UPPER SOUTHAMPTON TOWNSHIP ORDINANCE 419 AN ORDINANCE OF THE BOARD OF SUPERVISORS OF UPPER SOUTHAMPTON COMMONWEALTH OF TOWNSHIP COUNTY OF SUCKS PENNSYLVANIA AMENDING THE UPPER SOUTHAMPTON TOWNSHIP ZONING ORDINANCE BY ESTABLISHING REGULATIONS FOR ELECTRICALLY OR MECHANICALLY CONTROLLED DISPLAY SIGNS WHEREAS the Board of Supervisors of UpperSouthampton Commonwealth of Pennsylvania is Township County of Bucks empowered enact amend and repeal zoning ordinances to plan and to accomplish the purposes of the Pennsylvania implement its comprehensive Municipalities Planning Code pursuant amended to to the Act of 1968 L P 805 No 247 as reenacted and and WH the Board of Supervisors enacted a Zoning Ordinance that regulates signs CRIiIAS WHEREAS businesses and other the Board of Supervisors is organizations technology and the desire of mechanically controlled display signs and aware to use electrically or and of changing WHER the Board of Supervisors desires to amend the Zoning Ordinance to provide CAS sign regulations for permitting and regulating electrically or mechanically controlled display signs WHEREAS NOW THERETORE the Board of Supervisors of Upper Southampton Township County of Bucks Conunonwealth of Pennsylvania does hereby ordain and enact the following Sectlon 1 63 A 1 of the Code of Ordinances ofthe Chapter 185 Article VII Section 185 Township of Upper Southampton is amended by the addition of the following definition Electrically or Mechanically Controlled Display Sign a digital display that is located on or is part of a freestanding sign or parallel sign whose message or display area is controlled by and elechical or mechanical means The light emitting source ofthe display may be by lamp bulbs light emitting diodes reflected light with fluorescent or other illuminating devices Section 2 63A 2 ofthe Code of Ordinances ofthe Chapter 1 85 Article VII Section 185 Township of Upper Southampton is amended by the addition of the following Subsection o as follows o Electrically Mechanically Controlled Display Sign An Electrically or Mechanically Controlled Display Sign hereafter EMCD is permitted as a special exception in accordance with the following standards and conditions or 1 An EMCD may be located along Street Road and Second Street Pike in the RS Retail Sales District CC Controlled Commercial District and LI Ligh Industrial District on properties with at 2 An EMCD shall not exceed light a brightness frontage on such roads level of 0 3 foot candles above ambient depending on the sign size Measuring by taking the square root of the sttm of 100 plus the area of the sign in square feet For example a 12 square foot sign would result in a 10 6 foot measuring distance 6 the square root of 100 10 12 The test for in foot candles level shall be the difference between when measuring brightness the sign is offand when the sign is illuminated as measured from least 100 feet of road a preset distance distance shall be determined 3 The color and brightness of the message display of the EMCD shall meet the standards established at Section 185 58 All EMCD shall 4 automatic dimming technology brightness indirect correlation with the ambient The messageldisplay shall not blink or shall not so that the EMCD change equipped with automatically adjusts its come light at intervals of less than b0 seconds and flash at any tune 5 The messageidisplay shall be static and shall not be animated or otherwise move move in any direction 6 The time interval used to scroll display to the change from one complete message conplete message display shall be a maximum of one 1 second next message shall not use or employ visual dissolving or fading display techniques in which any pact ofone message display appears simultaneously with of a second message any part display 7 The 8 An EMCD shall be located and shall have an area part of a freestanding or parallel sign only ofnot more than 16 square feet The aspect ratio height to on andlor district Advertising signs that constitute an obstruction as defined in Subsection A 2 b hereof shall not be permitted in any zoning district Section 4 All other regulations provisions parts paragraphs sections subsections clauses 185 of the Code of Ordinances of the Township of Upper Southampton not specif cally amended by this Ordinance shall remain unchanged and in full force sentences or portions thereof ofChapter and effect part Section 5 The provisions of this Ordinance may be severed Tf any section clause sentence or provision thereof shall be held illegal invalid of unconstitutional by any court of competent t shall not impair any of the remaining sections clauses jurisdiction such decisions of the cout sentences parts or provisions ofthis Ordinance It is hereby declared to be the intent ofthe Board of Supervisors ofUpper Southampton and that this Ordinance wouldhave been enacted if such illegal invalid orunconstitutional section clause sentence part of
