Fiber Optic Cable Installation 2016 project
DESCRIPTION/BACKGROUND: The City has completed installation fiber optic conduit and
vaults for a fiber optic backbone running from the Lake Water Treatment Plant to Division Ave.
The City has purchased fiber optic cable for the backbone. This contract is to install the fiber cable
and make basic connections so that cable can be used to provide internet access to City Hall and
ready the cables for further development.
The plan is to install two 144 fiber cables throughout our conduit system. One of these 144f cables
will serve government entities (including the City, Bonner County and possibly ITD). The second
144f cable will serve economic development purposes.
Some additional expenses will be incurred after this project is completed before City Hall is “lit up”
with internet access through the fiber optic cable. Brent Stevens is working with Bonner County to
share those expenses. The City portion of this cost is expected to be less than $20,000.

TITLE:
BID ACCEPTANCE AND AWARD OF CONTRACT TO NORTH COUNTY
ELECTRIC, LLC, FOR FIBER OPTIC CABLE INSTALLATION
WHEREAS: Via an advertisement in the Bonner County Daily Bee on January 29 and
February 5, 2016, the City solicited bids for the installation of
approximately 37,000 linear feet of fiber optic cable;
WHEREAS: The bids that were received were opened and read aloud shortly after
2:00 p.m. on February 23, 2016, the deadline for submission of bids;
WHEREAS: The lowest bid, in the amount of $115,547, was submitted by Sandpoint
firm North County Electric, LLC, a qualified and responsive bidder; and
WHEREAS: It is the recommendation of the Public Works Director that the City accept
the bid from and award the contract to North County Electric, LLC.
NOW, THEREFORE, BE IT RESOLVED THAT: The Mayor is hereby authorized, on
behalf of the City, to execute the Fiber Optic Cable Installation Contract with
North County Electric, LLC, a copy of which is attached hereto and made a
part hereof as if fully incorporated herein.

NOTICE IS HEREBY GMN that the CITY OF SANDPOINT will accept bids until 2:00 PM
on February 23d, 2016 for:
City of Sandpoint, Fiber Optic Cable Installation 2016. The project includes installation of
approx.37,000 LF of owner-provided fiber optic coble to include providing labor,
equipment and materials for splicing, testing, documentation, closures, equipment, patch
panels, rnd accessories rs required to provlde a complete and functioning project.
Bids shall be submitted in a sealed envelope, and shall be clearly labeled "SEALED BID - Fiber
Optic Cable lnstallation 2016". The bidder's name, address, and acknowledgement ofall
addendums issued shall be printed in the upper left comer ofthe envelope. Bids shall be
submitted to Sandpoint City Clerk; I 123 Lake Street, Sandpoint, ID 83864, by the time and date
set forth above and shall be opened and publicly read aloud at 2:05 p.m. on said date in the
Upstairs Conferance Room ofthe City of Sandpoint.

Contractors and Subcontractors for this project shall be licensed in the State ofldaho by the
Idaho Public Works Contractor's State License Board in the Class and Type specified for the
value and scope ofwork to be done in accordance with the provisions of Title 54, Chapter 19,
Idaho Code as amended- The Contractor and Subcontractors shall possess a license in the Class
and Type required at the time they submit a bid for said project. Performance and Payment
bonding is required. This is a locally funded project subject to certain non-discrimination, storm
water quality, and other requirements. Please read the attached documentation and contact the
owner ifyou are uncertain of what these requirements are and how they apply to you.
A Pre-Bid Meeting will be held at Sandpoint City Hall, upstairs conference room on February

The OWNER will pay to the CONTRACTOR based on the unit prices for measurement of
actual work completed within 60 days of completion and acceptance ofwork done by this
contract.

This Agreement shall be binding upon all parties hereto and their respective heirs, executors,
administrators, successors, and assigns. All exhibits are hereby incorporated by reference as
if fully set forth herein.

If said work is not completed within the time specified, the CONTRACTOR agrees to pay to

GENERAL CONDITIONS
Prior to issuing a Notice to Proceed, the City of Sandpoint will require the Conkactor to provide
a Performance Bond and a Material Bond naming the City of Sandpoint as the beneficiary.
The following standards are hereby incorporated into the contr'act documents. Copies of these
documents are available for purchase from the respective State Agencies. Copies are available
for review at the Sandpoint Public Works Departmsnt.

CHANGES AND EXTRA WORK
The Engineer reserves the right to make, at any time during the work, such changes in quantities
and such alterations in the work as are necessary to satisfactorily complete the project. Such
changes in quantities and alterations shall not invalidate the contract nor release the surety, and
the Contractor agrees to perform the work as altered.
Ifthe alterations or changes in quantities significantly change ths character ofthe work under the
contract, whether or not changed by any such different quantities or alterations, an adjustmen!
excluding loss ofanticipated profits, will be made to the contract. The basis for the adjustment
shall be agreed upon prior to the performance of the work. If a basis cannot be agreed upon, then
an adjustment will be made either for or against the Contractor in such amount as the Engineer
may determine to be fair and equitable
Ifthe alteration or changes in quantities do not sigrrificantly change the character of the work to
be performed under the contract, the altered work will be paid for as provided elsewhere in the
contract.
The term "significant changes" shall be construed to apply only to the following circumstances:
a. When the character of the work as altered differs materially in kind or nature from that
involved or included in the original proposed construction; or
b. When a major itern ofwork, as defined elsewhere in the contract, is increased in excess of 125
percent or decreased below 75 percant ofthe original contract quantity. Any allowance for an
increase in quantity shall apply only to that portion in excess of 125 percent oforiginal contract
iton quantity, or in case ofa decrease below 75 percent, to the actual amount of work performed.
DIFFERING SITE CONDITIONS
During the progress ofthe work, if subsurface or latent physical conditions are encountered at
the site diffedng materially from those indicated in the contract or ifunknown physical
conditions ofan unusual nature, differing materially from those ordinarily encountered and
generally recogrized as inherent in the work provided for in the contract, are encountered at the
site, the party discovering such conditions shall promptly notify the other party in writing of the
specific differing conditions befor€ they are disturbed and before the affected work is performed.
Upon written notification, the Engineo will investigate the conditions, and ifit is determined
that the conditions materially differ and cause an increase or decrease in the cost or time required
for the performance ofany work under the contract, an adjustment, excluding loss ofanticipated
profits, will be made and the contract modified in writing accordingly. The Engineer will notify
the Contractor ofthe determination whether or not an adjustment of the contract is warranted.
No contract adjustment which results in a benefit to the Contractor will be allowed unless the
Conkactor has provided the required written notice.

AUTHORITY OF THE ENGINEER AND SUSPENSION OF WORK
Ifthe performance of all or any portion ofthe work is suspended or delayed by the Engineer for
an unreasonable period of time (not originally anticipated, customary, or inherent to the
construction industry) and the Contractor believes that additional compensation and/or contract
time is due as a result ofsuch suspension or delay, the Contractor shall submit to the Engineer in
writing a request for adjustrnent within seven calendar days ofreceipt of the notice to resume
work. The request shall set forth the reasons and support for such adjustment.
Upon receipt, the Engineer will evaluate the Contractor's request. If the Engineer agrees that the
cost and,/or time required for the performance ofthe contract has increased as a result of such
suspension and the suspension was caused by conditions beyond the control of and not the fault
ofthe Contractor, its suppliers, or subcontractors at any approved tier, and not caused by
weather, the Engineer will make adjustment as provided (excluding profit) and modiff the
contract in writing accordingly. The Engineer will notifr the Contractor ofthe dstermination
\Mhether or not an adjustment of the contract is warranted.
No contract adjustment will be allowed unless the Contractor has submitted the request for
adjustment within the time prescribed.
No contract adjustrnent will be allowed under this clause to the extent that performance would
have been suspended or delayed by any other cause, or for which an adjustrnent is provided for
or excluded under any other term or condition ofthis contract.
MONTHLY PAYMENTS
The Contractor shall pay each subcontractor for satisfactory performance of its contract no later
than 20 calendar days from receipt of each payment the Contractor receives. The Contractor
shall return retainage to each Subcontractor within 20 calendar days after the Subcontractor's
work is satisfactorily completed.
The Contractor shall certifr with each estimate payment that payment to Subcontractors has been
made within the prescribed time frames. The certification will be made on ITD forms and
retumed within 20 calendar days of receiving the estimate payment.
These requirements shall also apply to first or lower tier subcontractors.
ACCEPTA NCE A]\ID FINAL PAYMENT
The Contractor shall certify the actual total payment to Subcontractors or suppliers. The
certification shall be made on ITD forms, and shall be retumed within 30 calendar days of
receiving the final payment. These requirernents shall also apply to first or lower tier
subcontractors or suppliers.

The contractor/consultant warrants and takes the steps to verify that it does not knowingly hire or
engage persons not authorized to work in the United States; and that any misrepresentation in
this regard or any ernployment ofperson not authorized to work in the United States constitutes a
material breach and shall be cause for the imposition of monetary penalties up to five pereent
(5%) of the contract price, per violation, andlor termination of its contract.

under any ofthe laws of this state the contractoq or person in charge thereof must employ
ninety-five percent (95%) bona fide Idaho residents as employees on any such contracts except
where under such contracts fifty (50) or less persons are employed the contractor may employ
ten percent (10%) nonresidents, provided however, in all cases such ernployers must give
preference to the ernployment ofbona fide Idaho residants in the preferotce of such work;
provided, that in work involving the expanditure of federal aid funds this act shall not be
enforced in such a manner as to conflict with or be contrary to the federal statutes prescribing a
labor preference to honorably discharged soldiers, sailors, and marines, prohibiting as unlawful
any other preferences or discrimination among the citizens of the United States.
