JAHMA NAMED 2015 AHMA OF THE YEAR Francis Thomas Wins Industry Award A t its March 6, 2016 meeting in Washington, NAHMA (the National Affordable Housing Management Association) honored JAHMA with its AHMA of the Year Award in the Mid-sized AHMA category. Prior to this year, JAHMA had been in the small-sized category, and our increase in membership, which helped bump us up, was noted as a reason for the award, as was our offering more educational opportunities to our members. “We are always appreciative of being recognized by NAHMA for the outstanding work our organization and its members do,” said Sandy Cipollone, JAHMA’s board president. “Since the competition is among AHMAs from all across the country that are also doing excellent work, we greatly value this honor.” “JAHMA continues to be an outstanding resource for its members and the community as a whole, as evident by its increased educational programs and charitable endeavors,” Kris Cook, CAE, NAHMA executive director, said. “The associations’ hard work and commitment to its members, and to NAHMA, has shown JAHMA is truly deserving of the AHMA of the Year award in its size category. Among the other awards given are NAHMA Industry Statesman Awards, Industry Achievement Awards, Innovation Awards, AHMA Communities of Quality Program Award (for AHMAs whose members increase the number of properties that are NAHMArecognized COQs), and NAHMA Presidents Award. This year, the Industry Partner Award went to Francis Thomas, director of contract administration for the New Jersey Housing Mortgage Finance Agency. He is on the NJHMFA Management Task force and has made a significant difference in dealing with all the complex issues of not only HUD rules but also the new rules coming out of NJHMFA. He has served as an advisor to JAHMA and has worked tirelessly on programs for the JAHMA Foundation. The Industry Partner Award is given annually to a government agency or other affordable housing organizational partner that has made a significant contribution to the cause of affordable housing in the previous year. An employee must be licensed in order to list a unit for sale or lease (this includes preparing or placing advertisements – offering or attempting to offer real estate or an interest therein or soliciting/assisting or directing in the procuring of prospects) negotiating or signing a lease, collecting or attempting to collect rent, and negotiating a loan secured or to be secured by mortgage or other encumbrance upon or transfer of any real estate for others. Some employees need not be licensed, including secretaries, bookkeepers, construction or maintenance personnel, or independent contractors who service the utilities but do not have contact with tenants or prospective tenants. Titles are sometimes misleading and cannot be relied upon; it is the actual function that makes the difference. For example, a “superintendent” who makes repairs and manages utilities would not be considered involved in a real estate transaction, but if that “superintendent” negotiated leases or collects rent, then that person would be considered as engaging in a real estate transaction and would have to be licensed by the appropriate state agency. According to a New Jersey statute (N.J.S.A. 45:15-1), no per- son shall engage either directly or indirectly in the business of a real estate broker, broker-salesperson, salesperson or referral agent, temporarily or otherwise, and no person shall advertise or represent himself as being authorized to act as a real estate broker, broker-salesperson, salesperson or referral agent, or to engage in any of the activities described in R.S.45:15-3, without being licensed to do so. As defined by N.J.S.A. 45:15-2, “engaging in business” is any single act, transaction or sale, and shall constitute engaging in business within the meaning of this article. The difference between a broker, salesperson, broker-salesperson, or referral agent is spelled out in the legislation. That is to say, a broker is essentially self-employed, whereas the other categorized persons are employed by and operate under the supervision of a licensed real estate broker. A real estate referral agent, for the purposes of R.S.45:15-1 et seq., is defined to be any person employed by and operating under the supervision of a licensed real estate broker whose real estate brokerage-related activities are limited to referring prospects for the sale, purchase, exchange, leasing or rental of real estate or an interest therein. Referral agent licensees shall only refer such prospects to the real estate broker through whom they are licensed as a referral agent and shall only accept compensation for their activity as a referral agent from that broker. A referral agent shall not be employed by or licensed with more than one real estate broker at any given time. No person may simultaneously be licensed as a referral agent and a real estate broker, brokersalesperson or salesperson, and no person licensed as a referral agent may engage in the business of a real estate broker, broker-salesperson or salesperson to an extent beyond that authorized by their status as a licensed real estate agent. There is still plenty of time to submit an application for a scholarship from the JAHMA Educational Foundation for 2016-2017. The JAHMA Educational Foundation will be accepting scholarship applications until June 1st. The program, in its 15th year, has awarded more than $620,000 to worthy student-residents attending college, trade or technical schools. Residents can access the application by going to the JAHMA website at www.jahma.org and clicking on the Educational Foundation icon. Residents must be in good standing at their apartment community and be a high school senior, graduate or GED holder to be eligible. In order to qualify for consideration an application must contain an application form, two references, an essay, a Certification of Residency in Good Standing form, and a current grade transcript. “Last year, the Foundation provided 21 scholarships to individuals living at 11 different apartment communities across New Jersey,” said JAHMA Foundation President Ken Pagano at a recent JAHMA board meeting. “This year, we would like to see those numbers increase. Navigate is thrilled to continue supporting these initiatives, as we have done for the past 10 years.” In addition to the donation, Navigate has agreed to match—up to an additional $50,000—any new donor sponsorships for the June 15 event, which will be held at Twenty Five Lusk in San Francisco.
