Your home is a single-family dwelling (no apartments, duplexes, townhomes or mobile homes)
You own and occupy this home (no rentals)
You are planning to reside in this home for at least the next 12 months
Your central air conditioning system(s) is in working condition
You have no more than two (2) central air conditioners
You have only one (1) thermostat for each central air conditioner
You aren’t participating in any other SMUD pilot programs
You aren’t enrolled in SolarShares®, a Medical Equipment Discount (MED) rate or an Electric Vehicles (EV) rate
You don’t have any of the following: zonal HVAC system, swamp cooler, wall heater, window-mounted air conditioner or floor furnace
You don’t have photovoltaic (PV) solar panels installed
You don't operate a child care or convalescent care facility in your home
You have access to the Internet and are willing to participate in online surveys
You complete this Application in its entirety, sign the attached Participation Agreement and return both documents in the self-
addressed, stamped envelope provided

• Your heating and air system isn’t compatible with the SMUD-provided thermostat

Summer Incentive Plan
You'll receive a credit on your electric bill for up to 12 Conservation Days* each summer (June 1 through September 30). On this plan:
• SMUD will automatically raise your thermostat temperature by 3 degrees from 4:00 p.m. to 7:00 p.m. on Conservation Days
• SMUD will credit you $3 each time you participate in a Conservation Day
* On Conservation Days, peak hours are from 4:00 p.m. to 7:00 p.m. Conservation Days will be on weekdays only, and never on the
4th of July or Labor Day.

SMUD’s PowerStat ® Pilot - Participation Agreement
Terms and Conditions
This Participation Agreement (“Agreement”) for SMUD’s PowerStat Pilot (“Pilot”) is entered into between the Sacramento
Municipal Utility District (“SMUD”), and the customer (“Customer”). The Parties agree as follows:
1. Term. This Agreement is effective upon the date of last execution by the Parties and shall continue until terminated by default or by either Party with thirty (30) days prior written notice.
2. Pilot Scope. This Pilot will provide select residential customers a thermostat(s) (“Thermostat”) to manage energy use and costs, and to help SMUD test and study new residential technologies. Specifically, in exchange for Customer’s participation in the Pilot, SMUD will provide a Thermostat(s) and installation (if not previously provided) at the street address (“Premises”) provided by Customer, at no cost to Customer. In exchange for the credit specified in the Summer Incentive Plan, SMUD automatically will raise Customer’s thermostat temperature by three (3) degrees between 4:00 p.m. to 7:00 p.m. on Conservation Days.
3. Credits. If Customer chooses to enroll in the Summer Incentive Plan, Customer will receive credit for each Conservation Day in which Customer participates. No more than twelve (12) Conservation Days will be called each summer (June 1 through September 30, excluding weekends, 4th of July and Labor Day). If Customer opts out or overrides
the temperature offset at any point on a Conservation Day, Customer will not receive credit for that day. SMUD reserves the right to change the credit, as amended from time to time, before each summer. SMUD will notify Customer before the summer period starts. Customer automatically will be enrolled in the program with the new credit.
4. Surveys. Customer agrees to participate in up to ten (10) online, telephone, or mail surveys throughout the Pilot to provide feedback on Customer’s experience.
5. Ownership of Thermostat. Ownership of the SMUD-provided Thermostat(s) will default to Customer at the time
of installation.
7. Maintenance. SMUD shall have the exclusive right to maintain the Thermostat(s) and perform services during the Pilot term, except for services already covered by the Thermostat manufacturer’s warranty. All non-warranty costs associated with maintenance of the SMUD-provided Thermostat will be at the sole expense of SMUD while the customer is an active participant in the Pilot. Under no circumstances shall Customer perform maintenance or other services, or remove the Thermostat(s) during the Pilot term. If Customer uninstalls the Thermostat(s) or performs maintenance or other services on the Thermostat(s) during or after the Pilot term for any reason, neither SMUD nor the Thermostat’s manufacturer will be responsible for reinstalling or fixing the Thermostat(s) or reinstalling the old thermostat(s). If this Agreement is terminated or expires, Customer will be solely responsible for maintaining and servicing the Thermostat(s).
14. Liability. SMUD will not be liable, and Customer waive(s) any and all claims, for any damage, loss, expense, injury or death that result from Customer’s participation in the Pilot and/or ownership and use of the Thermostat(s).

SMUD will direct all communications or notices to Customer regarding the PowerStat Pilot program according to the contact information provided by Customer.
16. Amendments. SMUD reserves the right, at its sole discretion, to amend the terms of this Agreement. SMUD will notify Customer in writing of the amendment at least thirty (30) days in advance of the effective date of the amendment. The amendment will become effective as of the amendment effective date stated in the notice.
17. Termination. Each Party may terminate this Agreement with thirty (30) day advance written notice. If Customer terminates this Agreement within the first twelve (12) months, Customer keeps the Thermostat(s) and Customer shall reimburse SMUD for the cost of the Thermostat(s). If SMUD terminates this Agreement, Customer keeps the Thermostat(s) and does not need to reimburse SMUD for the cost of the Thermostat(s).
18. Applicable Law. This Agreement shall be interpreted, governed by, and construed under the laws of the State of California, as executed and to be performed wholly within the State of California.
19. Entire Agreement. This Agreement and Customer’s Application constitute the entire understanding between the Parties as to the subject matter hereof.

6. Installation. If an installation appointment is required, the Thermostat(s) shall be installed at Customer’s Premises by SMUD or its contractor(s), who shall perform the work as soon as reasonably practical after execution of this Agreement. SMUD will provide Customer advance notice of installation date. All costs related to installation will be at the sole expense of SMUD. SMUD or its contractor(s) will uninstall the old thermostat(s) and leave it with Customer.
If the old Thermostat contains mercury, SMUD or its contractor(s) will dispose of mercury thermostats in a safe manner as required by law.
13. Warranty. SMUD makes no warranties, implied or expressed, written or oral, with respect to the goods and services provided under this Agreement including, but not limited to, the warranties of merchantability and fitness for a particular purpose. The Thermostat manufacturer’s limited product warranty is applicable to the Thermostat. During the Pilot term, SMUD will assist Customer to determine applicable warranty coverage.

8. Access to Premises. Customer grants SMUD and/or its contractor(s) the right to enter Customer’s Premises to install and maintain the Thermostat(s) during the Pilot term.

9. Cost. There is no cost to Customer for the Thermostat(s), initial installation, removal of the old thermostat(s), maintenance, and the standard thermostat manufacturer’s warranty services.

10. Data and Confidentiality. SMUD and the Thermostat manufacturer will keep all Customer’s personal information and data confidential. Data to be collected and analyzed includes hourly electricity use data, interaction data with SMUD’s customer web portal and Thermostat data.

11. Peak Corps Participants. Participants in SMUD’s Peak Corps (Air Conditioning Load Management) program who are eligible and choose to join the Pilot will not participate in Peak Corps while participating in PowerStat. If this
Agreement is terminated or expires, Customer will be reinstated in Peak Corps.
12. Rates, Rules and Regulations. This Agreement is subject to SMUD’s Rates, Rules and Regulations, as amended from time to time.

Terms and Conditions
This Participation Agreement (“Agreement”) for SMUD’s PowerStat Pilot (“Pilot”) is entered into between the Sacramento
Municipal Utility District (“SMUD”), and the customer (“Customer”). The Parties agree as follows:
1. Term. This Agreement is effective upon the date of last execution by the Parties and shall continue until terminated by default or by either Party with thirty (30) days prior written notice.
2. Pilot Scope. This Pilot will provide select residential customers a thermostat(s) (“Thermostat”) to manage energy use and costs, and to help SMUD test and study new residential technologies. Specifically, in exchange for Customer’s participation in the Pilot, SMUD will provide a Thermostat(s) and installation (if not previously provided) at the street address (“Premises”) provided by Customer, at no cost to Customer. In exchange for the credit specified in the Summer Incentive Plan, SMUD automatically will raise Customer’s thermostat temperature by three (3) degrees between 4:00 p.m. to 7:00 p.m. on Conservation Days.
3. Credits. If Customer chooses to enroll in the Summer Incentive Plan, Customer will receive credit for each Conservation Day in which Customer participates. No more than twelve (12) Conservation Days will be called each summer (June 1 through September 30, excluding weekends, 4th of July and Labor Day). If Customer opts out or overrides

SMUD reserves the right to change the credit, as amended from time to time, before each summer. SMUD will notify Customer before the summer period starts. 4. Surveys. Customer agrees to participate in up to ten (10) online, telephone, or mail surveys throughout the Pilot to provide feedback on Customer’s experience.
5. Ownership of Thermostat. Ownership of the SMUD-provided Thermostat(s) will default to Customer at the time
of installation.

All non-warranty costs associated with maintenance of the SMUD-provided Thermostat will be at the sole expense of SMUD while the customer is an active participant in the Pilot. If Customer uninstalls the Thermostat(s) or performs maintenance or other services on the Thermostat(s) during or after the Pilot term for any reason, neither SMUD nor the Thermostat’s manufacturer will be responsible for reinstalling or fixing the Thermostat(s) or reinstalling the old thermostat(s). If this Agreement is terminated or expires, Customer will be solely responsible for maintaining and servicing the Thermostat(s).
14. Liability. SMUD will not be liable, and Customer waive(s) any and all claims, for any damage, loss, expense, injury or death that result from Customer’s participation in the Pilot and/or ownership and use of the Thermostat(s).
