Specify aspects of the above application you are submitting on: ! ! The siting of a major public artwork on Queens Wharf – one of the City’s significant public spaces. The appropriateness of the northern end of Queens Wharf to host a major public artwork by one of New Zealand’s most significant contemporary artists. ! This submission does not seek to make comment on the nature or merit of the proposed artwork itself, nor the artist other than to note (as above) that the art work and it’s creator are due serious public consideration given the international reputation of the artist and his work . It does, however, recognise the limitations of the consent approval process in this regard.! ! ! ! The reasons for my/our submission are: ! As a Council-appointed Advisory Panel assembled to provide oversight and expert opinion related to the development and implementation of a strong Auckland Public Art Policy, we feel a direct obligation to contribute our expert advice and articulate our position on this proposal. ! Within the APAPPA Terms of Reference, the role and responsibilities we are tasked with are clearly identified. In summary these are that: APAPPA provides globally insightful, cohesive and expert viewpoints regarding strategic context and guidance for the “arts activities in public places” responsibilities of CDAC’s Arts and Culture Unit. ! - ! - ! ! ! It involves discussion and commentary on significant initiatives – whether proposed or confirmed – affecting Auckland’s “arts in public places”, such as plans for new integrated artworks; altered or expanded arts facilities; temporary public art activities delivered in isolation or through festivals or events; and priorities for sector investment. It provides the independent expert advice required by Auckland Council’s Public Art Policy including: - Review and discussion of the “art in public places” annual work programme; - Discussion and expert comment on the Unit’s strategies to integrate art into major built environment projects, such as AMETI, the City Rail Link, and precinct and town centre upgrades; and - Discussion and expert recommendation regarding proposals and gift offers – whether generated internally or externally – for permanent works of art across the Auckland region. There are a number of additional concerns that have prompted this submission; 292 - To restore some balance to the current debate around the site and the proposed work. The proposal has a high public profile and the resulting debate and criticism of the project appears, in part, to have been informed by a misconception and an, at times, apparently antagonistic position maintained by one of City’s major media outlets. - To provide qualified expert opinion drawing on the shared expertise and experience of APAPPA members. The panel members extensive professional backgrounds and experience cover the theory and practice of urban design; public space place-making; the Arts – their significance (in a public sense – including bicultural considerations), their conceptual content and the commissioning process’: event design, production and delivery.. - As advocates for public art we have collectively identified the need for Auckland to pursue public artworks of scale and significance as part of a vigorous and engaging public art programme. This places particular importance on landmark artworks that are bold in intent and location. We view the Queens Wharf site (as a significant new public space) as holding particular promise and public resonance for the siting of a significant new public artwork. ! ! ! ! ! ! The decision I/we wish the Council to make is (include any part of the application you wish to have amended and any conditions of a general nature): ! ! To support the resource consent application made by Waterfront Auckland. Through the granting of resource consent to the applicant the site would play host to a large, bold and appropriately provocative piece of art by one of NZ’s leading contemporary artists. We have no doubt it will become a celebrated work over time and a landmark for not just the wharf, but for this part of the City’s harbour space and the Waitemata Channel. As such, it marks the start of an important new period in Auckland’s public art history. ! ! ! ! Considerations! The site and proposed artwork has had a high public profile primarily fuelled by the dollar figure attached to the work and its delivery. This figure is a significant amount of money within a local context and, rather regrettably, has become a controversial issue. We would point out that, within a global context (to which this City now aspires) this sum is entirely consistent with the establishment of works of major public significance. It is an act of maturity on the part of a City with global aspirations to provide the genesis and a positive home for works of this kind. In this regard, we also note that the proposed work will be entirely privately funded as a gift to Auckland City – with no pressure on the public purse, but with all the public acclaim that comes to a City that is seen to sanction and facilitate a public move of this potential stature. The controversy about funding is both misplaced and represents, in our view, an embarrassing provincialism for a city that wishes to establish a reputation on an international stage. ! The other significant issue that has featured in public discussion relates to the use of Queens Wharf as a host site for a major public artwork. 293 Although not a major issue for this Resource Consent, we would be remiss if we did not note the high level of public interest and concern that exists around the proposed extension of the POAL wharves to the immediate east of Queens Wharf. This has created a intensely sensitive environment in which to discuss the import of the siting and visual impact of any public art work within this part of the waterfront precinct. This is particularly the case where the art work concerned derives a significant part of its conceptual resonance from its implied role as a “Light House” (i.e. something to be seen and recognised as a “city marker” for arriving and departing ships (and passengers) from the approaches down the Waitemata Channel. ! Given the nature of the existing activities on Queens Wharf, a risk has been identified within DKO Architectures’ report (entitled “The Lighthouse” Queens Wharf, Auckland) that the work will create a dislocating barrier to accessing the northern and most public area of Queens Wharf. Current use and users of Queens Wharf that may contribute towards this risk has been identified to include; - Ferry traffic via Pier 1 on the South Eastern edge of the wharf. - Vehicle movements including supply vehicles, private motor cars and taxis facilitating passenger drop off and pick ups of ferry users, event goers and cruise ship passengers. - The Cloud event space used for public and private functions. - Shed 10, a cruise ship depot and function space. In consideration of these concerns, and in addressing the matter of the Queens Wharf siting for public art works generally, it is APAPPA’s strong opinion that the northern end of Queens Wharf is an ideal position to site a significant public artwork of this kind and conceptual content. Our reasons for this position are as follows; ! -The creation of a public destination (and public landmark) at the northern tip of the wharf of the scope scale and conceptual content envisaged – a public art work that is likely to attract repeated visitation,- is a key move in further establishing the perception and reality of public access and “ownership” of Queens Wharf (the ‘Peoples Wharf’) than in it’s existing (and temporarily ambiguous) form. We further note that ! ! ! - There is an undeniable logic in creating an urban magnet (with a strong public presence) to activate the northern end of Queens Wharf, given that vehicle movements, car parks, cruise ship crowds and a programme of private events within both the Cloud and Shed 10 all currently contribute to the public dislocation and ambiguity of the Wharf as a major new public place in the City. - The siting of a significant public artwork with a heightened public profile will proactively support the transition of a previously inaccessible wharf from a passive space to an active one. It does not fulfil it’s promise as a genuine public space if it continues to operates as a ‘best kept secret’. Rather the placing of “The Light House” at the northern tip of the Wharf should be viewed as another important step in opening up the Auckland waterfront to genuine public access and use. - The proposed site provides an opportunity to create a point of first contact for visitors arriving via cruise ship at Queens Wharf that is not a functional operation within a functional structure. It is an opportunity to boldly invite questions around who we are as a people and how we see ourselves in terms of our regional and Pacific identity. - This site (and specific siting) acknowledges how many Aucklanders and visitors experience the city within this land/water context. The Waitemata Harbour is a significant and central feature of Auckland and water based activity is a popular pursuit of the city’s peoples. 294 ! ! ! - A site (and the work) bridges the divide between land and sea, and provides a multi faceted experience for viewers dependent on the terms of their engagement - be it by foot, bicycle, kayak or ferry. It is a site that supports Auckland’s best rewards for living here in this city – in essence, our relationship with our harbours,our beaches and other waterways. - We believe that the proposed site is entirely consistent with the Waterfront Plan which identifies the role public artwork will play in it’s goal to promote the waterfront area as a place for all Aucklanders and visitors to Auckland. In this regard, we also note that “The Cloud” (and its requirements around vehicle-based servicing and access) represents a strictly limited and temporary occupation on the Wharf and not a long-term physical presence, unlike the proposed public art work. When it comes down to which should take precedence in public terms it is our view that the permanent should always trump the temporary. - We also note that the proposal is utterly consistent with Auckland Council’s Public Art Policy and the Auckland Plan. Additionally we acknowledge that consent is required in accordance with the existing Regional Plan: Coastal, but that within the soon to be adopted Unitary Plan resource consent would not be required. Consequently, in reviewing the documents accompanying the application for resource consent we are satisfied there are no adverse affects identified by the major stakeholders who have considered the site’s implications related to the visual landscape, urban design, nautical operations, heritage and environmental effects. ! ! ! Recommendations! The APAPPA understands that there has not, to date, been specific Mana Whenua consultation over the proposed artwork(s) for Queens Wharf and see that such direct discussions would be consistent with the Auckland Council / Mana Whenua partnership intent and the application of the Te Aranga design principles. This submission: attests to the quality of the proposed artwork notes that The Lighthouse meets our best practice expectations for the creation and presentation of art in public space briefly outlines our track record of support for Michael Parekowhai. Quality of the proposed artwork 5. As described, The Lighthouse will be one of Auckland’s significant works of public art. The artwork references New Zealand’s architectural and social history by taking the form of a scaled-down state house, as well as referencing the form and significance of the stars which guided early Māori and European navigators as they travelled to Aotearoa. By combining ‘the familiar with the unexpected, the simple with the decorative, the literal with the poetic’, Parekowhai generously invites his audience to consider their place in the world as well as their relationship to others. 301 6. The Lighthouse’s location, at the end of busy Queens Wharf, will provide Aucklanders, New Zealanders and international visitors with the chance to freely access and enjoy this major artwork. While the audience will principally be pedestrians, we also note that the artwork will be visible from a number of vantage-points across the Waitematā harbour. 7. The Lighthouse project offers Parekowhai an adventurous commission that will allow this well-regarded artist to create and present a significant, permanent artwork. This will in turn further extend his creative and professional development within the realm of public art. We have no doubt that this project will be realised to the highest quality, and become a significant asset to the waterfront and the city. Best practice expectations for art in public space 8. 9. This Auckland Council public art project meets Creative New Zealand’s expectations for the commissioning of permanent artworks within public space. These expectations seek to ensure that: projects are consistent with the local or regional public artwork strategy the local council confirms its interest in, and financial commitment to, the project proposals state the long-term maintenance plan for the proposed artwork copyright protection for the New Zealand artist is maintained. This project also aligns strongly with Creative New Zealand’s strategic outcomes, including fostering the development of high-quality New Zealand art (see paragraph 15). As ‘the largest Michael Parekowhai commission to date in New Zealand and the largest monetary gift for a single artwork in New Zealand’, The Lighthouse will also help advocate for the value of the arts in public life, and be a positive example of private investment within the arts sector. Creative New Zealand’s support for Michael Parekowhai 10. Creative New Zealand endorses Michael Parekowhai as a contemporary artist of significant national and international standing. Parekowhai’s projects are expertly conceived and then realised to an exceptionally high standard of production. 11. Throughout his career, Creative New Zealand has supported a range of projects by the artist through our contestable grants scheme, most recently by offering support towards Parekowhai’s major solo exhibition currently on display at the Queensland Art Gallery / Gallery of Modern Art, Michael Parekowhai: The Promised Land.1 In addition to our project-specific support, we also worked closely with the artist when he was commissioned to represent New Zealand within our national pavilion at the 54th Venice Biennale in 2011. 12. Parekowhai’s presentation in Venice was titled On first Looking into Chapman’s Homer and his impressive cast and carved sculptural works referenced notions of discovery, exploration and the cultural interplay between the old world of Europe and the new. The intricately-carved Steinway concert grand piano presented for the first time in Venice, He Korero Purakau mo Te Awanui o Te Motu: story of a New Zealand river, is now held within the national art collection of the Museum of New Zealand Te Papa Tongarewa. REG - 2015 - 1417 Date of Submission: Monday 8 June 2015. Thank you for providing information to Ngāti Whātua Ōrākei (NWŌ) regarding the application from Auckland Waterfront Development Agency to place a significant public artwork at the northern end of Queen's Wharf on Auckland's waterfront. From the information provided, NWŌ understand that the main components of the project’s physical works, which are of concern to us are the: 1. Stormwater; and 2. Cultural heritage NWŌ are kaitiaki of significant areas of the Auckland Isthmus and surrounds including the city centre. NWŌ see themselves as a partner of Auckland Council and its subsidiaries and maintain a strong presence in the planning and management of areas of interest in our rohe. In addition NWŌ note that the Resource Management Act 1991 requires all persons exercising functions and powers (including policy/plan making and resource consent processes) to: • recognise and provide for, as a matter of national importance: o The relationship of Māori and their culture and traditions with their ancestral lands, water, sites, wāhi tapu, and other taonga; o the protection of historic heritage from inappropriate subdivision, use, and development; o the protection of recognised customary activities; • have particular regard to Kaitiakitanga; • take into account the principles of the Treaty of Waitangi (Te Tiriti o Waitangi). The area for development falls within the rohe (tribal area) of NWŌ. In late 2012 NWŌ completed an Iwi Management Plan (IMP). In accordance with 35A of the Resource Management Act 1991 Auckland Council has held a copy of the IMP since 2013 and it has been included in NWŌ's formal submission on the Proposed Auckland Unitary Plan. The IMP provides clear guidance on issues of importance to NWŌ, with the on-going diminishment of the mauri (life force, somewhat compatible with ecological health) of harbours, streams, wetlands and lakes being an issue of major concern (see page 13 of the IMP for further discussion in this regard). Urban development has resulted in the Waitematā & Manukau coasts and tributaries receiving untreated road runoff, storm / wastewater discharges. This has caused the on-going diminishment of the mauri of harbours, streams, wetlands and lakes which is a serious issue for NWŌ in our role as kaitiaki in Tāmaki Makaurau. The abovementioned activities are a concern to NWŌ as they contradict the objectives and policies as stated in the IMP and highlighted below. This submission will: • Identify the concerns; • highlight relevant objectives and policies from NWŌ's IMP; 310 • list recommendations for each concern. Stormwater Unfortunately we just don't seem to have received enough information with respect to this application, to assess how well or not stormwater/run-off issues have been considered. This falls under NWŌ's 'Te Wai Ora a Tāne and Mauri Moana (Waters and their Ecological Communities)' objective which looks to protect the mauri (aura) of harbours, streams, wetlands and lakes by preventing the discharge of untreated contaminants to our water ways. 7.1.1 Te Wai Ora a Tāne and Mauri Moana (Waters and their Ecological Communities) Objective: 1. The maintenance and, where required, restoration of the mauri of the waimāori networks and moana of Tāmaki, the Waitematā, Manukau and North Shore. These waters will be fit to swim in and sustainably gather resources from, and wāhi tapu / wāhi hira (sacred or important areas / places) will be recognised and cared for. Policies: a. Marine waters shall be managed and, where necessary, restored to maintain or enhance their mauri and to protect ecosystem, amenity, and mana whenua values b. Fresh water streams, lakes, wetlands and rivers shall be managed and, where necessary, restored to maintain or enhance their mauri and to protect ecosystem, amenity, and mana whenua values. d. Avoid the direct discharge of wastewater into rivers, lakes and the sea. Recommendations: NWŌ continue to advocate for improvements to the current approach to stormwater which allows the discharging of untreated stormwater and associated contaminant run-off into our waterways. NWŌ recommends: • The use of filters, capturing and re-using rainwater and the use of permeable surfaces on a property can all also contribute to improved stormwater management. Cultural Heritage NWŌ would appreciate the opportunity to collaborate with Auckland Waterfront Development Agency and other iwi representatives regarding the incorporation of cultural art/design/celebration of heritage in any future development within Queens Wharf. More specifically NWŌ would like to discuss how through this project the ancestral associations to Rerenga-ora-iti (Queens Wharf) can be recognised and celebrated in an appropriate manner. NWŌ advocate for a collaborative process whereby a 'cultural design brief' is created for the project which would be opened to proposals from iwi artists/designers. 7.3.2 Cultural Heritage Objectives: 1. NWŌ sites of significance and wāhi tapu, and our relationships with those sites, are maintained or enhanced. This includes the holistic protection and management of cultural heritage / archaeological features of interest in partnership with Auckland Council and the Historic Places Trust. 311 2. NWŌ sites of significance and wāhi tapu are promoted and actively celebrated with the focus on Māori values, unless restricted for tikanga reasons. This will increase recognition, knowledge, appreciation, respect and care of Māori heritage and values in Tāmaki within the NWŌ community, Council, key stakeholders and the public. 3. NWŌ has ownership and management of, access to and use of its heritage sites, including control of sensitive information about them (e.g. NZAA database). This will enable the protection and appropriate management of cultural and archaeological features of interest to NWŌ. 4. NWŌ has expertise in all facets of heritage management and has its own 'whare taonga', heritage archive and / or partnership in the management of displays on NWŌ heritage (e.g. at the maunga or in Auckland museums). 5. Increase the acknowledgement of and support for NWŌ values and our active exercise of kaitiakitanga. Improve the strength of NWŌ relationships with other managers in developing and implementing initiatives for sustaining cultural heritage in the rohe. Policies: a) All NWŌ heritage sites are identified / scheduled / registered with councils, local boards, Historic Places Trust and Department of Conservation, starting with 'Tekau mā Rima as a minimum. This would involve different layers of public identification depending on the sensitivity and management of the heritage information, e.g. with respect to urupā. Ideally, the numerous government bodies with authority over Māori heritage in New Zealand need to combine all layers of relevant information into a single database. b) Appropriate use and classifications in relation to NWŌ heritage values, e.g. reserves with heritage values are classified as 'historical' and not 'recreational'; 'buffer zones' with specific controls are created around heritage sites c) Connections (both physical and visual) between and the relationships between heritage sites across landscapes are acknowledged and managed sustainably. Where appropriate, access to heritage places is provided and maintained. d) Establish and maintain strong partnerships / working relationships / agreements with key stakeholders / heritage authorities in the implementation of heritage initiatives where there are shared values and goals throughout the rohe. This would improve sustainable management of our heritage sites / landscapes, with a focus on their Māori values. This includes providing NWŌ with greater control over access to sensitive information about our heritage. e) NWŌ actions with regards to heritage will be consistent with our stated heritage values and with the advocacy we undertake elsewhere (e.g. when we undertake a development). 312 f) NWŌ will advocate for heritage management practices that contribute, where appropriate, to other tribal objectives (e.g. enhancement of indigenous biodiversity). g) Co-own and manage / co-manage heritage sites of importance to NWŌ. Archaeological features and remains can take the form of burnt and fire cracked stones, charcoal, rubbish heaps including shell, bone and/or 19th century glass and crockery, ditches, banks, pits, old building foundations, artefacts of Māori and early European origin, or human burials / remains. In addition to any requirements under the RMA 1991, the HPA 1993 protects all archaeological sites whether recorded or not, and they may not be damaged or destroyed unless an Authority to modify an archaeological site has been issued by the New Zealand Historic Places Trust (NZHPT). An archaeological site is defined by the HPA s. 2 as: ‘any place in New Zealand that – (a) Either – (i) Was associated with human activity that occurred before 1900; or (ii) Is the site of the wreck of any vessel where that wreck occurred before 1900; and (b) Is or may be able though investigation by archaeological methods to provide evidence relating to the history of New Zealand.’ Authorities to modify archaeological sites can be applied for either under Section 11, in respect to a particular site or sites, or under Section 12, for all sites that may be present within a specified area. Applications made under S12 require approval by the Māori Heritage Council of the NZHPT. The 313 tangata whenua must be consulted regarding applications to modify or destroy archaeological sites which have Māori cultural associations. This document sets out protocols to be followed in the event that archaeological remains, taonga or kōiwi (human remains) are unexpectedly exposed during development work. PROTOCOLS If material that may be kōiwi (human remains) is identified the following protocol will be adopted: a. Earthworks will cease in the immediate vicinity (10m) while an archaeologist is consulted to establish whether the remains are human. b. If it is still not clear whether the material is human, work shall cease in the immediate vicinity until a reference collection and/or a specialist can be consulted and a definite identification made. c. If the material is identified by the archaeologist as human, earthworks will not be resumed in the immediate area (defined by the archaeologist and Ngāti Whātua Ōrākei) until the NZHPT, the New Zealand Police and Ngāti Whātua Ōrākei (NWŌ) have all given approval. d. The area of the site containing the kōiwi will be secured in a way that protects them from further damage. e. Ngāti Whātua Ōrākei representatives will be given the opportunity to conduct karakia and such other religious or cultural ceremonies and activities as are appropriate to NWŌ tikanga, and to remove the material should they wish, once the Police have confirmed that the site is not a crime scene. f. If NWŌ so request, the human remains may be further analysed by the archaeologist or a qualified anthropologist / pathologist prior to reburial. g. Activity in the immediate vicinity can recommence as soon as authorized by NWŌ, the HPT and the site archaeologist. If remains are exposed that are potentially archaeological features or deposits, the following procedure should be adopted: 1. Earthworks should cease in the immediate vicinity (10m) while an archaeologist is consulted to establish whether the remains are part of an archaeological site as defined under the Historic Places Act 1993. 2. If the archaeologist confirms that it is an archaeological site, the area of the site will be defined by the archaeologist and excluded from earthworks. 3. The NZHPT will be informed of the discovery and, if the site cannot be avoided, an application for an Authority to modify the archaeological site will be made (this is a legal requirement). 4. If the archaeological site relates to Māori occupation / use Ngāti Whātua Ōrākei must be consulted (an assessment of effects on NWŌ cultural values will be required as part of the Authority application). Māori artefacts such as carvings, stone adzes, and greenstone objects are considered to be taonga (treasures). These are taonga tūturu within the meaning of the Protected Objects Act 1975. Taonga 314 may be discovered in isolated contexts, but are generally found within archaeological sites, modification of which is subject to the provisions of the Historic Places Act. If taonga are discovered the procedure set out for the discovery of archaeological sites (above) must be followed, and the following procedure will apply to the taonga ourselves: 1. The area of the site containing the taonga (at least 10m radius) will be secured in a way that protects the taonga from further damage. 2. The archaeologist will then inform the NZHPT and the nominated Ngāti Whātua Ōrākei representative so that the appropriate actions (from cultural and archaeological perspectives) can be determined. 3. Work may resume when advised by the NZHPT, site archaeologist and Ngāti Whātua Ōrākei. 4. The archaeologist will notify the Ministry for Culture and Heritage of the find within 28 days as required under the Protected Objects Act 1975. The Ministry for Culture and Heritage, in consultation with Ngāti Whātua Ōrākei, will decide on custodianship of the taonga. Ngāti Whātua Ōrākei is a registered collector of taonga tūturu and hence legally permitted to hold such items. Ultimate ownership is determined by the Māori Land Court. The reasons for my submission are: The artwork fails to maintain the character of the existing built environment and as such is at odds with the parts of the NZ Coastal Policy Statement 2010 To the extent that the it fails to adequately retain and reflect character features, structures and elements that demonstrate the heritage and history of the working waterfront, its visual effects are at odds with the Operative Regional Plan Coastal. The application doesn’t adequately recognise the heritage values of Queens Wharf and as a consequence, its assessment of heritage effects is understated. While it acknowledges that Queen’s Wharf is on Heritage New Zealand’s List, it overlooks that on that basis, it has also been proposed for scheduling in the Proposed Auckland Unitary Plan. 324 The applicant notes that while it is true that the nature of the structure on the wharf is different to the historic buildings, the key point is that the heritage integrity of the wharf is retained. To the contrary, the key point is that the values (for which the Queen’s Wharf was included in Heritage NZ’s List and for which that organisation [sub# 371-145], amongst others, have proposed it for scheduling in the PAUP) have not been adequately recognised and consequently provided for in the applicant’s assessment of effects. There was mention in the application that Heritage New Zealand had been consulted but no details of any response were attached. Furthermore, on the basis that the applicant asserts the artwork is intended to be integral to the ‘people’s wharf, it is noted that that there doesn’t appear to have been much consulting with members of that public.
