General Terms and Conditions for Submission of Tender for Supply of Materials
1. Online tenders are invited from reputed and experienced manufacturers only having adequate
manufacturing & testing capacity, best facilities and capability only for supply of WHOLE
CURRENT A.C.SINGLE PHASE TWO WIRE SMART ENERGY METER OF ACCURACY
CLASS 1.0 WITH TWO WAY COMMUNICATION FACILITY SUITABLE FOR ADVANCE
METERING INFRASTRUCTURE (AMI), PEAK LOAD MANAGEMENT (PLM), AND DEMAND
RESPONSE (DR) as per specifications attached at Annexure ‘B’. Offers of manufacturers who have
no past experience and adequate manufacturing capacity of the tendered item may not be considered
valid and may be rejected. Purchase preference will be given to manufacturing unit of Jharkhand
State as per Jharkhand Procurement Policy, 2014.
2. Eligibility criteriai)
The bidder should be Indian meter Manufacturer only.
ii) The bidder must possess bureau of Indian Standard Certification (ISI mark) for meter manufactured
in India.
iii) The bidder must possess valid ISO 9001:2008 certification for meter manufacturing, ISO 27001:2005
for information security management system & ISO 14001:2004 for environmental management
system.
iv) Bidder should have CMMI level 3. Certificate of the same shall be enclosed with the bid.
v) The bidder should have valid electrical license of state of Jharkhand at the time of installation.

3) The online Tender should be submitted in the prescribed enclosed proforma only in two parts
i.e. (Technical & Commercial Part) and (Price Part) in two separate folder.
4) Both parts of the tenders will be submitted upto 18.00 hrs on 23.1.2016 in the website
Jharkhand tenders.gov.in and the Part – I will be opened on 28.01.2016 at 11.00 hrs. The
undersigned may extend the due date of opening of Part – I with intimation to all tenderers.
Price part should only be uploaded in price part-II folder only failing which offer shall be
rejected. Please note that the bidder should submit the two samples meter with box with the
bid.
The online Price Part (Part–II) of those tenderers whose offers are found technically and
commercially acceptable will be opened later on.
5.
No offers/ tenders will be accepted after due date and time.
The desirous tenderers can download tender documents including terms and conditions, BoQ

6.
Earnest money:
a)
Tender must be accompanied with an earnest money for
Rs. 02 Crores (Rs. Two Crores) only
for the offered quantity, unless exempted from such deposit, failing which the tender will be out
rightly rejected.
b)
The earnest money should be deposited in the form of Bank Draft / Bank Guarantee of any
Nationalized Bank, valid for 180 days from date of opening of tender, drawn / issued in favour of

in the Office of Chief

Earnest money deposited by firms against any other tender of the Nigam/ or of this office will not be
considered as earnest money for the present tender under any circumstances.

Exemption:
The tenderers of following categories are exempted from deposit of earnest money
subject to the conditions laid down below: a)
The firm registered with DGS&D for manufacture of the item for which tenders are to be
submitted and the registration certificate should remain valid at the time of submission of
the tender and during contract period. The tender in such case shall be accompanied with
a certified photo state copy of the valid registration certificate failing which the tender
shall be rejected. The monetary limit should be more than Rs. 100 crores (Rs. One
hundred Crores) as mentioned in the DGS&D certificates, failing which the
exemption will not be applicable & offer will be rejected.
b)
The State Govt./ Govt. of India undertaking.
c)
Firms registered with NSIC under single point registration scheme for manufacture of the
item, provided that certificate is valid on the date of tender and during the period of
delivery. The monetary limit should be more than Rs. 100 crores (Rs. One hundred

Crores) as mentioned in the NSIC certificates, failing which the exemption will not be
applicable & offer will be rejected.
d)
The earnest money will be liable to be forfeited on revocation of tender before the
validity of the quotations expires or on refusal to enter into a contract after the award
(LoI/PO) is made to the tenderer.
e)
SSI unit of Jharkhand, registered with Department of Industries, Govt of Jharkhand /
Industrial Area Development Authority, Govt of Jharkhand, for tendered item, valid on
the due date of tender and during the period of contract. SSI unit of Jharkhand must
submit self attested or notarized valid copy of SSI registration certificate for tendered
item, issued from department of Industries/ Industrial Area Development Authority, Govt
of Jharkhand, failing which, they will not be considered SSI unit.
The tender in such cases should be accompanied with self attested or notarized
copy of the valid registration certificate, failing which tender shall be rejected.
NB:
Aforementioned certificate must accompany with documentary evidence for its validity
on the due date of the tender, failing which tenders will be rejected. As the documents
mentioned herein above must be valid during the period of supply/ delivery also. Copy of
the same shall be produced at the time of submission of bill for payment.
8.
Security Deposit and Contract Agreement:
The successful tenderers shall have to deposit security money @ 2% of the ordered value at
the time of executing the contract agreement. However, the SSI units of Jharkhand having
permanent valid registration with Department of Industries /Industrial Area Development
Authority (IADA) Govt. of Jharkhand for the manufacture of the item will be required to
deposit security money of the ordered value as per Jharkhand Procurement Policy’2014. In
no case, exemption from security money will be granted. Security money to be deposited
may be adjusted from the earnest money deposited in shape of cash/ Bank Draft only, if any.
The amount of security money shall be deposited with AO,JBVNL, Ranchi in cash or
in shape of Bank Draft/ Bank Guarantee (of any Nationalised Bank) will be treated as a
performance guarantee. The security money thus deposited will be released after completion
of satisfactory supply of full ordered quantity of materials, expiry of guarantee period.
Payment will be made only after depositing the security money and execution of contract
agreement.
The bid security may be forfeited:
a)
If the Bidder:
i) Withdraws its bid during the period of bid validity specified by the bidder in the bid form, or
b) In the case of a successful bidder, if the bidder fails:
i)
to sign the contract, or
ii)
to furnish the required performance security.
9.
Annual turnover:
Annual turnover of the firm for preceding three financial years must be at least Rs. Rs. 30
crores (Rs. Thirty Crores) only Certified / Attested copy of annual A/C (Balance sheet,
profit & loss A/c etc) from practicing chartered Accountant or both for financial year

2012-13, 2013-14 & 2014-15 must be submitted along with the offer to establish financial
credibility of the bidders. In absence of the above credentials, offer may be rejected.
However, SSI units of Jharkhand are exempted from annual turnover clause.
10.
Delivery:
The Commencement of delivery period shall be reckoned from the date of issue of PO. The
proforma of schedule of delivery (annexure-‘H’) is enclosed with the tender. Tenderers shall
fill up the proforma giving a clear schedule of delivery. Early delivery may be preferred.
11.
Penalty / Liquidated damage:
The delivery of goods will be guaranteed under liquidated damage clause. Our usual terms of
LD-clause is ¼% (quarter percent) of the value of the materials delayed per week or part
thereof subject to maximum 5% (Five percent).
The above item will be deemed to have been delivered only when all its component parts are also
delivered in stores of JBVNL. If certain components are not delivered in time the equipment/item will
be considered as delayed till such time as the missing parts are delivered.
12.
Price:
Rate in figures and in words must be quoted in the enclosed proforma of price part on FIRM
price, subject to any statutory change in due course of time, indicating therein Ex-factory
price, freight element up to destination, element of Excise duty, sales tax and other charges.
The Ex-works price shall be quoted after considering benefit under CENVAT or any other
scheme to be retained by the supplier. The materials are to be dispatched to various
destinations in Jharkhand as may be required. The responsibility of safe delivery will rest
with the supplier. If the price elements are not quoted separately as indicated above, the
tender will be liable for rejection. Freight element will include loading, unloading, packing
and forwarding complete. If any other taxes are levied or reduced by the Govt. the same will
be added or subtracted respectively to the landed cost for evaluation of the tender. If Excise
Duty, Sale Tax / VAT or Entry Tax is not quoted separately or proof of exemption of the
same is not given, the relevant duty and / or tax at the maximum rate will be added to
evaluate landed cost of the bidder.
Arithmetical errors will be rectified on the following basis: If there is discrepancy
between unit price and the total price i.e obtained by multiplying the unit price and quantity,
the unit price shall prevail and total price shall be corrected. If the bidder does not accept the
correction of errors, his bid will be rejected & EMD will be forfeited. If there is a
discrepancy between words and figures, the amount in words shall prevail.
11) Routine Tests:- The successful bidder will have to furnish routine test report of the meters and meter boxes
expected to be supplied. The tests that will be conducted on the materials shall be stated in the tender. It is
pertinent to note that each unit of material (meter and meter box) shall be subjected to the tests prescribed in the
relevant standard (latest edition) before supply is affected. Untested materials shall not be accepted.
12) Type-test:- The tenderer shall also submit applicable type test report of the tendered item from any
NABL(ERTL/YMPL/CPRI/ERDA) accredited laboratory, failing which the tender shall be rejected out
rightly.

13) BIS Licence certificate:- The bidders shall have to submit copy of BIS license certificate for tendered item
which should be valid on the due date of tender, failing which the tender will be rejected out rightly.
14) Calibration:- The meters shall be factory calibrated and sealed suitably before dispatch as explained in the
Guarantee Technical Particulars.
Guaranteed particulars:- The performance particulars as required in the specification should be sent along
with the tender. Other details not specified may also be given.
15) Past experience:Bidders must have supplied at least 5 (five) lacs static energy meters with meter box, LCD display and
communication Port facility within Financial Year 2012-13, 2013-14 & 2014-15. Bidders must submit detailed
list of executed purchase orders along with their copies for the same item clearly indicating PO # and date with
name of material and its quantity & value and also submit name and address of the ordering authority issued in
at least any one of the last 3 (three) years from the due date of tender, failing which the offer may be rejected.
The bidder should also submit performance certificate if any, indicating period of supply, quantity and value for
the tendered item issued during the above period with the offer.
On placement of order, Bidder has to supply full ordered quantity, failing which the bidder shall not be
eligible to participate in forth coming tenders, for a period of at least one year from the date of issue of such
purchase order.
Past performance of the material supplied earlier by a bidder to erstwhile JSEB may be taken in to
account while finalizing this tender.
16) Deviation from specification:- Deviation from the specifications of the NIT, if any, should be specified/stated
in the offer in the deviation sheet enclosed with this BoQ. In case there is no deviation, it must be declared
clearly in the deviation sheet (Annex-‘F’).
17) Income Tax and Sales Tax:Attested copy of sales tax clearance certificate up to 31.3.2015 should accompany the tender, failing which
the tender may be rejected. State and Central Sales Tax registration Number of the tenderer should also be
stated. Self declaration certificate with a declaration separately that nothing is due to Income Tax Department
& payment of Income tax is up-to-date.
18) Drawing and Design of item:- The detailed dimensional drawing to scale will have to be furnished with the
tender. Incomplete tenders, tenders not containing full details, technical particulars, dimension, literatures, test
certificates, delivery period etc are liable to be rejected.
20) Terms of payment:-
a) 100% payment will be made by Sr. Manager/ Accounts Officer, JBVNL,, Ranchi on submission of
5% Bank Guarantee from any Nationalised Bank of ordered value on non-judicial stamp Rs. 60/(Rupees sixty) only valid for Guarantee period as per cl-22 and on receipt of SRV duly signed by the
concerned consignee after receipt of the materials in good condition along with approved routine test
certificate and duly filled check list for payment from Stores & Purchase wing.
b) If the Bank Guarantee of any Nationalised Bank is not furnished, payment will be made after
deducting 5% of the total order value from the first or consecutive bills after receipt of the materials
in good condition along with approved routine test certificate and duly filled check list for payment
from Stores & Purchase wing. The deducted amount will be kept back as performance guarantee and
will be released after successful completion of guarantee period.
For the above modes of payment ¼ % (Quarter percent) rebate will be deducted from the exfactory price of the materials. However, Excise Duty part will be paid only after production of
documentary evidence issued by Excise Department of their jurisdiction. Sales Tax will be paid on

submission of upto date income tax and sales tax deposit certificate by competent authority of
respective department. The paying officer will accept the Bank Guarantee after confirmation from the
concerned bank. Supplier must submit documentary evidence in support of claim for exemption from
any tax or duty if any. The 5% amount / B.G. will be paid after expiry of Guarantee period. Entry
Tax, if any, shall be reimbursed based on documentary evidence.
21)
Bank Guarantee for repairs of equipments / materials at the supplier’s works:
In case the equipment fails, within the guarantee period and the same is required to be taken back to the
supplier’s factory, the same shall be covered up by suitable Bank Guarantee of any Nationalised Bank of
equivalent cost of equipment for period required for replacement. Further Bank Guarantee shall be furnished by
the supplier within one week’s time on hearing from the consignees. He shall not lift the damaged/rejected
equipment from our store unless the approval of acceptance of Bank Guarantee is received from our Sr.
Manager/ Accounts Officer, JBVNL, Ranchi.
22) Guarantee:In the event of any defect in the equipment/materials arising out of faulty design inferior quality of raw
materials and bad workmanship within a period of 5 (five) year from the date of receipt of material at
purchaser’s stores, the manufacturer shall guarantee to replace or repair the defect to the entire satisfaction of
the purchaser free of cost. However, the manufacturer fails to do so within a reasonable time, the purchaser
reserves the right to defect repair or replacement and recover charges for repair or replacement from the
manufacturer.
23) Inspection:- The manufacturer should notify the purchaser well in advance (minimum 15 days) about the
program for testing of complete equipment/materials as per terms of order along with necessary work test
certificate so that the purchaser can send his representative to witness the test on the mutually agreed date. The
purchaser reserves the right to reject either raw materials or finished product found to be not complying with the
requirement of the specifications.
The manufacturer shall extend all possible facilities for inspection and testing at any time during the
course of manufacturer and after offering for inspection and testing of the finished product for which no extra
cost shall be charged.
24) Dispatch:a) The manufacturer after receiving dispatch clearance from the respective inspection Authority/Purchaser shall
deliver the equipment/materials suitably packed to stores any- where in the state of Jharkhand. The materials
should be suitably packed and the consignment is to be delivered as per dispatch instruction to be
communicated in due course, after inspection of materials/equipment. The manufacturer shall notify the
purchaser and consignee officer about value of consignment, weight and dimension of consignment by telegram
and copy will be submitted by registered post on the strength of which the consignment can be taken delivery at
destination.
b) Materials/equipment as per dispatch clearance shall have to be dispatched within the stipulated period of the
order and inspection of further lots against the said order will be arranged after receipt of confirmation
regarding physical delivery to our stores by the inspection authority.
25) Re-inspection Charge:
Re-inspection charges as applicable shall be leviable in case it is found at the time of inspection at the works of
the bidder that:
a)
The material was not ready for inspection and the inspection notice given by supplier was fictitious.
b)
Quantity offered for inspection is short by more than 50% from the quantity in the inspection call.
c)
Inspection is not arranged / not got carried out due to any reason an account of supplier.

d)
Material is found not conforming to provisions of Purchase order/ GTP/ relevant BIS and thus rejected by
inspecting officer.
Or
Manufacturing defects are observed during physical/ visual inspection/ checking.
Or
f)
Quantity of item not found as per provisions of Purchase order.
26) Packing:e)
The materials/equipment shall have to be packed suitably in transportable lots as indicated in the technical
specification. If the materials/equipment are found to be acceptable after inspection and testing, the same shall
have to be suitably sealed by our inspecting officers. Due care shall have to be ensured during transportation to
keep the packing and seal intact for acceptance by consignee stores. All necessary Assistance in this regard shall
be extended by the party to the Boards inspecting team free of cost.
The party shall have to replace the entire lot at their cost if any discrepancy/defect is found in the
materials/equipment delivered to the consignee stores. The Board reserves the right to take any penal action
what-so-ever without any further reference to the manufacturer for causing any loss to Board.
27) Minimum Quantity:
The requirement mentioned in the tender notice and general conditions is tentative and is subject to
increase or decrease at the time of finalization of the tender. The tenderer must quote minimum 60% of
the tendered quantity. Tenders with lesser quantity will not be entertained.
29) Penalty / Liquidated damage:
The delivery of goods will be guaranteed under liquidated damage clause. Our usual terms of LD-clause is ¼%
(quarter percent) of the value of the materials delayed per week or part thereof subject to maximum 5% (Five
percent). Tendered item will be deemed to have been delivered only when all its component parts are also
delivered in stores of JBVNL. If certain components are not delivered in time the equipment/item will be
considered as delayed till such time as the missing parts are delivered.
30) Validity:Validity of the tender should be for a period of at least 180 days.
31) Risk Purchase:The time of delivery or physical dispatch stipulated in the purchase order shall deemed to be the essence of the
contract and if the manufacturer fails to delivery or dispatch any consignment within the period prescribed for
such deliver or dispatch in the said purchase order/contract/letter of intent, the purchaser shall be entitled to
purchase such consignment or if not available, the best and nearest available substitute elsewhere on the account
and at the risk of the manufacturer or to cancel the contract and manufacturer shall be liable to compensate for
any loss or damage which the purchaser may sustain by reason of such failure on the part of the manufacturer.
32) Acceptance of order:The purchaser will communicate acceptance of tender to the successful bidder by a letter of intent/formal order.
In case of letter of intent, formal order will follow as early as possible after receipt of unequivocal acceptance of
LoI/PO. The successful tenderer shall communicate the acceptance of the order so as to reach the purchaser
within a week from the date of issue of the said letter of intent/Purchase order. If the acceptance of order is not
received within the above period, then the earnest money against the tender is liable to be forfeited.
33.
Extension Order:
In the event of an order being placed on the tenderer, the tenderer requested to give his concurrence
that he is willing to accept additional order on the same terms and conditions if the extension order is
placed by Nigam within 12 (twelve) month from the date of acceptance/ placement of order.

34) Accuracy:The accuracy of the meters shall not exceed the permissible limit of accuracy as per standards for a period of 10
(ten) years. In case any drift is noticed which is beyond the permissible limits the bidder shall recalibrate the
meters for correct accuracy and if re-calibration is not possible, the meter shall be replaced by a new meter
without any extra cost.
35) Tenderers are required to intimate the deviations from the guaranteed technical particulars in the enclosed
deviation sheet. In case there is no deviation, it should be mentioned clearly in the deviation sheet. The tender
will be liable to be rejected if submitted with blank deviation sheet.
36) Jurisdiction of Court:
The civil court Ranchi shall alone have an exclusive jurisdiction to decide any difference/ dispute/ cases for and
against JBVNL/ Contractors/ Suppliers arising out of or in respect of the NIT, or contract agreement, or
Purchase order.
37) The Board reserves the right to cancel full or part of the awarded contract without assigning any reason of those
firms which will be found defaulter for delay in supply of materials or his supply or his supply sub-standard
quality of the materials.
38)
The bidders should submit self-declaration Certificate, that the firm is not blacklisted from Central Govt /
State Govt / Central or State Govt. undertakings/ Public Sector Undertaking etc. for the tendered item
and also submit declaration Certificate that the firm is not related to any persons employed in the Board or
his/her close family member/blood relations / proxies.
39)
Governing Language:
The Contract shall be written in English and shall be interpreted in accordance with the laws of the union of
India.
40)
No documents submitted by bidders after opening of the tender (Part-I) on their own shall be accepted, unless
and until asked for.
41)
Sample:Two nos. sample meter alongwith meter box conforming to this specification duly sealed along with the
routine test certificates shall be submitted with techno-commercial bid free of cost. The above sample meter and
meter box shall be tested in purchaser’s meter testing lab/ independent test lab in presence of firm’s
representative & will not be returned to bidder. The sample shall be complete in all respects and no deviations
shall be allowed for technical qualification. In case sample does not conform to the specifications, the
financial bid of offer shall not be opened.
42)
Training:- The successful bidders will provide training to employee of the Nigam at their various Laboratories
spread through out the state of Jharkhand to the entire satisfaction of the purchaser.

Annexure-‘A’
Eligibility criteriaThe prospective bidder must qualify all of the following requirements to be eligible to
participate in the bidding. Bidders who meet following requirements will be considered as

TYPE TESTS
After successful design and manufacturing meter shall be type tested as per IS: 13779
(latest version) & IS 15884 (for testing of connect/disconnect feature) in a third part NABL
accredited lab.
7.
DESIGN
Voltage circuit, sealing arrangement, terminal block, terminal cover and nameplate etc. shall
be in accordance with IS-13779 (latest version). The meter shall be compact and reliable in
design, easy to transport and immune to vibration and shock involved in transportation and
handling. The construction of the meter shall ensure consistent performance under all
conditions especially during dust storm/heavy rains/very hot weather. The insulating
material used in the meter should be non-hygroscopic, non- aging and of tested quality. The
terminal block and meter case shall have safety against spread of fire. They shall not be
ignited by thermal overload of live parts in contact with them as per the relevant IS- 13779.
Meter shall have proper fixing arrangement.
8.
ELECTRONIC COMPONENTS
The meter shall be manufactured from high accuracy and reliable Surface Mount
Technology (SMT) components. The supplier should submit the details of source/agencies
from whom purchase of various components of meters used by them.

b) From remote server through suitable communication

Data Concentrator Unit (DCU)
The DCU provides the central link between Smart Meters and MDAS, enabling continuous meter read and
control.
1. Hardware & Power Supply
 The installation of DCU shall be suitable for clamp mounting on poles as well as rail mounting on
distribution panels (Constructional feature as per TS) Power supply shall be suitable for 3phase, 3x240V phase to neutral, -40% +20%, 50 Hz AC. Power
supply shall be terminated on suitable sized MCB to facilitate isolation during in-situ maintenance.  DCU shall consume minimum power for its operation and it shall also have rechargeable battery with
backup for 1 hour for normal meter reading and for 5 hours to push tamper event and carry out on demand
reading and the network health status / connectivity continuity & check. DCU should have feature to send
power outage and restoration message to server.  DCU shall have built in Real time Clock with battery backup. 2. Configuration, Functionality & Interface
 DCU shall be able to configure the communication with underlying devices/ nodes/meters.  DCU shall pull data from the field devices and push the data at configured intervals to the MDAS. It
should also support the MDAS in pulling data from the DCU. The data acquisition (Push/Pull) frequency
shall be programmable. DCU shall be capable to prioritize control commands.  DCU shall have internal memory for storing interval data  DCU shall support on demand read of individual/group of meters.  DCU shall push events like tamper, power off to MDAS immediately on occurrence/receipt from field
devices/meters3. Communication
 The DCU shall have provision for modem with SIM slot for supporting Dual-band 850/900/1800/1900
MHz GSM/GPRS module for communication over GPRS or 3G further a valid communication terminal
port i.e. RJ45/RS232 for other communication option shall also be provided. DCU modem should support
only dynamic IP SIM card.
 The DCU also shall have Wide Area Network (WAN) connectivity to the MDAS through digital cellular
GPRS / 3G communication connection  DCU shall periodically monitor meter reads/downstream commands and shall retry and reconnect in case
of failed events/reads.  During Power Interruption, on restoration of power supply DCU shall establish communication with
underlying devices as well as upstream application (MDAS) automatically.  The meter communication interface shall be suitable for data transfer for speed of upto 64 kbps.  The retry attempts shall be configurable

RF mesh (license free band) or PLC. DCU shall support
only one communication technology towards meter side.
The DCU also shall have Wide Area Network (WAN)
connectivity to the MDAS through digital cellular GPRS

commands and shall retry and reconnect in case of failed
events/reads.
During Power Interruption, on restoration of power supply
DCU shall establish communication with underlying
devices as well as upstream application (MDAS)

meters/field devices it is designed for)
1.3.10 Remote Firmware Upgrade: The DCU shall support
remote firmware upgrades as well remote configuration in
order to remotely add new features and functions to DCU
without having to send person to field.
