Sample Participating Broker Agreement
This agreement is made this nineteenth day of August 2005 between David D. Jones, known
hereinafter as the Seller, and Douglas Avery, known hereinafter as the Broker. Broker holds a
valid real estate broker’s license, license number 568976, issued by the state of Florida.
Seller agrees to pay the Broker a brokerage commission, equal to three percent of the purchase
price and payable at the time of the closing, when the Broker’s prospect purchases the Seller’s
property, under the following conditions:
1.
Participating Broker must register the Broker’s prospects with the Seller by mailing, on
Broker’s company stationery, the Broker’s prospect’s name, signed by the Broker and the
Broker’s prospect. If the Broker fails to register prospects with the Seller as set forth, no
commission will be paid to the Broker. No oral registrations of the Broker’s prospects with
the Seller will be accepted.
2.
Participating Broker may serve only as a broker representing prospects and not as a
principal, lender, or other financial participant in the purchase of the Seller’s property. No
commission shall be paid to any Broker participating as a buyer of the Seller’s property.
3.
Neither participating Broker nor any principal thereof, licensed salesperson associated
therewith, nor any employee or licensee thereof, is or will be a principal or financial
participant with or lender to any buyer of Seller’s property.
