code of Conduct for Political Activities Campus (Kod Tatakelakuan Aktiviti-Aktiviti Politik Dalam Kampus) Reminder: 1. Student have to tender a written notice to UNIMAS regarding his/her involvement in political outside campus for UNIMAs supervision – avoid the student tarnish the university reputation 2. The said student have to keep goods manner and behaviour 3. UNIMAS is exempted/ excluded and shall not be liable for the student while performed their political activities. S.15A • Organization, body or groups of student are prohibited to collect or attempt to collect or to promote or attempt to promote any collection of money or property and enter into a written contract except by VC permission. • If any organization, body or group of students of the University conducts itself in a manner which the Vice-Chancellor considers detrimental or prejudicial to the interests or well-being of the University, or to the interests or well-being of any of the students or staff of the University, or to public order, safety or security, or if any such organization, body or group violates any provision of any written law, the Vice-Chancellor may suspend or dissolve it. Suspension, prohibited to enter Campus, ceased as a student of the University and disciplinary action if the student : 1. charged with a criminal offence 2. Restriction order – detention and internal security 3. imprisonment • Student still can attend for examination subject to approval granted by Ministry of Internal Security. • Student can become a student of other University subject to the Minister approval. In disciplinary matter, AUKU shall be read together with the :- UNIVERSITY MALAYSIA SARAWAK (DISCIPLINE OF STUDENTS) RULES 1999 UNIVERSITY MALAYSIA SARAWAK (DISCIPLINE OF STUDENTS) RULES 1999 KAEDAH –KAEDAH UNIVERSITI MALAYSIA SARAWAK (TATATERTIB PELAJAR- PELAJAR )1999 History • Govern specifically on the matter involving students discipline, misconduct and behaviour as a University student. • Provide provision that regulated regulations & rules as a procedural framework to guide University in dealing with the students conducts and allegation of misconduct on the students. • Listed all the do and don’t thing (prohibition), the disciplinary trial procedure, penalties and appeal procedure that should be obey by student. • Divided into two prohibitions :General Discipline and Specific Discipline GENERAL DISCIPLINE Refer Rules 3 of the Discipline Rules : Whereas a student shall not1) conduct himself (within or outside campus) in any manner which is detrimental or prejudicial to the interest, well-being or good name of the University or to public order, safety or security, morality, decency or discipline;. 2) Violate provision of any written law; 3) Disrupt or interfere or caused this to any teaching, study, research, administrative work, or any activity carried out by or under the direction of or with the permission of the University; 4) prevent, obstruct, or interfere or cause all of this event with any officer or employee of the University or any person acting under the direction and permission of such officer or employee from carrying out his work, duty and function; 5) prevent, obstruct or cause to prevented or obstructed any student from attending lecture, tutorial or class or engaging any legitimate activity; 6) Organize, incite or participate in the boycott of any examination, lecture, tutorial, class or other legitimate activity carried out by or under the direction, or with the permission of the University; 7) damage, tamper, interfere with, move or any manner deal with any substance, object, article or property in the University; 8) do any act or cause any act to be done in Campus, so as to cause or be likely to cause any obstruction, inconvenience, annoyance, loss or damage to any person in the University; 9) contravene any instruction or requirement of the University Librarian, a member of the library employee in respect of the use of the library, its book and other facilities in the libraries; 10) Contravene any instruction or requirement of an authorized person in respect of the use of any laboratory equipment, apparatus or substance and other facilities in the laboratory. Specific Discipline 1) Attendance at Lectures- required to attend lecture, tutorial, class and other instruction relating to the course of study & absent with prior permission or obtain approval. 2) Restriction on use of text lecture. 3) Prohibition against plagiarism- should not plagiaries any idea, writing, data or invention. 4) Appearance for examinations – compulsory to attend an examination except if the student is debarred (ex. disciplinary action). 5) Conduct during examination- cheating & fraud or attempt to cheat and fraud in examination are totally prohibited. 6) Organizing assemblies –not permitted except with the prior consent and approval by University. 7) Loudspeakers- not permitted to own, use, have in possession, custody or control any loudspeakers, loudhailer, amplifier or other appliance without prior approval. 8) Banners- shall not make or made or display any banners without permission. 9) Publication, etc of document- shall not publish, distribute or circulate document without approval except for academic purpose. 10) Student’s activities outside Campus-the activities must not effect or prejudicially tarnish the University name and interest. 11) student engaging in occupation- not allowed. 12) Representations relating to University- with permission. 13) Student’s objection to entry of persons into Campus- prohibited. 14) No Gambling within Campus. 15) Consuming liquor and disorderly behaviour- shall not consume or have in possession or under custody and control any liquor. 16) Obscene articles- prohibited to distribute, circulate, exhibited it. 17) Drugs and poisons-prohibited except for medication approved by Pharmacist/Doctor. 18) Cleanliness within Campus- take care of the cleanliness and neatness of the Campus. 19) Making noise- shall not make any noise or sound or cause any noise or sound likely to cause annoyance or disturbance. 20) Examination of student suspected to have a mental disorder- University may required this if the student suspected to have mental illness. 21) Living or sleeping accommodation in Campus- only used accommodation that has been provided. 22) Entry into prohibited parts of Campus or Buildings. 23) Student attire. 24) Disobedience- student should not contravenes any legitimate instruction, direction or requirement given or made by University. 25) Hostel Disciplinea) entering or remaining in a student resident. b) No obstruction or prevent an authorized person (University Officer) to carry out their duty- ex: inspections. c) Remaining outside hostel at night. d) Remaining within hostel premises after midnight. e) Have to used the hostel premises with care and avoid cause any nuisance. f) Prohibited to change hostel room without permission. g) Transfer of resident – the University have the right to ask the resident student to vacate her/his room at any time without assigning any reason if it think fit and reasonable to do so. f) Pengetua have power to give order, etc (regarding good order and discipline). 26) Road Traffic Discipline a) Written authorization for students keeping, possessing or owning motor vehicles on Campus - apply the authorization from the VC, at all times display it on the motor vehicles and this shall be annually renewed. b) Registration of student motor vehicle. c) Speed limit- shall not drive excess speed limit. d) Motor vehicles to be driven only on carriageway of road. e) Obstructive parking not allowed – shall not park at any place in any manner so as to cause danger, obstruction or inconvenience to other person or vehicle. f) Use of allotted parking bays. g) Pillion riding – student driving two- wheeled motorcycle shall not carry more than one person. h) Traffic Directions and Signs – obey and comply. i) Produce driving license and student card for inspection whenever required. j) Obstruction of traffic flow – prohibited. k) Acts within Campus which are offences under the Road Transport Act 1987 shall be penalize under disciplinary offences.
