Where deliveries are quoted “ex-stock” the period of delivery must not exceed Five (5) maximum
working days after receipt of order. If this condition is not adhered to, the order could be
cancelled.

SPECIFICATION
INTRODUCTION
Cable jointing kits are used in the Ekurhuleni Metropolitan Municipality’s (EMM) electrical
network to maintain the continuity of cable especially for long length for the distribution of
electricity. The effects of MV cables jointing kits failure are generally severe in terms of
customer outage as well the repair cost to EMM. It is therefore important to ensure that MV
cable jointing kits comply with the required specifications and are of acceptable quality.
1 Scope
This specification details minimum requirements testing and supply of medium-voltage
cable accessories used on a.c systems of voltages 6.35/11 kV up to and including 19/33 kV,
for both Paper Insulated, lead-sheathed, mass-impregnated non-draining (MIND) cables and
Cross Link Polyethylene (XLPE) as well as 110 & 160 mm corrugated high-density
polyethylene (HDPE) pipes for lying of cables in road crossings; for the Ekurhuleni
Metropolitan Municipality, on an as and when required basis for a period indicated in the
tender heading. The accessories are required for the type cable parameters described in table
A1.2 and A1.3 included in this specification.

The terms, definitions and abbreviations of NRS 053 and NRS 012 shall apply to this
specification.
4 Quantities
Due to the uncertainty and fluctuation of the EMM requirements, no indication can be given
as to the quantities of the above-mentioned items which will be required under this contract.
The supplier/s will therefore be required to supply the requirements in such quantities as may
be required by the EMM from time to time. When supplies are required, the EMM will
endeavour to place orders, on an as and when required basis, as far in advance as possible.

5 Requirements
5.1 General
5.1.1 Standard operating conditions

5.1.3 Accessory earthing
5.1.3.1 General
5.1.3.1.1 The minimum earth fault current rating of the main earthing conductor shall be 10
kA 1 s.
Note – Where a higher earth fault current rating is required, multiple earthing conductors
or associated connectors (or both) may be required.
5.1.3.1.2 The main earthing conductor of cable terminations shall be terminated with a tinned
copper connector that has an M12 fixing hole and that shall be of the length
described in SANS 1332:2013.
5.1.3.1.3 All cable termination earthing conductors shall be water blocked to prevent ingress
of moisture into the termination. The method of waterproofing shall be stated in
Schedule B and shall be clearly indicated in the accessory installation instruction.

5.1.3.1.4 Constant force springs (CFS's) used to connect the main earthing conductor to the
lead sheath or armour of a cable shall have a minimum width of 20 mm and shall be
suitable for the relevant cable dimension.
5.1.3.1.5 CFS's that form part of the main earthing connection shall not be used to secure any
ferrous metal enclosures used for the mechanical protection of a three-core cable
joint.
5.1.3.1.6 The main earthing conductor of a joint shall be separated from the individual core
insulation by a collective insulating inner sleeve that:
• For a paper-insulated cable extends from lead sheath to lead sheath;
• For an XLPE-insulated cable extends from bedding to bedding;
• For a transition joint extends from lead sheath to bedding; and
• That is effectively sealed at each bedding or lead sheath interface.
5.1.3.1.7
The edges of a CFS be smoothed using a suitable filler tape positioned around the
CFS. The filler tape shall also serve to restrain the spring.
5.1.3.2 XLPE-insulated cables
5.1.3.2.1
The earthing conductor requirements XLPE-insulated cables in accordance with
SANS 1339 shall be in accordance with table 2. All earthing conductor shall be
tinned copper braid.
Note – Secondary earthing conductors are not required for single-core XLPE-insulated
cables that have a copper wire screen.
5.1.3.2.2 The connection between the secondary earthing conductor and the copper screen
of a cable shall be made using a CFS.
5.1.3.2.3 The main earthing conductor of a three-core armoured cable joint or termination
shall be connected to the armour wires of the cable with a CFS.
5.1.3.2.4 The armour wires directly below the CFS of a three-core amoured cable shall be
supported using a range-taking (adjustable) stainless-steel support bush. The type
of support offered shall be stated in Schedule B.
Note – Support below the armour wires is required to accommodate the triangular shape of
certain XLPE-insulated cables.
5.1.3.2.5 Single-core cables that have a copper wire screen, a suitable mechanical torque
shear connector shall be provided for the purpose of connecting the copper screen
wires. Mechanical torque shear lugs shall have an M12 fixing hole.

5.1.3.3.1 The main earthing conductor of all joints or terminations shall be a 70mm² tinned
copper braid.
5.1.3.3.2 The main earthing conductor of a joint or termination shall be:
a) Connected to the lead sheath of the cable with a CFS. A layer of tinned copper
mesh shall be provided for application under the CFS; and
b) Connected to the armouring of the cable with a CFS, in the case of armoured
cables.
Note – No armour claps are permitted due to the “cold flow” characteristics of the lead
sheath.
5.1.4 Cable terminations

Indoor terminations for use in air-filled enclosures; and
Outdoor terminations
5.1.4.2
The design of the cable termination shall take into account changes to the
electrical field distribution caused by pollution deposited on the surface of the
termination in indoor and outdoor applications.
5.1.4.3
The minimum specific creepage distances for type 1 and type 2 cable terminations
shall be in accordance with SANS 876. The actual creepage distance offered shall
be stated in schedule B
In the case of single-core terminations, no separate earthin or armouring tube shall
be used.
In the case of single –core terminations, the creepage distance shall be measured
from the end of cable insulation at the lug, along the surface of the termination tail,
to the nearest exposed earthed point.

In the case of three-core terminations, the creepage distance shall be measured
from the end of cable insulation at the lug, along the surface of the termination tail,
to the cable crutch.
5.1.4.4
The cable termination tail lengths shall be as given in table 3. The tail lengths are
relate to the distance from the terminal centre line to the cable support clamp or
the gland plate (where applicable) as specified in in table 7 of SANS 876:2013

5.1.4.5
All cable termination instructions shall be based upon the "top down" principle of
measurement and shall clearly indicate the distance to the end of the core screen
(screen cut) from the top down. The “top down” principle of measurement requires
the position of the screen cut to be referenced from the top end of the core
insulation. See figure 1 of NRS 053:2013.
NOTE – The intention of the "top down" measurement is to maximize the length of screened
tail to allow for core crossing in the screened section of the termination where
needed.
5.1.4.6
Clearances within an air-insulated enclosure shall be in accordance with NRS
012:2013.
5.1.4.7
Cable terminations for impregnated paper-insulated cables shall have semiconductive tubes that cover the metallic-paper core screen from the break-out boot
to the end of the core screen.
NOTE – The purpose of the semi-conductive tube is to prevent the metallic-paper core
screen from moving during the termination process.
5.1.4.8
Three-core cable terminations shall be designed to accommodate crossing of cable
cores within the screened section of the tri-furcated cores.
5.1.4.9
The design of the cable termination shall ensure that no part of the armour or lead
sheath of the cable is exposed once the termination is completed. In the case of a
three-core termination this shall be achieved by either ensuring that the length of

the break-out boot is adequate or provision for a separate earthing/armour tube is
made.
5.1.4.10 Outdoor cable terminations for paper-insulated cables shall be provided with crutch
support to prevent damage to the cable crutch end core insulation from over trifurcating.
5.1.4.11 Cable terminations shall be provided with a method of sealing the interface between
the termination tail insulating tube and the lug barrel either by:
a)Allowing for at least 100 mm of additional length of termination tail outer tube and
sealing mastic that covers the lug barrel; or
b) Providing lug outer tubes of length at least 100mm.
5.1.4.12 Cable terminations for single-core cable shall be supplied in sets of three i.e.
allowing for the termination of three single-core cables.
5.1.4.13 For indoor three-core cable terminations within air-filled cable enclosures fitted
with low-voltage ring-type current transformers, an “extended screen” termination
shall be supplied. The termination design shall allow for the core screen of the
cable to extend through the current transformers by having a tail length of 800 mm.
5.1.4.14 Terminations shall be supplied with range-taking mechanical torque-shear lugs in
accordance with NRS 075 and shall be suitable for the standard ranges specified in
table 1. The mechanical torque shear lug fixing hole shall be M16.
5.1.4.15 Three-core terminations shall be supplied with three phase identification tubes
marked ”R” (red), “W” (white) and “B” (blue) respectively. The tubes shall be of
the same material as the phase outer material and shall be provided with a suitable
sealant on the inside surface.
5.1.5 Cable joints
5.1.5.1
All three-core cable joints shall be of the filled type. The method of filling shall be
stated in schedule B
NOTE – The primary purpose of filling three-core cable joints is to provide a longitudinal
water block.
5.1.5.2
All jointing instructions shall clearly indicate the maximum length and diameter of
the ferrule(s) that may be used with the joint.
5.1.5.3
Three-core cable joints shall be designed to accommodate crossing of cable cores
within the joint. The method of core crossing shall be indicated in the jointing
instruction.
5.1.5.4
Tree-core XLPE cable joints shall individually screened using a suitable tinned
copper metallic screening layer (e.g. tinned copper mesh tape or tinned copper earth
sock) that extends from the metallic core screen on the one side to the metallic core

screen on the other. The tinned screening shall be connected to the metallic core
screen with a CFS

Cable joints for single-core cable shall be supplied individually i.e. allowing for the
jointing of one single-core cable.

Cable joints shall be supplied with range-taking mechanical torque-shear ferrules in
accordance with NRS 075 and shall be suitable for the standard ranges specified in

5.1.6 Shrouded terminations
5.1.6.1
For type 2 cable terminations in accordance with NRS 012:2013, a method shall be
provided for insulating the cable termination at the equipment terminal fixing point
for the specified connection arrangement. The connection arrangement will
typically consist of a straight or right-angled cable connection onto a bushing, post
insulator or solid shaped copper conductor.
5.1.6.2
The outer covering of the shroud shall be heat-shrink, cold shrink or slip-on

The shrouds shall be supplied with three lengths of self-amalgamating filler tape
having minimum dimensions of 300 mm x 50 mm x 3mm that shall be used for
covering of all sharp edges of the cable/terminal fixing point interface.
5.1.6.4
Shrouds with taped outer layers are not acceptable.
5.1.6.5
Shrouds shall be supplied in sets of three i.e. allowing for the termination of one
three-core cable or three single-core cables.
5.1.6.5
The shroud installation instruction shall clearly indicate the minimum thickness of
insulation required at any point of the shroud.
5.1.6.6
The shrouds shall be tested as a shrouded termination in accordance with IEC
60055-1 or SANS 60502-4 at the minimum phase-to-phase and phase-to-earth
clearances.
NOTE – The phase-to-phase and phase-to-earth clearances at which the shrouds are tested
shall not exceed those given in NRS 012:2013.
5.1.7 Fully insulated unscreened separable connectors (USC).
5.1.7.1 It shall be possible to connect cables straight and at right angles to respective
switchgear.
5.1.7.2
The fully-insulated separable connectors shall be supplied in sets of three i.e.
allowing for the termination of one three-core cable or three single-core cables.

NOTE – A trifurcating termination kit is used to convert a screened three-core XLPEinsulated cable into three screened single-core unarmoured cables tails for the
purpose of terminating the individual cores of the cable using accessories designed
exclusively for single-core vcables. The purpose of the kit is to:
a)
Separate the three individual screened cable cores;
b) Provide the necessary earth connections for the metallic core screens and, where
applicable the armour of the three-core cable; and
c)
Provide a watertight seal for the screened cores, cable crutch and earth connection.
5.1.8.1
A trifurcating termination kit shall be range-taking in accordance with the standard
ranges specified in table 1.
5.1.8.2
The tail length of a trifurcated cable shall be 800 mm or 2 500mm.
NOTE – A trifurcating termination kit that has 800mm tails is used for terminating threecore cable using SSCs into a cable termination enclosure designed for three-core
cables in accordance with SANS 876. A trifurcating termination kit that has
2 500mm tails is used for terminating a three-core cable into a cable termination
enclosure designed exclusively for single –core cables in accordance with SANS
876.
5.1.8.3
An earthing kit in accordance with the requirements of 5.1.3 shall be provided for
connecting to the copper tape core screens and, where applicable, the armour wires.
The earthing arrangement shall have passed a thermal-short circuit (screen) test.
5.1.8.4
A trifurcating termination kit shall include all components required for sealing the
screened cable cores, cable crutch and earth connection.
5.1.8.5
The minimum wall thickness of the waterproof sealing tubes provided for the
screened cores, cable crutch and earth connection shall be 2mm after installation.
5.1.8.6
Environmental sealant mastics shall be provided to ensure a watertight seal in the
cable crutch area (i.e. around the break-out boot skirt and turrets) of the trifurcating
termination kit. When tested in accordance with clause 5 of NRS 053, there shall be
no evidence of moisture ingress into to the crutch area of the cable termination.
5.1.9 Extensible screened separable connectors (SSC's)
5.1.9.1
Extensible SSC's are used on 11kV XLPE cable terminations onto all equipment
that has a Type C interface that has a rated current of ≥ 630 A.
5.1.9.2
The maximum intended cable size for this application is 300 mm².
5.1.9.3
Extensible SSCs shall be of the dead-break, bolted contact type and shall be
suitable for connecting to a 630 A outside cone plug-in type bushing with interface
type ‘C’ in accordance with EN 50180 and EN 50181 having an M16 × 2 thread.

requirements of NRS 075 and shall be suitable for the standard cable sizes specified
in tables 1.
5.1.9.9
Where SSCs are provided with an external length of insulated conductor that is
required for the earthing of the SSC housing, the conductor shall be:
a) an insulated copper conductor of nominal cross-sectional area of at least 4 mm²,
b)
of length 700 mm, and
c) terminated at the non-SSC end with a lug having an M12 fixing hole.
5.1.10 Cable repair sleeves
NOTE– Cable repair sleeves may be used to repair underground cables that have a
damaged/punctured outer sheath.
5.1.10.1 Cable repair sleeves shall be suitable for application on cables of outer diameter
ranges as follows:
a) 45 mm to 65 mm; and
b) 65 mm to 95 mm.
5.1.10.2 A cable repair sleeve shall be of a wrap-around design and shall be supplied with a
rail and stainless steel zip/channel or any other approved sealing method.
5.1.10.3 The length shall be at least 1 000mm.
5.1.10.4 The minimum thickness shall be 2mm after installation.
5.1.10.5 The inner surface shall be coated with a suitable adhesive to prevent moisture
ingress into the cable.
5.1.10.6 Each repair sleeve shall be supplied with the cable preparation equipment and tools

shall have a minimum wall thickness of at least 2 mm after application.
5.1.13.2 An installation instruction shall be provided with every accessory supplied.
5.1.13.3 The jointing and termination instructions for accessories used with XLPE-insulated
cables shall clearly indicate the cable preparation required for cables having an
outer sheath made of polyethylene.
5.1.13.4 Cleaning kits for cable joints, terminations and tri-furcating kits shall consist of at
least the following:
a) Non-oil based cleaning solvent supplied in a sealed container that prevents leakage
or evaporation;
b) 50 mm x 600 mm aluminium-oxide or glass based abrasive tape;

5.1.14 Elastometric Insulating bushings boot for bushings up to 17.5 kV
5.1.14.1 Elastometric is a flexible insulation moulded boot that fits over the connection
between the cable lug and the inline or right-angle equipment bushing , this is to
improve the phase to phase and phase to ground insulation, it is also known as an
concertina boot.

ratio (where applicable) and the batch number (visible on all components forming part
of an accessory). This part number shall be referenced in the bill of materials.
Components that are physically impossible to mark shall be individually packed and
the packaging shall be marked;
f) The expiry date (visible on the packaging of all components or consumables that are
subjected to a shelf life limitation). These components or consumables shall be
individually packed;
g) In addition, where an accessory contains components or consumables that have an
expiry date the expiry date shall be clearly marked on the outside of the cardboard
container; and
7.1.2 Completed accessory shall be provided with unique serial number which shall be
linked to the following minimum information to be kept by the supplier for traceability
purposes.
a) Manufacture’s name and the name of the supplier;
b) Accessory part number and description of the part;
c) The date of packaging.
Details of the serial number offered shall be indicated in schedule B. this serial number shall
be marked on the accessory outer packaging and shall appear in the installation instructions.
7.2
Packaging
The packaging shall be in accordance to the requirements of clause 6.2 of NRS 053.
8. Documentation

All documentation shall be in English.

Installation Instruction
Installation instructions shall be supplied for each accessory and shall:
a) Be supported by legible illustrations that clearly indicate the application and assembly

f) Be individually printed in colour and not photo-copied,
g) Include an A4 tear-off page that makes provision for the following information (to be
completed on-site):
1) The serial number, the name of the manufacture, the name of the supplier and the
product number;
2) The jointer’s name, the jointer’s ID and the name of the company;
3) The date of installation;
4) The name of the customer, the name of the customer’s responsible person; and the
responsible person’s ID;
h) Include the following wording at the end of the instructions:
ANY COLOUR-CODED INSULATING TAPES (e.g PVC) USED FOR PHASE
IDENTIFICATION PURPOSE SHALL BE REMOVED BEFORE THE
TERMINATION IS ENERGIZED.
i) Indicate the positioning of the waterproofing for cable termination earthing
conductors,
j) Indicate the method of core crossing along with minimum clearances for terminations,
k) Indicate the method of sealing the interface between the termination tail outer tube and
the lug barrel for cable terminations,
l) Indicate the maximum length and diameter of the ferrule (s) that may be used with the

8.4
Test Report
8.4.1 Test reports shall be submitted with a tender and shall be arranged according to the
applicable type test sequence.
8.4.2 Test reports shall be accompanied by installation instructions and a bill of materials
that form part of the test report issued by the accredited laboratory.
8.4.3 A clear statement shall be given on the cover page of each test report that indicates
which clause(s) of the relevant specification has been excluded from the test
requirement.
8.4.4 All test reports shall bear the mark of accreditation which the accredited laboratory
holds. This mark of accreditation shall be prominent on the front page of the test
report.
9.
Samples and Storage

Sample of all accessories may be requested during the adjudication stage. Samples must be
supplied free of charge.

Storage
Components shall be capable of being stored without deterioration within the temperature
range of -10°C to + 45°C for at least 24 months.

Training
10.1 The supplier shall provide the following details with the tender regarding training

11.1
General
11.1.1
The type of pipes that is required under this specification and suitable for use as
cable protection pipes under roadways, railways etc. shall conform to SANS 6138624 class N with crush resistance higher than 450 N.
11.1.2
HDPE pipes shall be of double wall corrugated construction externally and waxy like
internal surface to make easy the draw-in of cable. The pipes shall be manufacture
from high-density polyethylene (HDPE) material and shall be of Nominal Sizes (DN)
160 mm and 110 mm.
11.1.3
Pipes shall be supplied in 6 m straight lengths and shall be fitted with the necessary
coupling on one end of the pipe to allow jointing where necessary during installation.
11.1.4
The colour of the pipes shall be black and the colour of the coupling shall be either
yellow or white and shall have the same material characteristics as that of the pipe.
11.1.5
The impact strength of the pipes shall be such that the pipe as well as the coupling
does not crack or rupture when mechanical compaction is applied during installation.
11.1.6
When bent or compressed, or exposed to impact or extreme temperature of a
specified value in accordance with impact and extreme temperature declared for the
product, either during, or after installation according to the manufacture’s instruction,
shall not crack and shall not be deformed to an extend that it is difficult to draw-in
the cable or is likely to damage the insulation of the installed cable.

polyethylene base polymer only those additives necessary for the manufacture and

All pipes shall be permanently and legibly marked in such a way that the marking

The marking shall be such that it is legible without magnification.

DEFINITIONS

“all applicable taxes” includes value-added tax, pay as you earn, income tax, unemployment
insurance fund contributions and skills development levies;
2.2
“B-BBEE” means broad-based black economic empowerment as defined in section 1 of the
Broad-Based Black Economic Empowerment Act;
2.3
“B-BBEE status level of contributor” means the B-BBEE status received by a measured
entity based on its overall performance using the relevant scorecard contained in the Codes of
Good Practice on Black Economic Empowerment, issued in terms of section 9(1) of the
Broad-Based Black Economic Empowerment Act;
2.4
“bid” means a written offer in a prescribed or stipulated form in response to an invitation by
an organ of state for the provision of services, works or goods, through price quotations,
advertised competitive bidding processes or proposals;
2.5
“Broad-Based Black Economic Empowerment Act” means the Broad-Based Black
Economic Empowerment Act, 2003 (Act No. 53 of 2003);
2.6
“comparative price” means the price after the factors of a non-firm price and all
unconditional discounts that can be utilized have been taken into consideration;
2.7
“consortium or joint venture” means an association of persons for the purpose of
combining Their expertise, property, capital, efforts, skill and knowledge in an activity for the
execution of a contract;
2.8
“contract” means the agreement that results from the acceptance of a bid by an organ of
state;
2.9
“EME” means any enterprise with an annual total revenue of R5 million or less .
2.10
“Firm price” means the price that is only subject to adjustments in accordance with the actual
increase or decrease resulting from the change, imposition, or abolition of customs or excise
duty and any other duty,levy, or tax, which, in terms of the law or regulation, is binding on the
contractor and demonstrably has an influence on the price of any supplies, or the rendering
costs of any service, for the execution of the contract;
2.11
“functionality” means the measurement according to predetermined norms, as set out in the
bid documents, of a service or commodity that is designed to be practical and useful, working
o operating, taking into account, among other factors, the quality, reliability, viability and
durability of a service and the technical capacity and ability of a bidder;
2.12
“non-firm prices” means all prices other than “firm” prices;
2.13
“person” includes a juristic person;
2.14
“rand value” means the total estimated value of a contract in South African currency,
calculated at the time of bid invitations, and includes all applicable taxes and excise duties;
2.15
“sub-contract” means the primary contractor’s assigning, leasing, making out work to, or
employing, another person to support such primary contractor in the execution of part of a
project in terms of the contract;
“total revenue” bears the same meaning assigned to this expression in the Codes of Good
Practice on Black Economic Empowerment, issued in terms of section 9(1) of the BroadBased Black Economic Empowerment Act and promulgated in the Government Gazette on 9

“trust” means the arrangement through which the property of one person is made over or
bequeathed to a trustee to administer such property for the benefit of another person; and

“trustee” means any person, including the founder of a trust, to whom property is bequeathed
in order for such property to be administered for the benefit of another person.
3.
ADJUDICATION USING A POINT SYSTEM
3.1
The bidder obtaining the highest number of total points will be awarded the contract.
3.2
Preference points shall be calculated after prices have been brought to a comparative basis
taking into account all factors of non-firm prices and all unconditional discounts;.
3.3
Points scored must be rounded off to the nearest 2 decimal places.
3.4
In the event that two or more bids have scored equal total points, the successful bid
must be the one scoring the highest number of preference points for B-BBEE.
3.5
However, when functionality is part of the evaluation process and two or more bids have
scored equal points including equal preference points for B-BBEE, the successful bid must
be the one scoring the highest score for functionality.
3.6
Should two or more bids be equal in all respects, the award shall be decided by the
drawing of lots.

5.1
In terms of Regulation 5 (2) and 6 (2) of the Preferential Procurement Regulations, preference
points must be awarded to a bidder for attaining the B-BBEE status level of contribution in

Bidders who qualify as EMEs in terms of the B-BBEE Act must submit a certificate issued by
an Accounting Officer as contemplated in the CCA or a Verification Agency accredited by
SANAS or a Registered Auditor. Registered auditors do not need to meet the
prerequisite for IRBA’s approval for the purpose of conducting verification and issuing
EMEs with B-BBEE Status Level Certificates.
5.3
Bidders other than EMEs must submit their original and valid B-BBEE status level verification
certificate or a certified copy thereof, substantiating their B-BBEE rating issued by a
Registered Auditor approved by IRBA or a Verification Agency accredited by SANAS.
5.4
A trust, consortium or joint venture, will qualify for points for their B-BBEE status level as a
legal entity, provided that the entity submits their B-BBEE status level certificate.
5.5
A trust, consortium or joint venture will qualify for points for their B-BBEE status level as an
unincorporated entity, provided that the entity submits their consolidated B-BBEE scorecard
as if they were a group structure and that such a consolidated B-BBEE scorecard is prepared
for every separate bid.
5.6
Tertiary institutions and public entities will be required to submit their B-BBEE status level
certificates in terms of the specialized scorecard contained in the B-BBEE Codes of Good
Practice.
5.7
A person will not be awarded points for B-BBEE status level if it is indicated in the bid
documents that such a bidder intends sub-contracting more than 25% of the value of the
contract to any other enterprise that does not qualify for at least the points that such a bidder
qualifies for, unless the intended subcontractor is an EME that has the capability and ability to
execute the sub-contract.

1. All quotations received will be evaluated on the 80/20 point scoring basis. The 80 points
will be for Price and 20 points are for Broad Based Black Economic Empowerment
(BBBEE) for attaining the BBBEE Status level contribution in accordance with the table

Penalties
The City Manager must act in terms of paragraph 15 of the Preferential Procurement Policy Regulations
2001, as published on 10 August 2001, against the person awarded the contract upon detecting that a
preference in terms of the Preferential Procurement Policy has been obtained on a fraudulent basis, or
any specified goals are not attained in the performance of the contract.
Regulation 15 of the Preferential Procurement Policy provides as follows:

The Joint Venture may not be terminated by any of the parties hereto until either:
The contract has been awarded to another bidder
or
The work undertaken by the Joint Venture under the contract has been completed and all
liabilities and claims incurred by and made by the Joint Venture have been settled, the bid is
cancelled or the period of validity of bid extended.

No party to the Agreement shall be entitled to sell, assign or in any manner encumber or transfer
its interest or any part thereof in the Joint Venture without obtaining the prior written consent of
the other party hereto.
The Parties of the Joint Venture shall cooperate on an exclusive basis. No Party shall during the
validity period of the bid submit a bid to or enter into a Contract with the EMM or any other party
for the Project, either alone or in collaboration with a third party.

COMPULSORY SITE INSPECTIONS / INFORMATION / CLARIFICATION MEETINGS
Where Compulsory Site Inspections and Compulsory Information, Briefing or Clarification
Meetings are to be held, it shall be subject to the following conditions:
1. Necessity for Compulsory Site Inspection and Compulsory Information / Briefing /
Clarification Meetings
Compulsory Inspections / Meetings must only be held where the nature of the contract is
such that it requires either an inspection of a site or a briefing session. The Bid
Specification Committee should indicate to the Tender Office that such a compulsory
inspection or briefing is regarded as a necessity.
2. Attendance Register
An attendance register of potential bidders and the firms they represent shall be kept and
signed by attendees. A copy of such Attendance Register shall immediately after the
inspection/briefing be sent to the Tender Office.
3. Confirmation Notes of Inspection/Briefing Sessions
Confirmation Notes of the Compulsory Inspection or Briefing Session shall be held by or
on behalf of the contact person of the Department for whom the Bid is being advertised.
A copy of the notes shall be sent to each firm that was represented at the
inspection/meeting as soon as possible after the inspection or meeting and before the
closing date of the bid. A copy of the notes shall also be sent to the Tender Office. The
relevant Department will ensure that the notes are submitted to the Bid Evaluation
Committee and to the Bid Adjudication Committee.
4. Bid Documents
The bid documentation shall clearly state that where the inspection of a site or the
attendance of a briefing session is compulsory, non-attendance thereof will lead to the
disqualification of the bidder in question. The bid documentation shall further clearly state
that if bid documents are obtained after the compulsory briefing session or site inspection,
it will only be made available to firms that were represented at the meeting. The mere fact
that a firm that was not represented at a compulsory meeting, but nevertheless submitted
to the municipality a set of bidding documents, should not be construed as creating any
expectations that a bid will be considered by the Municipality.
