AHMA’s annual Spring Management Event (SME) will be held May 5-6, 2016
at the Borgata Hotel, Casino and Spa in Atlantic City. The SME is once again
presented in partnership with the New Jersey Housing and Mortgage Finance
Agency (NJHMFA).
“We have a great line-up of workshops, speakers and special events,” said JAHMA President Sandy Cipollone. “The entire agenda is chock full of information
that will benefit you, both personally and professionally, as well as your company or organization.”
“In addition to general sessions, you will be able to choose workshops presented in concurrent sessions, so you and your colleagues can plan to focus on as
many problems, issues and solutions as you need to get the most out of the
conference,” said Jo Ann McKay, executive director. “Everything from sessions
on cybersecurity, changes in regulations, inspections, and much more of a substantive nature.”
“We also offer networking opportunities, and times to socialize, where you
learn as you engage with your peers,” she said.
Giving back to the community is encouraged by asking attendees to bring nonperishable food items, which will be donated to the Community Food Bank of
New Jersey.

• An awards luncheon, at which the Walter E. Kreher Distinction in Housing
Award will be presented;

Golf Outing Will Be Fore! Scholarships
F
or the 18th year, JAHMA members have the opportunity to
contribute to the JAHMA Foundation’s scholarship program
by participating in the annual Golf Outing, which will begin with
a shotgun start at 12:00 p.m. on the day preceding the Spring
Management Event (Wednesday, May 4, 2016).
Held on the Atlantic City Country Club course, the Golf Outing
opens with registration and a continental breakfast at 10:00
a.m., as well as lunch on the golf course and, after the final
round, cocktails and an awards banquet.
Proceeds are donated to The JAHMA Foundation Scholarship
Fund to further educational opportunities in the 2016-2017
school year for residents living at a JAHMA-member “Affiliate
Property.”

JAHMA Foundation President Ken Pagano noted that 2015’s
Golf Outing brought together 105 golfers and 112 sponsors.
“This very enjoyable event raised about $87,000 for the foundation’s scholarship program,” he said. Along with funds raised
for the In Time of Need program, and vendor exhibit funds, last
year’s Golf Outing netted approximately $100,000 for the
foundation’s programs.
“At the rate we’re going, we may hit our $1 million goal for
scholarships within the next few years,” Pagano said. “This will
be a tremendous accomplishment.”

Francis Thomas Wins Industry Award
A
t its March 6, 2016 meeting in Washington, NAHMA
(the National Affordable Housing Management
Association) honored JAHMA with its AHMA of the
Year Award in the Mid-sized AHMA category. Prior to this
year, JAHMA had been in the small-sized category, and
our increase in membership, which helped bump us up,
was noted as a reason for the award, as was our offering
more educational opportunities to our members.
“We are always appreciative of being recognized by
NAHMA for the outstanding work our organization and
its members do,” said Sandy Cipollone, JAHMA’s board
president. “Since the competition is among AHMAs from
all across the country that are also doing excellent work,
we greatly value this honor.”
“JAHMA continues to be an outstanding resource for its
members and the community as a whole, as evident
by its increased educational programs and charitable
endeavors,” Kris Cook, CAE, NAHMA executive director,
said. “The associations’ hard work and commitment to
its members, and to NAHMA, has shown JAHMA is truly
deserving of the AHMA of the Year award in its size
category. We look forward to seeing what JAHMA can
accomplish in the years ahead.”
Also receiving an AHMA of the Year Award is PennDel
AHMA, which won in the small-sized category, and
SAHMA, the Southern Affordable Housing Management
Association, which won in the large-sized category.

Among the other awards given are NAHMA Industry
Statesman Awards, Industry Achievement Awards,
Innovation Awards, AHMA Communities of
Quality Program Award (for AHMAs whose members
increase the number of properties that are NAHMArecognized COQs), and NAHMA Presidents Award.
This year, the Industry Partner Award went to Francis
Thomas, director of contract administration for the
New Jersey Housing Mortgage Finance Agency. He is
on the NJHMFA Management Task force and has made
a significant difference in dealing with all the complex
issues of not only HUD rules but also the new rules
coming out of NJHMFA. He has served as an advisor to
JAHMA and has worked tirelessly on programs for the
JAHMA Foundation.
The Industry Partner Award is given annually to
a government agency or other affordable housing
organizational partner that has made a significant
contribution to the cause of affordable housing in the
previous year.

Obligations of Property Managers:
Are You Violating the Law in New Jersey?

An employee must be licensed in order to list a unit for sale
or lease (this includes preparing or placing advertisements –
offering or attempting to offer real estate or an interest
therein or soliciting/assisting or directing in the procuring of
prospects) negotiating or signing a lease, collecting or
attempting to collect rent, and negotiating a loan secured or
to be secured by mortgage or other encumbrance upon or
transfer of any real estate for others.
Some employees need not be licensed, including secretaries,
bookkeepers, construction or maintenance personnel, or
independent contractors who service the utilities but do not
have contact with tenants or prospective tenants.
Titles are sometimes misleading and cannot be relied upon;
it is the actual function that makes the difference. For example, a “superintendent” who makes repairs and manages
utilities would not be considered involved in a real estate
transaction, but if that “superintendent” negotiated leases
or collects rent, then that person would be considered as
engaging in a real estate transaction and would have to be
licensed by the appropriate state agency.
According to a New Jersey statute (N.J.S.A. 45:15-1), no per-
son shall engage either directly or indirectly in the business
of a real estate broker, broker-salesperson, salesperson or
referral agent, temporarily or otherwise, and no person shall
advertise or represent himself as being authorized to act as
a real estate broker, broker-salesperson, salesperson or
referral agent, or to engage in any of the activities described
in R.S.45:15-3, without being licensed to do so.
As defined by N.J.S.A. 45:15-2, “engaging in business” is any
single act, transaction or sale, and shall constitute engaging
in business within the meaning of this article.
The difference between a broker, salesperson, broker-salesperson, or referral agent is spelled out in the legislation.
That is to say, a broker is essentially self-employed, whereas
the other categorized persons are employed by and operate
under the supervision of a licensed real estate broker.
(N.J.S.A. 45:15-3) A real estate broker, for the purposes of
R.S.45:15-1 et seq., is defined to be a person, firm or corporation who, for a fee, commission or other valuable
consideration, or by reason of a promise or reasonable
expectation thereof, lists for sale, sells, exchanges, buys or
rents, or offers or attempts to negotiate a sale, exchange, purchase or rental of real estate or an interest therein, or collects

and commission, or otherwise to sell real estate, or any parts
thereof, in lots or other parcels.
A real estate broker-salesperson, for the purposes of
R.S.45:15-1 et seq., is defined to be any person who is qualified to be licensed as a real estate broker but who, for
compensation, valuable consideration or commission, or
other thing of value, or by reason of a promise or reasonable
expectation thereof, is employed by and operates under the
supervision of a licensed real estate broker to perform the functions of a real estate salesperson as defined herein.
A real estate referral agent, for the purposes of R.S.45:15-1
et seq., is defined to be any person employed by and operating under the supervision of a licensed real estate broker
whose real estate brokerage-related activities are limited to
referring prospects for the sale, purchase, exchange, leasing or
rental of real estate or an interest therein. Referral agent
licensees shall only refer such prospects to the real estate
broker through whom they are licensed as a referral agent
and shall only accept compensation for their activity as a
referral agent from that broker. A referral agent shall not be
employed by or licensed with more than one real estate broker at any given time. No person may simultaneously be
licensed as a referral agent and a real estate broker, brokersalesperson or salesperson, and no person licensed as a
referral agent may engage in the business of a real estate
broker, broker-salesperson or salesperson to an extent
beyond that authorized by their status as a licensed real
estate agent.

No person, firm, partnership, association or corporation shall
bring or maintain any action in the courts of this State for the
collection of compensation for the performance of any of the
acts mentioned in R.S.45:15-1 et seq. without alleging and proving that he or she was a duly licensed real estate broker at the
time the alleged cause of action arose.
No person claiming to be entitled to compensation as a
referral agent, salesperson or broker-salesperson for the
performance of any of the acts mentioned in R.S.45:15-1 et
seq. shall bring or maintain any action in the courts of this
State for the collection of compensation against any person,
firm, partnership or corporation other than the licensed broker with whom the referral agent, salesperson or
broker-salesperson was employed at the time the alleged
cause of action arose, and no action shall be brought or
maintained without the claimant alleging and proving that
he or she was a duly licensed real estate referral agent,
salesperson or broker-salesperson at the time the alleged
cause of action arose.

Deadline for JAHMA Scholarship Applications June 1st
G
ood news! There is still plenty of time to submit
an application for a scholarship from the JAHMA
Educational Foundation for 2016-2017.
The JAHMA Educational Foundation will be accepting
scholarship applications until June 1st. The program, in
its 15th year, has awarded more than $620,000 to worthy
student-residents attending college, trade or technical
schools.
Residents can access the application by going to the
JAHMA website at www.jahma.org and clicking on the
Educational Foundation icon. Residents must be in good
standing at their apartment community and be a high
school senior, graduate or GED holder to be eligible. In
order to qualify for consideration an application must
contain an application form, two references, an essay, a
Certification of Residency in Good Standing form, and a
current grade transcript.
“Last year, the Foundation provided 21 scholarships to
individuals living at 11 different apartment communities
across New Jersey,” said JAHMA Foundation President
Ken Pagano at a recent JAHMA board meeting.
“This year, we would like to see those numbers increase.

Veterans Housing Initiative
Wants to Support You
It’s time for property managers throughout the JAHMA community
to promote and implement the 2016 Art and Poster contest for the
2017 NAHMA calendar. This year’s theme is Words That Heal: Stop
Bullying, Spread Kindness.
The JAHMA Foundation’s Veterans Housing Initiative is seeking to
enhance its awareness of programs and activities that management
companies across New Jersey are operating to assist veterans with
their housing needs and/or progressive programs for veterans once
they have established residence within an apartment community.
Each year children from communities in assisted housing from all
over the country submit posters after first sending them to their local
AHMA. The contest always has an anti-drug theme as well as various sub-themes.
Local JAHMA winners receive prizes and recognition, and the firstplace artwork is forwarded to the NAHMA Educational Foundation
for the national contest. The national grand-prize winner gets a
$2,500 gift certificate and a trip to Washington, D.C. for the awards
presentation.

Navigate Issues Challenge to Foundation Donors
N
avigate Affordable Housing Partners (Navigate), headquartered in Birmingham, Ala., has made a $50,000 donation in support of the NAHMA
Educational Foundation 2016 scholarship program and challenges others to do the same.
“Our $50,000 donation to the NAHMA Educational Foundation will help sponsor its 2016 annual fundraising dinner,” Eric Strong, Navigate CEO, said. “As a
foundation board member, I see firsthand the great work this board is doing to
create opportunities to continue education for residents of affordable housing.
Navigate is thrilled to continue supporting these initiatives, as we have done for
the past 10 years.”
In addition to the donation, Navigate has agreed to match—up to an additional
$50,000—any new donor sponsorships for the June 15 event, which will be held
at Twenty Five Lusk in San Francisco. This annual fundraising dinner supports
the scholarship fund for the NAHMA Educational Foundation, a 501(c)(3) nonprofit corporation dedicated to furthering the educational opportunities of residents living in an Affordable Housing Management Association (AHMA) member property. In 2015, the scholarship program awarded a total of $212,500 to
worthy post-secondary school students.
“We are overwhelmed by Navigate’s generosity and are pleased to partner with
them. We look forward to speaking directly with potential donors and promoting these matching seed funds to significantly increase the number of scholarship awards available in 2017,” Melissa Fish-Crane, NAHMA Educational Foundation chairperson, said.
“We have had numerous residents of our member properties receive scholarships from the NAHMA, as well as the JAHMA, foundations,” pointed out Jo Ann
McKay, JAHMA executive director.
