WHEREAS, the Township Council previously adopted provisions regarding the sale of secondhand goods and the licensure of dealers in such goods by Ordinance 2013-14; and
WHEREAS, upon recommendation of the Police Department, the Township Council now seeks to amend the scope of goods governed by such regulations.
NOW THEREFORE, BE IT ORDAINED the Township Council of the Township of
Maple Shade as follows:
Section 1. The definition of “Secondhand Goods” contained in Section 114-41 is hereby amended to delete the words “furniture” and “clothing.” follows:
Section 2. Appendix 1 (Also identified as Appendix 114(a)) is hereby amended as a.
The words “furniture” and “clothing” are hereby deleted. b.
The term “any and all other articles of value” is revised to read “any and all other articles of value identifiable by a serial number or other owner-applied number.”
Section 3. Repealer.
Any and all other ordinances inconsistent with any of the terms and provisions of this ordinance are hereby repealed to the extent of such inconsistencies.
Section 4.
Severability.
In the event that any section paragraph, clause phrase, term, provision or part of this ordinance shall be adjudged by a court of competent jurisdiction to be invalid or unenforceable for any reason, such judgment shall not effect, impair or invalidate the remainder thereof, but shall be confined in its operation to the section, paragraph, clause, term, provision or part thereof directly involved in the controversy in such judgment shall be rendered.
PLEASE TAKE NOTICE that this ordinance will be heard on second reading and a public hearing will be held by the Township Council at a meeting to be held at the Municipal
Complex, 200 Stiles Avenue, Maple Shade, NJ (08052) on March 27, 2014 at 7:00 pm. All interested persons will be afforded an opportunity to speak at the public hearing.
