CFS PREMIUM GREEN BAMBOO AND SOLID STRAND EUCALYPTUS FLOORING WARRANTIES AND FLOOR CARE COMMITMENT TO THE CUSTOMER CFS offers the following warranties for your protection. The warranties described below are given to the original purchaser, are not transferable, and are subject to the procedures, limitations, disclaimers, and exclusions set forth herein. The warranties cover only approved product applications as recommended by CFS Corporation. The warranties are only valid when the CFS products are used under normal, residential household conditions with the exception of the light commercial finish warranty and all products are installed according to the CFS Premium Green Bamboo and Solid Strand Eucalyptus Flooring Installation Instructions. LIMITED MANUFACTURING DEFECTS WARRANTY CFS Premium Green Bamboo and Solid Strand Eucalyptus Flooring products are warranted to be free from manufacturing defects for the life of the product subject to the standard 5% allowable defect allowance that is common within the flooring industry. LIMITED 25-Year Finish Warranty CFS Corporation warrants to the original purchaser that its finish layer will not wear through or separate from the bamboo for 25 years from the original date of purchase. This warranty applies to all CFS Premium Green Bamboo and Solid Strand Eucalyptus flooring products when used in normal residential household conditions. LIMITED 3-YEAR LIGHT COMMERCIAL FINISH WARRANTY CFS Corporation warrants to the original purchaser that its finish layer will not wear through or separate from the flooring for 3 years from the original date of purchase. Finish wear through is defined as 100% finish removal over a minimum of 3% of the total installation. This warranty applies ONLY TO CFS Premium Green Bamboo and Solid Strand Eucalyptus flooring products when used in light commercial installations as defined below. Light Commercial Defined: Hotel Conference, Meeting, and Guest rooms, Retail Boutiques, Sales Floors, Barber and Beauty Shops, Showrooms, Product Display Areas, Office Conference & Meeting Rooms, Showrooms, Institutional Classrooms, Meeting Rooms, Commons Areas, Residence Hall Living Areas, Medical Offices, Waiting Rooms, Examination Rooms, and Storage Rooms. Warranty Exclusions CFS CORPORATION DOES NOT GUARANTEE THE INSTALLATION OF ANY OF ITS PREMIUM GREEN BAMBOO AND SOLID STRAND EUCALYPTUS FLOORING PRODUCTS OVER RADIANT HEAT SYSTEMS. Grain patterns and color variations created in bamboo stalks and eucalyptus trees are like all of nature - never repeated. Naturally occurring characteristics such as streaks, knots, variations in grain and color are not considered defects. Your newly installed floor may vary from samples or pictures shown — this variation is not covered by our warranty. 10/12/2012 CFS Premium Green Bamboo and Solid Strand Eucalyptus Flooring Warranties and Floor Care - 1 Scraping in our hand scraped bamboo is all done manually and will not be uniform. These scrapes are not considered defects. Splintering along the edges of hand scraped bamboo, after recommended cleaning, is not covered under the warranty. Flooring affected by splintering can be repaired with a stain stick – available at most big box home centers. Also, age, character and exposure to sunlight may keep new or replacement flooring from matching existing flooring or samples. Product must be inspected and match the original sample or be approved by the original purchaser prior to installation. Any product thought not to match original sample or thought to be defective by the person doing the installation should be returned to the dealer for inspection and possible replacement PRIOR TO INSTALLATION. Installation constitutes acceptance of the products. No warranty or and cost reimbursements will be offered for obvious appearance-related claims such as grade color or possible manufacture defects once the products have been installed. Because bamboo and eucalyptus flooring are natural products, they will expand and contract due to seasonal moisture level changes. The relative humidity in the home must be kept in between 35% to 55% to properly maintain the floor. CFS Corporation is not responsible for hydrostatic pressure or thermal dynamics resulting from an improper concrete slab installation. All flooring will undergo natural color changes due to the effects of sunlight and/or ultraviolet light and these changes are not covered by our warranty. Area rugs and other furnishings should be moved occasionally as they block sunlight and may give the appearance of discoloration around where the rug was located. This is not a product defect. CFS Corporation warranties exclude damage caused by tapes and or adhesives, indentations, scratches, or damage caused by misuse, negligence, accidents, fire, erosion, insects, pets, shoes, pebbles, sand, and other abrasives. Also excluded is failure to follow all written installation instructions, lack of proper maintenance, insufficient protection of furniture legs, and misuse or improper alterations of the original manufactured product. All installations must comply with the procedures outlined in the CFS Premium Green Bamboo and Solid Strand Eucalyptus Flooring Installation Instructions, which can be found online at www.cfscorporate.com. No damage or defects caused by improper installation or failure to provide a suitable installation environment are covered in this warranty. Failure to install your flooring in accordance with the instructions will void all warranties. CFS reserves the right to request documentation of all moisture readings collected before, during and after the installation. Failure to provide adequate information related to moisture readings may void your warranty. Damage due to water and/or moisture, including, but not limited to, kitchen spills, dropped ice, damage resulting from broken or leaking pipes, wet mopping, weather conditions, or natural disasters is excluded from CFS Corporation warranties. Any alteration of original manufactured product is not covered under this warranty. Alteration or repairs to the manufacture’s original product will void any and all warranties. This includes sanding, top coating, recoating, or refinishing of the factory applied finish. Gloss reduction is not considered surface wear; therefore it is not covered under this warranty. No warranties apply to cabin grade, off-grade, products sold “as-is”, or any other products not outlined in the warranty. The sole obligation and liability of CFS under our limited warranties is to repair, replace or have the floor refinished, at CFS’s option. Only floors that were professionally installed may be eligible for labor cost reimbursement. If you installed the floor yourself, CFS may cover the cost of replacement materials only. These warranties EXCLUDE and will not pay for consequential or incidental damages associated with any warranty claim. CFS will not pay costs associated with relocation during the repair process such as hotel, meals, or moving and storage of furniture. This writing is the complete and exclusive statement of the warranty, and is in lieu of all other expressed and/or statutory warranties. CFS Corporation assumes no liability for incidental or consequential damages. Claims Information In the unlikely event that any portion of your CFS Corporation floor should fail with respect to the provisions of the warranties, CFS Corporation, at its discretion, and only to the original purchaser, will repair, refinish, or replace such defective portion with the same product or one of equal value. In the unlikely event that CFS Corporation is not able to correct the failure after a reasonable number 10/12/2012 CFS Premium Green Bamboo and Solid Strand Eucalyptus Flooring Warranties and Floor Care - 2 of attempts, CFS Corporation will refund to the original purchaser, if requested, the purchase price for that portion of the floor that fails. TO FILE A CLAIM: First, the end user should contact the retailer where the floor was purchased. The retailer may be able to remedy your problem or will take the appropriate steps to help. If, for any reason, you need to contact CFS Corporation you can, however, CFS will work with your retailer only to determine the cause of the issue (if your retailer is no longer in business, see the details below). Proof-of-purchase (sales receipt) is required to verify all warranty claims. CFS Corporation reserves the right to have the floor inspected and remove samples for technical analysis. For all claims – if either party cannot determine if the issue is a manufacturer defect or not, the retailer or end user should hire an independent NWFA flooring inspector to inspect the job and provide their conclusions. The inspection MUST be from a NWFA certified inspector. All other inspections may be determined to be invalid. If determined to be a manufacturing defect, the end user and retailer should agree on requested settlement from CFS prior to submitting to CFS. Both parties should sign the CFS claim form as their recommendation for settlement. CFS will review the claim and all supporting documents provided. If CFS agrees with the requested settlement, CFS will submit the claim approval letter (which will spell out the settlement in detail – expenses and other settlement requests). Both end user and retailer should sign and return the letter to CFS. Once received, a Credit Memo will be issued to the original purchaser (retailer). CFS will require, for technical analysis, pieces of the defect to provide to the manufacturer for quality control purposes. If retailer is no longer in business, the end user may contact CFS directly – after hiring the independent third party NWFA inspector for their results. To present a claim to CFS, some documentation of proof of purchase of CFS Flooring (sales receipt from retailer, picture of information from the end of a box of material), a detailed list of expected expense reimbursements and settlement requests will be needed as well as the inspection report detailing the findings. Upon review of claim and CFS approves the claim, CFS will then work with you to repair or replace your flooring. If your floor is no longer offered, CFS will replace or repair your floor with a comparable product. CFS can only issue credit for labor and incidentals in this case. CFS will reimburse you for all inspection fees on all claims if the product fail was determined to be a manufactures defect. Those expenses should be included in your settlement request. Claims Jurisdiction The parties hereby submit to the jurisdiction and venue of the Superior Court of Gwinnett County and the United States District Court for the Northern District of Georgia in the event of a dispute arising from or relating to this Agreement. The parties agree that any dispute, controversy or claim arising out of or in connection with, or relating any way to, the warranties contained herein or the purchase, use, installation, delivery or condition of the products warranted hereby, shall be filed in, and exclusively litigated in, the Superior Court of Gwinnett County, Georgia or the United States District Court for the Northern District of Georgia. PREMIUM GREEN BAMBOO and STRAND EUCALYPTUS FLOOR CARE AND MAINTENANCE Clean loose dirt and grit from the floor using a dust mop, broom, or vacuum (without a beater bar head) o Broom or vacuum without beater bar head is recommended on all Hand scraped Premium Green Bamboo Floors. Immediately wipe up food or liquid spills with a soft damp cloth. Do not use oil-based products such as oil soap. 10/12/2012 CFS Premium Green Bamboo and Solid Strand Eucalyptus Flooring Warranties and Floor Care - 3 For additional cleaning use a product designed for cleaning no-wax hardwood floors (such as Bona® Hardwood Floor Cleaner with a microfiber cleaning pad). These products should not contain lemon oil or ammonia. Do not use a wet mop to clean your floor and do not allow the floor to become flooded. Never wax your floor. Keep your pet’s nails trimmed. Use plywood or Masonite to protect your floor when rolling heavy loads such as appliances across your floor. Install proper floor protectors on the feet of all furniture. Avoid heavy impacts, spiked high-heels, and rotational loads. Have a professional repair any areas of the flooring that become damaged.
