1. CONDITION OF TENDERING

a) Tenderer should have minimum two years experience in Operation & Preventive
maintenance of Pumping stations and its machinery in Water Supply Scheme to the
bodies like Maharashtra Jeevan Pradhikaran,
MIDC, BMC, other Municipal
Corporation and local bodies etc. to the entire satisfaction of those bodies and a
certificate to such effect from an officer not below the rank of Executive Engineer
will have to be produced.
b) Authorization Letter from M/s. Kirloskar Brothers Ltd., Pune
c) All bidders are cautioned that the tender containing any deviation from contractual
terms & conditions, specifications or other requirements and conditional tenders will
be rejected as non-responsive.
d) The rates quoted should include provision for payment of incidental expenditures,
House keeping that may be incurred by the contractor as per any rule or statutory
regulation of State or Central Government.

a)
SUBMISSION OF TENDER (TWO ENVELOPE SYSTEM)
The tender shall be submitted in one Envelope called as main envelope of the
tender. The main envelope shall be duly super scribed as " Offer for " Providing day
to day operation and preventive maintenance of GIRNA PUMPING STATION ON
COMPREHENSIVE TYPE O & M BASIS " Full name and address of the Tenderer
shall be written at the bottom left hand corner of the envelope. This main envelope
shall contain two separate envelopes as Envelope No. 1 and Envelope No. 2 duly
sealed.
b)
ENVELOPE NO.l:- Envelope No.l Clearly marked as " ENVELOPE NO.l"
should contain the following documents duly attested.
i) D.D. within the specified period, of the equall amount of Cost of Tender Form
downloaded from website, favouring Commissioner,MMC, Malegaon.
ii) Xerox copy of Earnest Money deposit paid receipt in the form of prescribed in
detailed tender notice.
iii) Copy of Registaration certificate in Electrical- Mechanical category in appropriate
class with MJP or registered with or Any State Government Department in
appropriate class
iv) Professional tax & Works contract registaration certificate,VAT/ TIN/ PAN card/
certificate .
V) Details of the works of the similar type and magnitude carried out by the
contractor along with the certificate issued by the concerned authorities.

vi) In case of partnership firm a certified copy of power of attorney to sign the tender
documents and all other proceedings pertaining to the work.
v) Experience Certificate from an authority not below the rank of Executive Engineer
of having successfully completed work of operation & maintenance for Pumping
station / Filter Plant for which joint venture with experienced contractor shall be
acceptable.
vii) Valid electrical contractors license.
viii) The contractor should have Workmen Compensation Policy purchased from
Govt. agency, after getting work order within one month.
ix) Registration at ESIC & Provident Fund office shall be submitted by the contractor
after getting work order within one month.
x) Special features which the contractor feels worth mentioning in his offer, without
conditions so as not to deviate from specification stated herein.
No indication of financial offer of the tender is to be given directly or indirectly in the
envelope . Such an attempt will make the tender liable for outright rejection.

IMPORTANT :-
The Envelope No.1 shall contain the Technical Aspects of offer only.
Envelope No.1 shall not contain any reference to the price to be quoted or any mention
which has bearing determining the price
c) ENVELOPE No. 2 :
The second Envelope marked as “Envelope No.II” should
mentioned only the cost of offer of the Tender in Schedule “B” and nothing else. The
contractor should note this procedure carefully.
3) OPENING OF THE TENDER
For opening of Tender only Envelope No.I shall be opened. Envelope No.2 shall be
opened on the same date if possible ,as per procedure given below.
A) Envelope No.1 of all the Tenders will be first opened to verify its contents as per
requirements.
2) The forwarding letter of the Manufacturer /Authorised dealer shall then be read out.
B) ENVELOPE No. II :Envelope No.2 shall be opened in the office of the Commissioner, Malegaon
Municipal Corporation, Malegaon.
4 ) Conditional Tenders shall be out rightly rejected and Envelope No. II will not opened in
case of conditional tenders.
5) No subsequent variation will be allowed on the ground such as mistakes.
Misunderstanding etc.
6) The tender form shall be strictly in accordance with the condition laid down in these
documents. All corrections in the tender form shall be attested by the tenderer. The rate shall
be written in Rupees and paise only. The rate in words should be written in single line only,
not admitting any interpolation.

8) a) Earnest Money :Earnest Money of Rs. Rs. 15000/- (Rs. Fifteen Thousands only) shall be paid in form of
Cash or DD within Specified Period. The Earnest Money Deposit Receipt shall be
forfeited subject to......
i)
If the tenderer withdraws his offer before the validity of the tender
expires.
ii)
If the successful tenderer fails to deposit the Security Deposit in accordance
with the condition mentioned under Security Deposit Clause .
b) The Earnest Money of the unsuccessful Tenderers will be returned after the tender
have been finalized and on discharge of the E.M.D. Receipt.
9) VALIDITY OF THE TENDER
The Tender shall remain valid for 240 days from the date of submission of tenders.
10)ACCEPTANCE OF THE TENDER
I)
The Malegaon Municipal Corporation does not bind itself to accept the lowest
or any tender, nor will it assign any reason for rejection of any Tender or Part of the
Tender.
II) The Malegaon Municipal Corporation
reserves right or to amend the tender
documents up to the date notified.
IV)
In case of discrepancy in the words and figures the rates adopted by the
contractor for working out the total amount of the item shall be taken as correct. In
other cases the correct rates would be that which is lower.
V)
The Agreement will have to be executed by the successful tenderer on a Stamp
paper of Rs. 200/- .

11)SECURITY DEPOSIT
a)
1) 5% Retention Money and 5% Security Deposit will be deducted from each
Running Account Bill ( R.A.Bill)
.
b) 1) The retention Money will be refunded at the time of final bill.
2) The Security Deposit shall be refunded within 6 month on the expiry of the
contract or the satisfactory completion of contract or whichever is later.
ii) In case of breach of any terms, and conditions of contract the amount of Security
Deposit and Retention Money shall be liable to be forfeited in full or part by the
Corporation and the future losses if any will be recovered from the Contractor .The
decision of the Commissioner, Malegaon Municipal Corporation shall be final and
binding on the tenderer.

12) TERMS AND CONDITION
OF GRINA PUMPING STATION.
FOR
OPERATION
AND
MAINTENANE
1) Tenders are inviting from the contractors of Electrical and Mechanical Engineer &
contractors.
2) The period of Service providing shall be up 24 months from the date of work
order.
3) Tenderer shall furnish his full address including Telephone No. to enable the
Concerned staff .
4) In the event of Partnership Firm, Name and Address of all the Partners shall be
furnished.
5) Any increase or decrease on account of any case will not be paid extra.
6)Conditional Tender will not be considered.
7)Right to reject all or any tender without assigning the reason is reserved
with Corporation
8)Corporation reserves right to make parallel Rate Contract without assigning
any reason.
9) Escalation of Price Variation shall not be paid under this contract.
10) Each of the tender documents is required to be signed by the person having proper
authorization from the contractor or the persons submitting the tender in token of
his/their having acquainted himself/themselves with the special conditions, conditions
of contract etc. as laid down. Any tender with any of the documents not so signed
will be rejected.
11) The tender form must be filled in English and all the entries must be hand written
in ink. If any of the documents are missing or not signed, the tender shall be
considered invalid.
12) Malegaon Municipal Corporation is not concerned with any rise or fall in prices
of any materials. The rate quoted shall include all cost, allowances, tax etc. which
may be enacted from time to time by the State or Central Government under no
circumstances Malegaon Municipal Corporation shall not be responsible for
compensation or losses to the contractor due to any increase in cost of labour or
materials etc.

A BRIEF SCOPE OF CONTRACT
1) Daily operation and maintenance of Girna Head works and pumping station in one
shift only.
2) Routine and preventive maintenance of electrical and mechanical, Hydraulic
equipments and machineries erected in the premises of Girna Head work.

3) General duties( Government regulations, safety etc) records of results, maintenance
inventory, stocks penalty clause.
SCOPE IN DETAIL OF CONTRACT
1) Daily operation
Contractor should manage the flow of ¸raw water at existing pumping station by
proper communication with Deputy Engineer, Water Supply Department . During
maintenance of any work ,plant is to be run under loaded condition. Maximum
utilization of plant capacity is expected from contractor to meet the ideal results.
Scheduled daily operation should be for One Shift only. In case of emergency
contractor should manage emergency operation at any time for required period
other than regular operation.
2) Routine and preventive maintenance of elec/mech./hydra. machines.
Contractor should prepare schedule of daily maintenance and preventive
maintenance of equipments and machineries operated and run by him in the premises
Girna Head works.
The scope covers maintenance of pumping machinery , power pack, open
pump, pressure guage, submersible pump, centrifugal pump, Valves, flow meter,
switch gears, electrical fitting in building and in premises, electrical motors, cable
connections, glands, lugs etc. complete. what ever required other than this. Covering
supply, erection test and trial with labour expenses in which electricity bills shall be
paid by Malegaon Municipal Corporation. But sundry materials, lub oils, power oils ,
grease and other miscellaneous materials plus machining charges will be born by
contractor without any delay and hesitation.

He should maintain all electrical panels, switch gears, power cables, control
cables , switchyard, changeover switches etc.
Contractor should maintain all process equipments so as they won’t create
interference in Pumping process and will reduce the down time.
Contractor should operate and maintain the Pumps and pumping machinery
and he should take care of all allied equipments when required.
3) Major Repairs
For Major repairs / preventive maintenance overhauling of the pumping station
the essential parts will be made available by MMC. if any component need repairing
or reconditioning the same will also be made available by the Corporation. But the list
of such material and major works list will have to be made available by the contractor
in advance.
5) General duties
( Govt. regulation, securities safety records etc)
Contractor should observe and obey the prevailing rules and regulation and
amendments in them of all concerning Govt. Authorities like Electrical Inspector,
Director of Industrial safety and Health labour Commissioner, explosive licencing
agency, Maharashtra Pollution Control Board, Central pollution Control Board,
NRAP Delhi. Local Health organization Irrigation Department of GOM and other
related authorities.
Malegon Municipal Corporation will pay annual agency fees of the Govt.
agencies. But Penalties due to disobeyance of rules and norms laid by Govt.
authorities shall be recovered from Contractor.
Contractor should maintain all kind of securities in premises round the clock
,For that he should arrange required manpower to prevent theft and robberies. No un
known person shall not be allowed to enter the premise except granted. Municipal
staff official and elected representative of MMC body to be permitted direct without
permission. Educational study visits of Engineering students are permissible only on
written permission from Engineer / I/C of MMC. The contractor should not sublet the
worker appoint sub contractor on the said work.
6) Safety :
Contractor should observe all safety rules and regulation corresponding to
electricity, factory Act, Any accident causing over sighting the rule related case to
handle by the contractor at his own risks and costs. Subject to the provisions of
Factory Act contractor is required to safeguard his complete staff under insurance
policy drawn from Govt. of Maharashtra. The insurance is compulsory. The copy of
cover note should be submitted to MMC.
7) Records
Contractor should maintain the record of labour attendance, pumping records,
electrical and mechanical maintenance, log book, the stock of spares, inventories of
goods etc. He should submit the copy of required information on demand to MMC.
Over all obstacle free smooth functioning of the Head works meeting to the optimum
norms laid by various Govt. authorities utilizing the maximum capacity of plant in a
limited resources ( Energy and fuel) with highest efficiency is expected by MMC.

8) PENALTIES .RECOVERIES IN SCOPE OF WORK
1. Penalty for not providing registration certificate under PF/ESIC / Labour contract
act- Rs.5,000 /- if required as per act for each individual requirement.
2. Penalty on account of absentee of staff
Engineer------------------------------ Rs. 500 / per day.
Electrician----------------- ---------- Rs. 300 /- per day.
Pump operator-----------------------Rs. 250/- Per day.
Mazdoor / Helper/Sweeper---------Rs. 200/- per day.
Security guards-----------------------Rs. 200/- per day.
3) Bad results may be disciplinary action on contractor by Commissioner, MMC.
9) Co- Ordination
The co- ordination shall be maintain by the staff for smooth running of plant in
one shift. The co-ordination with M.S.E.D.C.L. regarding the power failure problem
and same to be conveyed to the Engineer in- charge any event happened to failure /
defect / difficulty experienced at the Head Work shall be immediately inform to the
Engineer in charge . The Plant I/C should take observation and in emergency the
repairing works shall be maintain round the clock i.e. in 3 shifts for smooth running
of plant.
The register in the form of log book shall be maintain for daily pumping hours
power factor, power failure, break down etc. And also for all routine/ preventive
maintenance carried out daily and inform the same to the Engineer in charge.
The facility of Wireless is already provided by MMC. However it is the
responsibility of contractor to keep one mobile Phone as well as send special
messenger in case of failure of above communication system.
10) Staff Requirement
Minimum staff to be employed by the contractor for the operation & routine
maintenance at Girna Head work.

The supervisor shall inform the total hours of Pumping done daily. power
failure or any other break down power factor daily to Engineer in charge and also
keep the above record in prescribed format. The contractor has to submit list of
employees to be appointed for the above work with their qualification at the time
of agreement without which work order will not be given.
The contractor shall see that above maintain employees should be employed
for whole shift operation for the period of contract and will have to operate, repair
and maintain the entire plant & machinery and to keep in working and running
condition. In case of absentee / non attendance of any employee it is the responsibility
of contractor to employ additional / standby workmen or making suitable arrangement
by providing OT or such other means. In any case the above posts shall not be kept
vacant.
GENERAL CONDITIONS
1) Daily energy meter reading with P.F. should be taken in G-7 form and P.F.
should be maintain minimum 0.99 preferably unit, failing to this loose of P.F.
incentive to be received M.S.E.D.C.L. will be recovered from the contractor.
2) Wages Act. if there is any increase in minimum wages living allowance;
payment should be done as per charges as per min wages Act.
3) It will be the exclusive responsibility of successful bidder to see that if any
litigation arises on account of labour claim etc. same shall be dealt to and
settled by the contractor without any financial implication to Malegaon
Municipal Corporation. Same shall be solely born by the contractor only. The
contractor should abide all provision of labour laws. In any case dispute arise
the dispute shall be referred to the Arbitrator Commissioner of Malegaon
Municipal Corporation and Decision of Arbitrator shall be binding on the
parties.
4) The contractor shall open / dismantle and reassemble the machinery for minor
repairs or any preventive maintenance or for checking, as per instruction of
Engineer in charge of MMC, free of cost except dismantling and refitting the
whole pump assembly.
5) The contractor shall carry out the Duties and minor Maintenance Works in the
manner . Any damage caused to the station equipment on account of
negligence and willful act, the contractor shall be directly responsible to
compensate the Corporation for such damages/losses.
6) The contractor shall insure that all the personnel engaged by him should be
capable of handling and rectifying normal trouble shooting QUICKLY and
EFICIENTLY so as to keep the duration of interruption at the barest minimum
levels.
7) Uniform, Torch, Gun and other accessories if required for job should be
arrange by the contractor.
8) No unfair labour practice should be insisted nor minimum wages be denied for
the personnel.
9) In case of the department has any objection of posting of a certain person for
duties at its premises contractor will not post such person.
10) The contractor should abide by the provision of law.

11) The contractor will himself be responsible for all the statutory obligations of
labour laws. The MMC will not be responsible for any violation of labour laws
by the contractor. The contractor shall maintain a regarding statutory
obligations of labour laws and produce the same to this office on demand.
12) The contractor shall sanction no leave of any kind to the contractor personnel.
The contractor shall be liable to make substitute arrangement in case of the
absence of any contractor personnel. Similarly the contractor shall have to
make arrangement of substitute in case of weekly off. No extra payment shall
be payable on this account. No short leave or meal leave shall be permitted by
contractor personnel, unless the contractor provide suitable substitute without
any extra payment.
13) The MMC shall not be liable to provide any residential accommodation or
transport to the contractor personnel. No. cooking and lodging shall be allowed
inside / outside of the campus of the exchange / offices.
14) The contractor shall prepare a detailed duty and maintenance schedule and
finalize the same with the prior approval of the Engineer in charge as per the
requirement.
15) Any other work entrusted in the station either in restoration of supply or in
maintaining continuity of supply should be carried out.
16) Contractor should ensure that no illegal activities are carried out in the station
premises.
REPUDIATION OF THE CONTRACT
In case of non- performance, in any form of the condition of the agreement, the
Commissioner, Malegaon Municipal Corporation has power to cancel the contract
pertaining to the Contractor.
