Roll Back of M/s GTL Distribution Franchisee in Aurangabad - History created
M/s GTL Urja was appointed to look after the
Electricity Distribution Business in May-2011 as
Distribution Franchisee in the Aurangabad town. Though
Distribution Franchisee was envisaged for Rural area in
Electricity Act 2003, then Maharashtra Government &
Maharashtra State Electricity Distribution Company clearly
violated the provision of Electricity Act by handing over
Aurangabad Urban area to Distribution Franchisee. Since the
beginning M/s GTL Urja failed miserably on all fronts like
services, reduction of losses, theft of electricity, technical
expertise and payment of electricity purchased from
MSEDCL. In initial days of its working, Aurangabad city
and industrial area was forced to remain in dark due to non
availability of maintenance material and dearth of skilled
manpower to overcome fault finding and restoration of
supply. For few initial months Daily News papers and
electronic media was full of bad mouth for M/s GTL on all
above aspects. The real crisis between MSEDCL
(Maharashtra State Electricity Distribution Company) and
M/s GTL was started since beginning with non payment of
electricity purchase payment. Every month there was an
outstanding kept by M/s GTL of about Rs.200 Crores.
Beyond that even M/s GTL used its own rules and
regulations like production of original documentation while
applying for new connection. At times they even demanded
for NOC from Wife when connection was in the name of
Husband.
At first M/s GTL has denied applicability of Right to
Information Act and Consumer Grievance Redressel
Forums. These are provisions for transparency and
accountability of any Government company towards citizen.
By denying its acceptance M/s GTL was in no mood to run
business with fair practices. After strong follow up by
consumer representative and MSEDCL and Unions they
have agreed to abide by these regulations but half heartedly
as thereafter also delay in processing application under
above two heads was enormous.
Local Body Tax imposed on Aurangabad citizen
towards is an example of M/s GTL attitude towards handling
public authorities in a adamant and non cooperative way.
In the same fashion any consumer was facing
hardship for any kind of work like New connection/Billing
complaint/service complaint etc. The height was created by
M/s GTL by forwarding each and every billing complaint to
their headquarter at Pune 300 Km away from Aurangabad.
Through this consumer was harassed with abnormal delay in
complaint resolution and total darkness about complaint
status in the meantime between Pune andAurangabad.
Various Industrial consumers who had skilled
manpower and acumen also faced the hardship from M/s
GTL. Many legal matters arose between industrial and M/s
GTL management on various amicable issues.
Beyond this M/s GTL trend was moving towards
centralized working. May field offices were closed by them
by amalgamation and abolition. In the era of
decentralization, they moved in opposite direction by having
only two centers for consumer services of any across whole
Aurangabad city. Consumer was left at the hands of few
unskilled labours working at these two centers for their work
and he was required to travel at least 10 KM from any corner
of Aurangabad to these only operational centers costing time
and money.
M/s GTL was very dearth of skilled manpower as well
as technology. Bare minimum infrastructure was created by
them in their total tenure of if 3 ½ year. Mean while
MSEDCL throughout Maharashtra created huge
infrastructure by way of heavy investment where as
Aurangabad town was deprived of these benefits. Even in
Distribution Franchisee Agreement between M/s GTL and
MSEDCL. Rs. 15 Crore per year was reserved as subsidy for
infrastructure creation and loss reduction. M/s GTL has
failed to avail to this subsidy in the farm of grant.
Dark side of M/s GTL operation was that many
incidences which costed human life by way of accidents was
hidden from media and public at large. Many employees fatal
accident was not brought to the surface. Most of the accident
were because of inadequate knowledge about system
operation, ingligence of safely and improper monitoring by
higher offices.
In view of above all the real move forward was taken by
MSEDCL after 3 years by serving preliminary notice of
termination in the month of September 2014. Based on
preliminary notice served on M/s GTL on dt. 17 Sept 2013,
Subordinate Engineers Association led the batton by writing
an letter to Managing Director of MSEDCL cum Energy
Secretary of Maharashtra State Government about
termination of Aurangabad Franchisee and extending all out
support to roll back operation to Mahavitaran.
The default amount created by M/s GTL was increasing
as the days were passing MSEDCL management was of
opinion that due to manpower constraint it may not be
possible to roll back M/s GTL operation to MSEDCL. In the
same way the picture was presented to Maharashtra Govt. by
management. In this unstable scenario any other licensee
was also not ready to take charge of Aurangabad Electricity
Distribution operation.
Based on above, the real initiative was taken at
Aurangabad by Subordinate Engineers Association with
formation of Sanyukt Kruti Samitte (Alliance of all Unions
in MSEDCL) to eradicate M/s GTL Distribution Franchisee.
Great mobilization was done through media to get the public
support which was already against the GTL business.
Alliance of unions under flagship of Subordinate
Engineers Association started creating heavy atmosphere by
Gate meetings processions, press conferences and with
appeal to various MLAs, MPs, Industrial Associations and
NGOs at large. Real hype was created when Daily News
papers speculated about M/s GTLs demoralization by moves
taken by Sanyukt Kruti Samittee and it can vacate its
operation any time. News dailies were of the opinion that any

other Distribution licensee like TATA/ Torrent
Power/reliance may get the Distribution Franchisee
operation inAurangabad.
Meanwhile Alliance of all Unions (Sanyukt Kruti
Samittee) based on gathered data wrote a letter to Chief
Minister of Maharashtra Government to cancel
distribution Franchisee agreement with M/s GTL and
assured necessary manpower assistance to take over
operation by MSEDCL. The letter was circulated to
MSEB holding company CMD, Energy Secretary,
Industrial Associations, Media and public at large about
smooth handing over operation in case M/s GTL operation
is terminated without trouble to consumers.
The steps taken by Alliance of Unions created strong
belief amongst its employees and boosted their moral for
conquering back lost Electricity Distribution business.
The overall impact was heavy that final termination
notice was issued to M/s GTL by MSEDCL management
and declared possession of Aurangabad business back on
17th Nov. 2014 @ 00.00 hrs. Weired M/s GTL even could
not sustain this impact has failed miserably before actual
date of handing over. All the employees of M/s GTL
declared non cooperation to its management and it was
forced to wind up its operation two days before i.e. on 15th
Nov 2014. MSEDCL supported by Alliance of all Unions
taken overcharge of Aurangabad Distribution business on
15th Nov 2014in emergency situation as early vacation by
M/s GTL without intimation created Law & order
problem. Subordinate Engineers Association has
anticipated this well in advance and made MSEDCL
management aware about same on 12th Nov 2014 that
unexpected exit of M/s GTL may take place before actual
departure date.
Engineers and technical staff taken over Aurangabad
Distribution business on 15th Nov 2014 and supply to all
installation which went into dark due to unexpected early
exit of M/s GTL was restored in record time.
The overall exit of M/s GTL has reminded people
winding up the electricity distribution on business in
Orissa by a private firm when it was hit badly by Cyclone.
Here even though there was no natural calamity, M/s GTL
moved out of business in a very unfaithful way and created
loss of crores of rupees. Till the date any legal/police/penal
action is not initiated against M/s GTL rather it was given
safe escape path. This is an example of leaving fate of
electricity consumers at the hand of private organization
who does not carry any accountability and social
responsibility towards public at large.

Bill Summary
The Electricity (Amendment) Bill, 2014
The Electricity (Amendment) Bill, 2014 was
introduced in Lok Sabha on December 19, 2014 by
the Minister of Power, Mr. Piyush Goyal.
The Bill seeks to amend the Electricity Act,
2003. Primarily, it seeks to segregate the distribution
network from the electricity supplybusiness. It also
seeks to introduce multiple supply licensees in the
market.
Segregation of distribution and supply: Under
the Act,the distribution licensee both distributes and
supplieselectricity to the consumers. The Bill creates
a supply licensee who would be authorised to supply
electricity toconsumers. The distribution licensee
will distributeelectricity and enable the supply of
electricity. The Bill also provides for the transfer of
the supply license from the distribution licensee to
the supply licensee.
Distribution: Under the Act, the distribution
licensee is required to supply electricity at the
consumer’s premises within one month of receiving
a supply request. Under the Bill, a distribution
licensee shall provide a connection to enable the
supply of electricity within 15 days of receiving a
request application. The Bill creates an Electricity
Distribution Code which shall be specified by the
State Regulatory Commission. The code will provide
for the recovery of electricity charges, intervals for
electricity billing, disconnection of services on
nonpayment of bills, etc.
Supply: The Central or State Regulatory
Commission may grant multiple supply licenses
within the same area of supply. At least one of the
supply licensees should be a government company or
a government controlled company. The Bill enables
consumers to choose to buy electricity from several
supply licensees. Consumers can also switch
suppliers by giving a notice. The Bill amends the
Electricity Supply Code to provide for only supply
related matters and removes from it the matters
related to distribution.
Tariff: With respect to distribution, the Central
or State Regulatory Commission shall determine the
tariff for distribution of electricity. With respect to
supply, the State Regulatory Commission shall
determine the tariff. Prices for the supply of
electricity shall be market determined subject to a
ceiling price that shall be announced by the
respective Commissions.
Renewable energy: The Act does not define
renewable sources of energy. The Bill defines
renewable energy sources to include hydro, wind,
solar, bio-mass, cogeneration from these sources,
geothermal and other sources as notified by the
central government. The Act provides for a National
Electricity Policy. The Billprovides for an additional
National Renewable Energy policy. The Bill seeks to
promote generation of renewable energy through tax
rebates, generation linked incentives, etc.
Penalties: The Bill increases the penalties for
licensees for failure to comply with directions of the
Central or State Regulatory commission. Under the
Act, penaltiesfor all companies are up to Rs 15 lakh at
the central level and up to Rs 5 lakh at the state level.
The Bill increases these to Rs 10 crore and Rs 1 crore
respectively. For companies generating renewable
energy, the penalty will be up to Rs 1 crore and Rs 10
lakh at the central and state levels respectively.
Conditions of service of members: The Bill
reduces the term of office for the chairperson or other
members of the Central or State Regulatory
Commission from fiveyears to three years. The Bill
also allows for reappointment of the chairperson and
members for one more term in the same capacity in
which they had earlier held office.
Smart Grid: The Bill defines a Smart Grid as an
electricity network that uses information
andcommunication technology to generate, transmit
and distribute electricity efficiently. It seeks to
promote provision of electricity through Smart Grid.
The Bill also provides for the installation of smart
meters for proper accounting and measurement of
the consumption and metering of electricity

Power Sector Scenario - From the desk of Vice President, SEA
Our union, Subordinate Engineers Association
(SEA) is having glorious history, as it is a backbone
of the state power utility. Since the formation of
Maharashtra state, the development of power sector
in state was done by MSEB and subordinate
engineers played vital role during the process. The
state was exporting power to nearby states till 1998.
Thereafter the changes in policy have lead to worsen
the power sector scenario. The PPA’s which were
signed before 10-15 years couldn’t come in to
existence. The growing demand of power further lead
to power cuts & load shading in major part of the
state. The development of the state snagged due to
non-availability of electricity. The power availability
on sustainable basis with optimal cost will be the goal
in front of SEA members. Our union SEA will extend
all efforts & capacities to improve the power scenario
of the state. The constraints & improvement
measures are cited below.
The basic primary resources for Electrical power
generation are Fuel (Coal+Oil), Water, Human
resources. If all these three basic resources are fullfledged, the power sector will improve drastically.
The major constraints are observed amongst these
resources which are underneath below.
Coal: The basic constituent of thermal i.e base
load power generation is depending upon coal as a
basic fuel. The 80 % cost of the generated unit is of
coal & remnant 20 % cost is of other resources like
fuel oil, Auxiliary Consumption, manpower and
R&M expenses. The major thermal power plants in
our state are situated near coal mines. Some other TP
units are situated away from coal mines.
The MSPGCL 200 MW & above capacity units
are commissioned in earlier 80’s. These LMZ &
KWU machines are designed for CV of ranging from
4000 to 5000 kcal/ kg. Initially the coal with CV
ranging near designed value was supplied by the Coal
Inida, but in last decade the quality of coal has been
drastically deteriorated & it is supplied in range of
2500 to 3300 kcal/kg. The effect of this low grade
coal is affecting the performance of the power plants.
The PLF of the MSPGCL is dropped down
marginally. This has directly made effect on the cost
of generation & load shading in the state. The
development of the state was hampered & everyone
is thinking for better solution.
The coal linkage policy is governed by the
Ministry of Coal. Since the inclusion of private
players in power generation sector, the situation
further deteriorated. There was an acute negligence
towards state utilities was seen in last few years. The
imbalanced level playing fields for private & public
utilities were observed during last few years.
Therefore to improve the health of State power utility
the coal quantity & quality of coal shall be monitored
& efforts shall be taken at all levels for improving the
situation. The coal shortage outages of MSPGCL
units were increased in last few years. The non
operation of available thermal units is causing lot of
secondary losses to the society. The economic growth
gets restricted. Therefore utmost efforts shall be
taken at all levels in state power utility for its survival.
Water: The other basic constituent for thermal
power generation is water. The power plants are
situated near some major rivers or reservoirs in the
state. The Parli TPS & Chandraput Super Thermal
power stations were facing the water crises. The
major problem is for Parli TPS, as this is situated in
draught prone Marathwada region. These units have
stopped their operations due to water shortage. There
is need of proper survey from Irrigation Department
to resolve the problem. The water conservation
programme is to be implemented in power station by
making awareness amongst all. The Municipal
Corporations let out STP water usage for power
plants, the feasibility of shall also be reviewed /
checked.
Project Planning: In erstwhile MSEB
peculiarly in generation wing the power projects
were erected & commissioned departmentally
through project wing. It has been proved that these
projects were completed in due time or before
scheduled dates. In recent years the projects works
are carried out through EPC basis. These projects are
getting delayed & this directly increased the cost &
burden on exchequer. The review of this policy can be
taken up & a sample project can be taken up
departmentally.
Repair & Maintenance: The power plants are
equipped with dynamic machines, wear & tear rate is
always higher, therefore repair & maintenance of
these systems & subsystems is unavoidable, to
optimize the cost of generation utmost care is to be
taken for betterment of the units. R&M is continual
process in power plants, to carry out these works
properly, a well streamlined process is needful. The
delay in procurement of material can cause the loss of
generation. This may affect the men & machine in
power plants. The review of this policy is needful.

Human Resources: State power utility is
having one of the best technocratic backgrounds. The
remarkable achievements in all fields of power sector
are at the credit of the man power of the power utility.
The success of the organization is directly depending
up on the manpower working at all levels. SEA is the
union, which represents the engineers in the state
power utility. The engineers are working at middle
level of the organization and works like backbone of
the body.
In last few years, it is observed that the transfer
policy is adopted as per the other Govt. departments.
In general the yardsticks of other sector transfer
policy may affect the performance of the power
plants. The major thermal power units of MSPGCL
are a old age and completed the life of 20-25 years.
Therefore these units are having lot of operational
problems & having some perticular characteristics,
which can be resolved by experienced man power. In
power plant, the experienced manpower is required
to minimize the down time of the machines. To
become expertise / proficient in power plant
operations is a time consuming process. Considering
this, a review of this policy is to be taken on
optimistic way. The transfers on random basis can
lead to increase the cost of generation. It has been
also observed that, in past experiences of transfers,
the organization has faced considerable losses which
are not evaluated properly. Therefore the complete
review of the policy can be taken up bilaterally with
SEAbefore making transfers this year.
Since last few years the engineers curtailment is
seen in various sectors of O&M sections. The age old
units are equipped with less automation; therefore
higher manpower will be required. Also new section
like MPD, FQAD, POG are introduced, this is
appreciable step for smooth operations of power
plants, but the sanction of the posts for these section
shall be taken up without making any delay.
While concluding the views, I urge to the
members, the survival of the organization is the
survival of ours, therefore everyone shall extend his
best possible efforts for the betterment of the
organization.
