N-6 Notice To Contractors Implementation of Electronic Payroll Processing for Construction Contractors GDOT uses a software product called AASHTOWare Trns•port to manage the agency’s construction contract management program. GDOT is currently implementing a new module called Trns•port Civil Rights and Labor Management System (CRLMS). CRLMS will manage all aspects of GDOT’s external civil rights and labor compliance activities such as DBE goals, OJT goals, contract labor compliance and good faith efforts, federal prevailing wages regulations, electronic vendor payment validation and federal/state reporting requirements. In addition, CRLMS will replace GDOT’s current manual process for the collection of Contractor’s payroll information. The Electronic Payroll portion of CRLMS is currently being tested and is scheduled to begin implementation by December 2013. This is to advise all concerned parties that projects advertised on or after March 19, 2004 will require that all Contractors and subcontractors performing surface preparation or coating application shall be certified by the Society for Protective Coatings (formerly Steel Structures Painting Council) (SSPC) prior to beginning work, and shall remain certified while accomplishing any surface preparation or coating application. The Department will require that ANY painting contractors or subcontractors engaged in surface preparation and coating application be certified by SSPC according to SSPC-QP 1. In addition, the Department will require that ANY Contractor or subcontractor engaged in lead paint removal or removal or disturbance of paint containing hazardous material be certified by SSPC according to SSPC-QP 2. If only surface preparation and coating application are required by the contract (for new steel applications), then only SSPC-QP 1 certification will be required. Information about the SSPC Certification Program can be obtained at : www.sspc.org. The painting contractors and painting subcontractors must remain so certified for the duration of the project. If a Contractor's or subcontractor's certification expires, the company will not be allowed to perform any work until the certification is reissued. As a result of this non-attainment status, the Georgia Department of Transportation has instituted a Voluntary Ozone Action Plan (VOAP). One component of the Department’s VOAP is to encourage contractors who are constructing projects within the Metropolitan Atlanta region to restrict operations that contribute to the formation of ozone, ground level smog, between the hours of 6 A.M. and 6 P.M. on Ozone Action Days. The following counties comprise the Metropolitan Atlanta Non-attainment Region: Cherokee, Clayton, Cobb, Coweta, Dekalb, Douglas, Fayette, Forsyth, Fulton, Gwinnett, Henry, Paulding, and, Rockdale. “Ozone Action Days” will be declared by the Georgia Department of Natural Resources by 6:00 P.M. on the day immediately preceding the “Ozone Action Day”. An “Ozone Action Day” is a day when ozone levels are predicted to exceed the acceptable level for attainment as defined by the Clean Air Act provisions. On days that have been declared as Ozone Action Days, Georgia DOT contractors are encouraged to refrain from operating paving and heavy construction equipment between the hours of 6 A.M. and 6 P.M. On “Ozone Action Days”, GDOT contractors are also encouraged to avoid refueling motorized vehicles and equipment between the hours of 6 A.M. and 6 P.M., to limit single occupancy trips and to avoid the operation of gasoline powered small engines between the hours of 6 A.M. and 6 P.M. The voluntary reductions of exhaust and particulate matter that would be produced by these operations will help the Metropolitan Atlanta Region meet its required reduction in ozone levels. Failure to meet these requirements will result in further restrictions on the Department’s ability to acquire the necessary permits to pursue the Construction Work Program necessary to address the area’s mobility needs and to sustain the local highway contracting industry. N - 32 SPECIAL NOTICE TO CONTRACTORS EPD AIR QUALITY RULES MODIFICATIONS In September 1995, The Environmental Protection Division (EPD) modified the Rules for Air Quality control (Chapter 391-3-1) as they pertain to Open Burning. Effective January 9, 2005, outdoor burning is banned during the months of May, June, July, August and September in the following counties: Banks, Barrow, Bartow, Bibb, Butts, Carroll, Catoosa, Chattooga, Cherokee, Clarke, Clayton, Cobb, Columbia, Coweta, Crawford, Dawson, DeKalb, Douglas, Fayette, Floyd, Forsyth, Fulton, Gordon, Gwinnett, Hall, Haralson, Heard, Henry, Houston, Jackson, Jasper, Jones, Lamar, Lumpkin, Madison, Meriwether, Monroe, Morgan, Newton, Oconee, Paulding, Peach, Pickens, Pike, Polk, Putnam, Richmond, Rockdale, Spalding, Troup, Twiggs, Upson, Walker and Walton. Open Burning will be permitted in the months of October, November, December, January, February, March and April for the purpose of land clearing, construction or, right-of-way maintenance provided the following conditions are met: 1. Prevailing winds at the time of the burning are away from the major portion of the area’s population; 2. The location of the burning is at least 1,000 feet from any occupied structure, or lesser distance if approved by the Division; 3. The amount of dirt on or in the material being burned is minimized; 4. Heavy oils, asphaltic materials, items containing natural or synthetic rubber, or any materials other than plant growth are not being burned; 5. No more than one pile 60 feet by 60 feet, or equivalent, is being burned within a 9 acre area at one time. In addition to the above provisions, the EPD Rules require permits from the fire department and the Georgia Forestry Office, when required, and the use of air curtain destructors when Open Burning is permitted in these areas. All of these items are non-refundable. The NOTICE TO CONTRACTORS which includes line items and quantities is available on Bid Express at www.bidx.com . Proposals shall only be submitted electronically as specified in the Specifications; and shall be accompanied by a proposal guaranty in the indicated amount in the form of a Certified Check, Cashier’s Check or Bid Bond on the form issued by the Department. In accordance with the Specifications, the time set for receiving electronic submission of a bid terminates at 11:00 A.M. Bids shall only be submitted using the GADOT/AASHTO (American Association of State Highway and Transportation Officials) Electronic Bidding System (Expedite) and can be submitted, withdrawn and/or resubmitted prior to 11:00 A.M., but cannot be withdrawn after 11:00 A.M. The apparent low bids (unofficial bid results) will be posted after 2:00 P.M. on the Bid Express Web site at: https://www.bidx.com/ . Acceptance of an offer submitted to the Department will be given in writing within 50 days after the opening of the bid unless a longer period is specified in the proposal or agreed upon by the successful bidder. Offers of bidders who do not hold a current Certificate of Qualification will not be accepted unless prequalification requirements are specifically waived for the project, or unless the bid submitted is $2,000,000 or less. Work will be governed by the applicable edition of the DOT Specifications as amended by the contract provisions. Contract time will be as indicated. Payment will be made to the contractor each calendar month based on the estimated work complete in place as prescribed by the Specifications. Final payment will not be made until the Chief Engineer has certified that the work has been satisfactorily completed and accepted. All federally financed contracts will contain provisions with regard to minimum wages, employment of labor, methods of construction, disadvantaged business enterprise involvement, and subletting or assigning the contract. On all projects, the Department will insure that disadvantaged business enterprise contractors will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, national origin, sex, age, or disability in consideration for an award. On selected projects, the Department will set a percentage goal for work to be performed by disadvantaged business enterprise contractors. On such projects, the bidders will be required to certify and document the percentage goal of DBE utilization they propose to achieve. Proposed DBE participants shall be submitted with bid. At the time an award is made to the low bidder, the Department will announce the names of the DBE participants listed by the low bidder. This information will be shown on the Award Announcement. It will not be given by telephone either before award or afterwards.
