BUS CAMERA AND DVR SYSTEM
The County of Lackawanna Transit System (COLTS), the public transportation provider in Scranton and
Lackawanna County, in accordance with directives from the U. S. Department of Transportation and the
Pennsylvania Department of Transportation, is seeking bid quotations for the purchase of new camera
and DVR systems for its buses and paratransit vans.
All bids and related documents will be subject to the financial assistance contract between the Federal
Transit Administration (FTA), the Pennsylvania Department of Transportation (PennDOT) and COLTS.
COLTS will not discriminate against any bidder because of race, color, religion, sex, or national origin.
Any firm or person who enters into a contract with COLTS must agree to comply with any and all FTA
and Commonwealth of PA laws regarding the prohibition of discrimination. All bidders, by submitting a
bid, shall accept the affirmative duty to ascertain and comply with such laws.
Copies of the IFB package can be requested by e-mail at dhein@coltsbus.com or obtained from our
website, www.coltsbus.com. All questions regarding the IFB are to be directed to Douglas A. Hein,
Director of Grants and Finance.
One (1) original and two (2) copies of the bid must be submitted in the format outlined and marked
“Camera/DVR System”. Completed bid packages are due at the offices of COLTS no later than noon
(12:00 P.M. EST) on May 10, 2016. Bids should be addressed to:

Bids received later than noon (12:00 P.M. EST) on May 10, 2016 shall be rejected. The County of
Lackawanna Transit System reserves the right to reject any and all bids. This IFB does not commit the
County of Lackawanna Transit System to award a contract, to pay any cost incurred in the preparation of
a bid, or to procure on contract for services.

1.1 Submission Instructions
COLTS desires to contract with a qualified bidder for the purchase of bus camera and DVR systems.
COLTS reserves the right to reject any and all bids received as a result of this request, or to negotiate
separately with competing bidders.
1.1.1
Quantity
The bidder shall submit one (1) original and two (2) copies of its bid.
1.1.2
Due Date
In order to be considered, bids must be received at the offices of COLTS by noon (12:00 P.M. EST) on
Tuesday, May 10, 2016. Failure of the U.S. Postal Service or other delivery service to deliver bid
packages on time shall result in the bid not being opened or considered. Bids should be clearly marked
“Bike Racks” and delivered to:

1.1.3
Proprietary Information
Any information contained in the bid that the bidder considers proprietary must be clearly identified as
such. COLTS will respect requests for non-disclosure of proprietary information to the extent that
information so restricted conforms to the Freedom of Information Act and the Pennsylvania Sunshine
Laws.
1.1.4
Forms
Appendices A, B & C of this solicitation contain certain forms that are mandatory in the bid process.
These forms must be executed and submitted in their exact format in order for the bid to be considered
responsive. Precise, unedited computer reproductions to expedite the bid preparation process are
acceptable.

1.2 Questions Concerning the Project
1.2.1
Verbal and Written Questions
Prospective bidders are encouraged to submit substantive questions, comments, and concerns in
writing. Written question received no later than 3:00 P.M. EST on May 2, 2016 will be answered in
writing and distributed via addendum to those listed on the IFB distribution list. Questions should be
addressed to Douglas A. Hein of COLTS at 800 North South Road, Scranton, PA 18504. E-mailed
questions (to dhein@coltsbus.com) will be considered as written; however, no telephone solicitations
will be honored.
1.2.2
Approved Equals
Wherever brand, manufacturer, or product names are used they are included only for the purpose of
establishing a description of minimum quality of the requested item unless otherwise specified. This
inclusion is not to be considered as advocating or prescribing the use of any particular brand or item or
product. However, approved equals or better will be accepted only when previously approved by the
County of Lackawanna Transit System.
All requests for approved equals shall be received in writing. Changes to the specifications will be made
by addendum. Bidders may discuss the specification with the County of Lackawanna Transit System;
however, requests for changes shall be written and documented.
When an approved equal is requested, the bidder shall demonstrate the quality of its product to the
County of Lackawanna Transit System, and shall furnish sufficient technical data, test results, etc. to
enable the County of Lackawanna Transit System to determine whether the bidder’s product is or is not
equal to specifications.
1.3 Bid Format
1.3.1
Minimum Requirements – Technical Bid Format
At a minimum, each technical bid should contain the following elements organized in the following
fashion and in the order listed.

Cover: IFB Project title and bidder’s name

Letter of Transmittal: This letter must include the name, address, and phone number of the
bidder’s contact person and that of the firm. The period of time for which the offer will be
honored, which should be at least 90 days from the date of the bid. One original must be signed
by an authorized officer of the bidder.

Official bid form – Appendix A - The County of Lackawanna Transit System will not be
responsible for expenses incurred in preparing and submitting the bid. Such costs should not be
included in the bid.
The information requested is required to support the reasonableness of the proposed cost and
is for the review of the County of Lackawanna Transit System only. It will not be shared with
other bidders or released to the general public except in the form of total contract value. The
price must be binding for the life of the contract if a Notice to Proceed is issued within ninety
(90) days of submission. The Grand Total must be binding for this period and may become the
“Not to Exceed” Amount issued with the Notice to Proceed.

Required Certification and Assurances – Appendix B - The bidder must indicate its compliance
with certain Federal and state executive orders, laws, statues, and regulations to be considered
for award.

References Form – Appendix C – The bidder must include five (5) organizations that represent
work that is similar to this procurement. Include the company name, address, contact person,
telephone number, contract amount, and length of contract.
1.3.2

Submission of Supplemental Material
Bidders will be permitted to submit any additional information they consider relevant to the
project scope of work and the project at hand. Such supplemental materials, if submitted,
should be in addition to the bid, not contained in the bid itself. Only one copy of any
supplemental material should be submitted.
1.4 Bid Evaluation
1.4.1
Bid Evaluation

It is the intent of the County of Lackawanna Transit System to award a contract to the
responsive and responsible bidder whose bid conforming to this IFB, is the lowest in price.
Factors such as discounts, transportation costs and life cycle costs will be considered in
determining which bid is lowest in price.

A responsible bidder possess the ability to perform successfully under the terms and conditions
of this procurement

The low bidder will be required to demonstrate its ability to perform services contained in the
solicitation in a timely manner and to the complete satisfaction of the County of Lackawanna
Transit System. Doubt as to technical ability, productive capability, and financial strength which
cannot be resolved affirmatively may result in a determination of non-responsibility by the
County of Lackawanna Transit System.

If the low bidder is eliminated, then the second lowest bidder will be required to demonstrate
its ability to perform services as described herein. This process will continue to the next lowest
bidder until a bidder successfully meets the specifications requirements.

1.4.2


The County of Lackawanna Transit System reserves the right to investigate the qualifications of
all bidders under consideration to confirm any part of the information furnished by a proposer,
or to require other evidence of managerial, financial or other capabilities which are considered
necessary for the successful performance or the contract.
Single or unbalanced bids
In the event a single bid is received, the County of Lackawanna Transit System may cancel the
solicitation, change the requirements to allow for more bids, resolicit bids, or evaluate the bid
based on the established criteria.
The County of Lackawanna Transit System may determine that a bid is non-responsive if the
prices proposed are materially unbalanced. A bid is materially unbalanced when it is based on
process significantly less than cost or prices significantly overstated relative to cost.
1.5 Disadvantaged Business Enterprise
If not addressed under subcontractors, please identify any participation in the project by a
disadvantaged business enterprise. A listing of all certified DBE firms in the Commonwealth of
Pennsylvania can be viewed at www.paucp.com.
The County of Lackawanna Transit System (COLTS) has established a Disadvantaged Business Enterprise
(DBE) program in accordance with regulations of the U.S. Department of Transportation (DOT), 49 CFR
Part 26. COLTS has received Federal financial assistance from the Department of Transportation, and as
a condition of receiving this assistance, COLTS has signed an assurance that it will comply with 49 CFR
Part 26.
It is the policy of COLTS to ensure that DBEs as defined in part 26, have an equal opportunity to receive
and participate in DOT-assisted contracts. It is also our policy:
1. To ensure nondiscrimination in the award and administration of DOT-assisted contracts;
2. To create a level playing field on which DBEs can compete fairly for DOT-assisted contracts;
3. To ensure that the DBE Program is narrowly tailored in accordance with applicable law;
4. To ensure that only firms that fully meet 49 CFR Part 26 eligibility standards are permitted to
participate as DBEs;
5. To help remove barriers to the participation of DBEs in DOT-assisted contracts;
6. To assist the development of firms that can compete successfully in the market place outside
the DBE Program.

The Executive Director has been delegated as the DBE Liaison Officer. In that capacity, the Executive
Director is responsible for implementing all aspects of the DBE Program. Implementation of the DBE
Program is accorded the same priority as compliance with all other legal obligations incurred by COLTS
in its financial assistance agreements with the Department of Transportation.
COLTS has disseminated this policy statement to the Board of Directors and all of the components of our
organization. We have distributed this statement to DBE and non-DBE business communities that
perform work for us on DOT-assisted contracts. COLTS’ policy statement will appear in local and transitoriented publications once a year and will be included in all Requests for Proposals and Invitations for
Bids.
1.6 Contract
1.6.1
Award of Contract

COLTS anticipates award of a contract at its regularly scheduled Board meeting on April 19,
2016. A Notice to Proceed is anticipated within one (1) month, following receipt of necessary
documentation, such as insurance certificates from the selected vendor.

The County of Lackawanna Transit System reserves the right to award to other than the low
bidder and to award any or all items of the bid.

If awarded at all, the bid may be awarded to the bidder whose total price is lowest, whose bid is
responsive to the invitation thereof, and who is determined to be technically and financially
responsible to perform as required. The County of Lackawanna Transit System reserves the
right to accept another bid if it is in the best interest of the Authority. Conditional bids and any
bid taking exception to these instructions or conditions may be considered non-responsive and
may be rejected.
1.6.2
Contract Type
COLTS will enter into a firm, fixed fee contract with the selected vendor.
1.6.3
Time for Completion
COLTS intends to negotiate with the lowest priced, responsible bidder to establish a project schedule.
The desired time frame for completion of this contract is four (4) months although COLTS will seek a
schedule that is mutually satisfactory to all parties.

2.1 Technical Specifications
2.1.1

Technical Specifications
The DVRs and cameras shall have the following specifications:
HD800 8 Channel Mobile Digital Video Recording System
Digital Video Recorder (DVR) Minimum Specifications

The DVR shall record 8 video channels simultaneously, switching
systems are not acceptable.
 All 8 channels shall be capable of recording at 720 x 480 at 30fps simultaneously.
 The DVR shall record a separate audio channel with each video channel.
 The DVR shall support data storage on 2.5” mobile ruggedized hard drives.
 The DVR hard drive shall connect to a PC or laptop via a USB cable.
 The DVR shall provide a “One Touch Download” feature to download recordings
with a
single key press.
 The DVR shall be able to transfer recorded video and audio to a removable USB
Flash drive.
 It shall be possible to prioritize alarm video segments (up to 5 levels) for
auto download to the USB port.
 It shall be possible to use the USB port as a mouse port for operation and setup of
the DVR.
 The DVR shall have a front-mounted SD card port which records a removable
copy of alarm event video. This removable copy shall be in addition to the
copy stored normally on the DVR hard drive.
 The DVR shall be capable of both vertical and horizontal mounting, including undermount.
 The DVR shall use h.264 video compression for all channels.
 The DVR shall provide Selectable Resolution: CIF (352X240), 2CIF
(720X240), or D1 (720X480) (3 settings).
 The DVR shall provide Selectable Frame Rate: 1, 2, 3.75, 5, and 7.5,10,15,20,25,30
frames
per second per channel.
 The DVR shall provide full D1 (D1 @ 30 fps) on all channels simultaneously
(240fps @ D1 total composite frame rate).

The DVR shall provide selectable quality settings on each channel: 1-9 (9 settings).
The DVR shall provide resolution, frame rate, and quality
settings configurable independently for each video channel.
 The DVR shall provide dual stream encoding – configurable low-bandwidth substream for
3G/4G viewing.
 The DVR shall show predicted record time displayed in user interface.
 The DVR shall provide automatic hard drive overwrite or write-once
modes – user selectable.
 The DVR shall provide alarm event tagging for automatic/manual download
and to provide fast access to alarm events during playback.
 The DVR shall provide alarm triggering based on panic button, input (brakes,
stop arm, etc. - up to 8 total), vehicle speed, acceleration (collision, hard
braking, etc.), or J1939 data.
 The DVR shall provide alarm video protected from overwrite. The protection shall
be
selectable for 0, 3, 7, 10, 15, 20, 30, 45, or 60 days, or continuously protected.

The DVR shall provide increased frame rate on alarm occurrence: up to
30 frames per second.
 The DVR shall provide vehicle data, including inputs, speed, acceleration, and GPS
coordinates stored continuously with video at all times – “black box” data recording
functionality.
 The DVR shall provide time stamp, vehicle ID, camera names, and vehicle data
permanently embedded in video data as metadata – no video shall
permanently obscured by text.
 The DVR shall provide audio, video, and vehicle data stored fully synchronized in a
proprietary tamper-resistant file format with no known editing method
to assure the integrity of video evidence chain of custody.
 The DVR shall include an infrared remote control with 2 AAA batteries, mounting
brackets
with hardware, 2 hard drive module keys and bilingual warning stickers.
Hard Drive Module Minimum
Specifications
 The hard drive module shall be a removable, locking hard disk drive (HDD) housing
with 2.5
HDD with up to 1TB capacity options available.
 The hard drive module shall provide shock and vibration dampening fully integrated
into
HDD housing.
 The hard drive module housing shall be constructed of metal.
 The hard drive module shall have an Integrated heater for operation down to -40˚C.
 The hard drive module shall have a USB 2.0 port on HDD housing for direct
connection to a host PC – no docking station required.

The hard drive module shall have a key-switch on the HDD housing to lock
the USB port to prevent unauthorized access to the HDD contents and assure
integrity of video evidence.
Network
 The DVR system shall provide an optional integrated 802.11a/b/g/n (Wi-Fi)
internal to
DVR wireless card (factory option).
 The Wi-Fi factory option shall provide WEP, WPA, & WPA2 Encryption options.
 The DVR system shall provide optional 3G cellular wireless router for
remote monitoring with a variety of data plans.
 The optional 3G cellular router shall provide dual stream live view video and
audio – full or reduced bandwidth stream for efficient 3G/4G operation.
 The optional 3G cellular router shall integrate with web based vehicle tracking.
 The optional 3G cellular router shall provide mobile wireless internet access.
 The DVR system shall provide a built in Web UI accessed remotely or locally
with a standard web browser.
 The WebUI shall be able to view live or recorded video.
 The WebUI shall be able to backup recorded video.
 The WebUI shall be able to configure all DVR parameters.
 The WebUI shall be able to facilitate firmware upgrades.
 The DVR system shall provide remote viewing and backup of recorded
video through a video playback application.
 The DVR system shall provide automatic backup of recorded video through a

 The DVR system shall provide text and Email notification of alarm events
(with optional Wi- Fi or 3G wireless router).

Power

The DVR system shall provide a fully regulated power supply for error free
operation with any input voltage in the range from 8VDC to 30VDC.
 The DVR system shall provide a power supply that is fully protected
against overvoltage, transients, and reverse-polarity.
 The DVR system shall provide low-voltage cutoff with automatic restart.
 The DVR system shall provide a programmable system wake feature which allows
the DVR
to turn itself on even when the bus ignition is off and power is turned off.
 The DVR system shall provide programmable off delay configurable from 0 to 9

 The DVR system shall allow the DVR to be switched on/off automatically by

Physical/Environmental

The DVR shall be no larger than 9.2 inches wide by 9.0 inches deep by
3.4 inches high including mounting hardware.
 The DVR system shall have an operating temperature range of at least -40°C to 65°C.
 The DVR system shall have no cooling fans or air moving devices other than free
convection.
 The DVR system shall have an industrial, extruded aluminum chassis for
cooling and vandal resistance.
 The DVR system shall have an all metal chassis construction.
 The DVR system shall have all connectors be locking type to prevent
disconnection due to shock, vibration, etc.
 The DVR system shall have all cables attach directly to the DVR with no
breakout signal cables and/or boxes required.
 The DVR system shall have no active controls on the front panel of the DVR
to be tampered with or damaged.
 The DVR system shall allow top (under-seat), bottom (floor), or vertical mounting
using the
included brackets.
 The DVR system shall require no additional shock and vibration
protection and may be hard-mounted directly to the vehicle chassis.


The DVR system shall have analog audio/video outputs on front

names as well as common presets.
 The sensor inputs shall be individually configurable as active high

 The DVR system shall have a J1939 interface for connection to in-vehicle network.

etc. (custom function – will dependent on make/model/options of vehicle).

The DVR system shall have an analog speedometer input with user
selectable sensitivity and calibration.
 The analog speedometer shall have displays available in MPH or KM/H.
 The analog speedometer shall provide for manual or automatic calibration.
 The analog speedometer shall provide configurable high and low speeds as
marked events or protected alarms.
 The DVR system shall have 8 camera inputs with video, audio, power and
ground on a single locking connector.
 The DVR system shall have a total of 2 Ethernet ports (RJ45 – 10/100
BaseT) on the front and one on the back of the unit for expansion (Wi-Fi,
3G, etc.), local configuration, video
review, and
archiving
(optional).
 The DVR system shall have an optional panic button to allow
driver/user to easily tag events in the recorded video.
 The panic button shall include an external record indicator to display
system status to the driver/user.

 The DVR system shall have an optional GPS module for continuous recording of
vehicle
location, heading, and speed, as well as configurable and automatic
time and date synchronization.
 The DVR system shall have optional external 3-axis 8G
accelerometer/inertia sensor for data recording and detection of hard
braking, accident detection, etc.
 The accelerometer shall allow each axis to be individually configurable for G force
threshold.
 The accelerometer shall allow each axis to be individually configurable as
marked events or protected alarms.
 The accelerometer shall allow for calibration (zeroing) of unit after installation in
vehicle.
 The DVR system shall have provisions for attaching an optional Drivers
Display Module for diagnostics display, data entry, and messaging.
 The DVR system shall have provision for an optional Output Module for
connection to third party systems (AVL, etc.) for status and fault reporting,
etc.

Diagnostics





The DVR system shall have selectable audible or visible fault alerts.
The DVR system shall have video loss detection for each camera.
The DVR system shall have blind camera detection for each camera.
The DVR system shall detect system and hard drive faults.
The DVR system shall have multiple system fault indicators on the front
panel including hard drive, record and power.
 The DVR system shall have video present indicators for each camera on the front
panel.
 The optional panic button shall have remote record status and fault indicator.
 The DVR system shall provide an optional output module software
package to provide status and fault reporting to third party systems
(AVL, etc.).
 The DVR system shall provide recorded highest and lowest system
temperature and voltages along with date and time of occurrence.
 The DVR system shall provide display of current firmware versions and
available hard disk drive space.
DVR Features







The DVR system shall provide a built in clock-calendar accurate to within
±4 minutes per year across the entire operating temperature range (-40°C
to +65° C or -40°F to +160°F).
The built in clock-calendar shall include an Internal 10 year clock battery for
accurate time keeping even when removed from the vehicle.
The built in clock-calendar shall provide an embedded time stamp recorded
with video as metadata that does not obscure video.
The built in clock-calendar shall provide selectable NTP or GPS time
synchronization including time synchronization options and GMT
offset.
The built in clock-calendar shall provide customizable automatic
Daylight Saving Time adjustment.
The DVR system shall provide for local playback and configuration with
included remote control (requires monitor).
The DVR system shall provide an optional password for DVR
configuration and access through local UI, Web UI, or recorded video
playback application.
Video Playback Software



The video playback software shall provide for viewing video from all of
the following viewing sources: Hard drive, SD card, USB thumb-drive,
archived video, or remote DVR (playback or live video).
The video playback software shall provide for integration with an optional
Automatic
Vehicle Location system (AVL/GPS) facilitating a mobile video surveillance system
with AVL
solution.
The optional AVL system shall provide for actively monitoring a fleet of
vehicles with provisions for live tracking, fleet reports, and geofencing.

The video playback software shall provide for video selection by days on the
calendar and video segments highlighted by video type (normal or alarm).
 The video playback software shall provide for selecting video by
month/video segment/time/ or vehicle location (GPS map).
 The video playback software shall provide for the following playback
controls: time slider control with 3 zoom levels (24 hours, 1 hour, or 10
minutes), play, forward/reverse, pause,
fast forward/reverse (2-32X speed), slow forward/reverse (1/2,1/4,1/8 speed).
 The video playback software shall provide for advanced search of recorded
video with included capability to color code inputs to better differentiate
them for reviewing purposes.
 The video playback software shall provide for searching video by: Date/time,
alarms, inputs
(brakes, yellow warning lights, red warning lights, stop-arm, front door, rear
door, brakes, turn signals), ignition on/off, panic button, vehicle speed
over/under, acceleration, vehicle location (GPS geo-fence), motion alarm,
system alerts (blind camera, camera fail), text message.
 The video playback software shall correlate alarm video segments with their
corresponding location on the GPS map such that location of the alarm video
will be noted on the map and clicking on the alarm map segment will display
the appropriate video for the alarm.
 The video playback software shall provide for GPS mapping and display of
vehicle location, route, bread crumb trail and alarms all synchronized with
video playback.
 The video playback software shall provide for GPS mapping and search
integration. The ability to click on any point within the displayed
location/route/bread crumb trail and have
the software playback system go directly to the associated recorded video and start
playing
shall be included as part of the software package.
 The video playback software shall provide for information display inputs
(brakes, lights, etc.), ignition on/off, company name, vehicle ID,
acceleration, GPS coordinates, vehicle

slider bar control, which spans the 24 hour period corresponding to the calendar day

Software shall provide entry to a single vehicle graph and map whenever a specific vehicle
entry is selected on the vehicle list, whereupon the map shall update to reflect the route
taken by the vehicle for the entire day. Similarly, each graph below the route map shall
reflect the dataset in question across the 24 hour timespan corresponding to the selected
calendar day.
Clicking on a populated graph or sliding the 24-hour slider bar shall update the current
position of the vehicle shown on the route map to the location reported at the newly
selected time, and shall similarly update the marker in each graph below the map.



Software shall provide direct, real-time, full-view imaging from any connected device, along
with mapping and video request features.
Software shall provide an interface which allows selection from among host vehicles.
Selecting an individual vehicle shall expand to allow individual channel selection, where
selecting any channel presents it for viewing.

Automatic and Manually Requested Video Download












When any vehicle comes within range of the WLAN the software will determine if video
needs to be downloaded and commence the downloading automatically.
Software shall present all visible video events to the user allowing a variety of sorting
and filtering options.
Software shall allow download of video clips with up to 20 minutes duration. The time
required to download such video clips will be determined by lot-based Wi-Fi
parameters.
Left-clicking on any column header shall sort the entire list by the values in that column.
Multiple left clicks in a column header shall toggle between sorting in ascending and
descending order.
Clicking on the filter control in each column header shall bring up the filter dialogue for
that column.
Selecting any value or values in the filter control shall display events with those values.
Once a filter has been set, the filter icon shall indicate that a filter based on that column
is active.
Software shall allow users to manually request video file download from any vehicle in
the system.
Software shall allow users to select from summary view or detail view.
Software shall categorize available videos into three groups:
o Ready: video is fully processed and ready for playback & review.
o Pending: video is in process, and not yet ready for playback & review.
o Error: video has failed during processing, and cannot be reviewed.

Vehicle and On-Board Video System Diagnostics





Software shall allow the user to query, manage, and maintain compatible mobile devices &
host vehicles remotely.
Software shall perform algorithmic evaluation of each device and host vehicle functional
status, allow remote control & configuration of connected hardware, and monitor each
fleet member status including ongoing documentation of fleet member issues as they are
discovered by the system, in addition to simply presenting data.
Software shall provide the user with a remote system diagnostics report summary, which
details overall system and sub-system functionality.
The summary shall categorize available vehicles into three groups:
o No Fault: Systems functioning normally.
o Warning: Systems with some warning condition or possibly reduced functionality.
o Error: Systems that have failed to function normally.

Software shall provide for management of users, vehicle devices, vehicle device types, and

maintenance, event processing, and overall system health & status information.
Software shall provide an “assets” view, which displays each compatible hardware device
discovered by the system as a unique entry which allows a variety of sorting and filtering
options.
Each entry in the assets view shall contain the following data fields at a minimum:
o Last Reported: displays the current reporting status of each device. “Active”
indicates that the device has active communication with the system; otherwise the
last date and time that the device communicated with the system shall be shown.
o Vehicle Name: displays the value obtained by concatenating the values assigned to
the mobile DVR’s identification fields.
o Group: displays the group that the device is currently assigned to allowing the user
to group devices functionally for a variety of purposes including input assignment,
vehicle device maintenance, and stop arm detection schema. Clicking on the current
group assignment shall activate a drop-down control where the user can select
among and assign a vehicle device to any group previously created.
o Out Of Service: checking this checkbox control shall allow the user to remove the
associated item from visibility system-wide, in all non-administrative views.
Software shall allow the user to create and manage functional groupings of compatible
hardware devices.
Software shall allow each group to contain any number of unique devices, with each
supporting a unique input set assignment and stop-arm violation detection function
configuration.
Software shall allow administrative users to set automatic firmware upgrades for various
devices across the fleet per device model.
Automatic firmware upgrades shall be set using an administrator level update command
associated with any device model.
Software shall provide the ability for administrator level users to add, edit, and delete users
of varied capabilities to the system.

COMMONWEALTH OF PENNSYLVANIA
NON-DISCRIMINATION CLAUSE
1. Contractor shall not discriminate, against any employee, applicant for employment, independent

No Federal Government Obligations to Third-parties
(1) The Purchaser and Contractor acknowledge and agree that, notwithstanding any
concurrence by the Federal Government in or approval of the solicitation or award of the
underlying contract, absent the express written consent by the Federal Government, the Federal
Government is not a party to this contract and shall not be subject to any obligations or
liabilities to the Purchaser, Contractor, or any other party (whether or not a party to that
contract) pertaining to any matter resulting from the underlying contract.
(2) The Contractor agrees to include the above clause in each subcontract financed in whole or
in part with Federal assistance provided by FTA. It is further agreed that the clause shall not be

1986, as amended, 31 U.S.C. § § 3801 et seq . and U.S. DOT regulations, "Program Fraud Civil
Remedies," 49 C.F.R. Part 31, apply to its actions pertaining to this Project. Upon execution of
the underlying contract, the Contractor certifies or affirms the truthfulness and accuracy of any
statement it has made, it makes, it may make, or causes to be made, pertaining to the
underlying contract or the FTA assisted project for which this contract work is being performed.
In addition to other penalties that may be applicable, the Contractor further acknowledges that
if it makes, or causes to be made, a false, fictitious, or fraudulent claim, statement, submission,
or certification, the Federal Government reserves the right to impose the penalties of the
Program Fraud Civil Remedies Act of 1986 on the Contractor to the extent the Federal
Government deems appropriate.
(2) The Contractor also acknowledges that if it makes, or causes to be made, a false, fictitious, or
fraudulent claim, statement, submission, or certification to the Federal Government under a
contract connected with a project that is financed in whole or in part with Federal assistance
originally awarded by FTA under the authority of 49 U.S.C. § 5307, the Government reserves the
right to impose the penalties of 18 U.S.C. § 1001 and 49 U.S.C. § 5307(n)(1) on the Contractor, to
the extent the Federal Government deems appropriate.

Disadvantaged Business Enterprises (DBEs)
49 CFR Part 26
a. This contract is subject to the requirements of Title 49, Code of Federal Regulations, Part 26, Participation by
Disadvantaged Business Enterprises in Department of Transportation Financial Assistance Programs. The national goal
for participation of Disadvantaged Business Enterprises (DBE) is 10%. The agency’s overall goal for DBE participation is
4.2 %.
b. The contractor shall not discriminate on the basis of race, color, national origin, or sex in the performance of this
contract. The contractor shall carry out applicable requirements of 49 CFR Part 26 in the award and administration of this
DOT-assisted contract. Failure by the contractor to carry out these requirements is a material breach of this contract,
which may result in the termination of this contract or such other remedy as County of Lackawanna Transit System deems
appropriate. Each subcontract the contractor signs with a subcontractor must include the assurance in this paragraph (see
49 CFR 26.13(b)).
c. Bidders/offerors are required to document sufficient DBE participation to meet these goals or, alternatively, document
adequate good faith efforts to do so, as provided for in 49 CFR 26.53. Award of this contract is conditioned on submission
of the following concurrent with and accompanying an initial bid:
1. The names and addresses of DBE firms that will participate in this contract;
2. A description of the work each DBE will perform;
3. The dollar amount of the participation of each DBE firm participating;
4. Written documentation of the bidder/offeror’s commitment to use a DBE subcontractor whose participation it
submits to meet the contract goal;
5. Written confirmation from the DBE that it is participating in the contract as provided in the prime contractor’s
commitment; and
6. If the contract goal is not met, evidence of good faith efforts to do so.
Bidders/Offerors must present the information required above as a matter of responsiveness with initial bids (see 49 CFR
26.53(3)).
d. The contractor is required to pay its subcontractors performing work related to this contract for satisfactory performance
of that work no later than 30 days after the contractor’s receipt of payment for that work from the County of Lackawanna
Transit System. In addition, the contractor is required to return any retainage payments to those subcontractors within 30
days after the subcontractor's work related to this contract is satisfactorily completed.
e. The contractor must promptly notify County of Lackawanna Transit System, whenever a DBE subcontractor performing
work related to this contract is terminated or fails to complete its work, and must make good faith efforts to engage
another DBE subcontractor to perform at least the same amount of work. The contractor may not terminate any DBE
subcontractor and perform that work through its own forces or those of an affiliate without prior written consent of County
of Lackawanna Transit System.
f. The contractor hereby agrees to subcontract a minimum of ____% of the contract to Disadvantaged Business

Incorporation of FTA Terms

The preceding provisions include, in part, certain Standard Terms and Conditions required by
DOT, whether or not expressly set forth in the preceding contract provisions. All contractual
provisions required by DOT, as set forth in FTA Circular 4220.1E are hereby incorporated by

County of Lackawanna Transit System’s Protest Procedure
If a bidder/bidder perceives that a segment of the specifications is either too restrictive for competition or
if the bidder/bidder perceives any improprieties in the solicitation or specifications, a written protest
must be filed with the COLTS Executive Director at least five (5) business days prior to bid opening or the
due date for bids. Any protests concerning the award of a contract after the bid opening, or after a public
announcement by COLTS of a contractor selection decision, or after an evaluation of bids submitted under
an IFB, must be made within five (5) days after the bid opening, or public announcement in the case of an
IFB, in order to permit COLTS the opportunity to resolve the issue prior to contract award.
Contents of Protest to COLTS
A bidder or bidder filing a protest with COLTS must submit the protest in writing, via certified United
States mail with a return receipt request, to County of Lackawanna Transit System (COLTS) c/o Executive
Director, 800 North South Road, Scranton, PA 18504. The protest must include:

Regional Office III for resolution.
FTA Review of Protest: A protester must exhaust all administrative remedies with COLTS before pursuing
a protest with FTA. Review of a protest by FTA will be limited to:
(1)
COLTS’ failure to have or follow its protest procedures, or its failure to review a complaint or
protest; or
(2)
Violations of Federal law or regulation.
Following any adverse decision by the Executive Director, the bidder may file a protest if there has been a
violation in connection with 1 and 2 above. An appeal to FTA must be received by the U. S. Department
of Transportation, Federal Transit Administration (“FTA”), Region III, 1760 Market Street, Suite 500,

No formal briefs or other technical forms of pleading or motion are required, but a protest and other
submission should be concise, logically arranged, and clear.
Bid protests must be filed with FTA no later than five (5) days after the exhaustion of administrative
remedies with COLTS is known or should have been known, whichever is earlier.
