DP-2015-077 To: Mayor and Members of Council From: Development Approval & Planning Policy Department Meeting: 2015-10-06 Subject: Alteration Request for Designated Property at 18388 Heart Lake Road RECOMMENDATIONS That Report DP-2015-077 regarding Alteration Request for Designated Property at 18388 Heart Lake Road, be received; and That Council consent to the proposed alteration to the designated heritage property at 18388 Heart Lake Road as shown on Schedule B of DP-2015-077, with the conditions that any exterior wall-mounted equipment be located on the garage and that the necessary building permit be obtained. EXECUTIVE SUMMARY The property at 18388 Heart Lake Road was designated under section 29 of the Ontario Heritage Act (the OHA) by means of By-Law 00-130. Known as the Tramble-Westfall Schoolhouse, the property entails a c.1893 oneroom schoolhouse formerly known as Caledon S.S. No.9 (The Maples). The owners are proposing to install solar panels on the rear of the schoolhouse roof and the adjacent garage roof. Pursuant to section 33 of the OHA, alterations to a designated heritage property require the consent of Council after consultation with its municipal heritage committee. Heritage Caledon has reviewed the matter, and recommends that Council consent to the alteration as proposed with the conditions that any exterior wallmounted equipment be located on the garage and that the necessary building permit be obtained. DISCUSSION Purpose (background) On July 22, 2015, the Town received a request from the owners to alter the designated heritage property at 18388 Heart Lake Road, known as the Tramble-Westfall Schoolhouse (Schedule A). This property was designated under section 29 of the OHA by means of By-law 00-130. Its key heritage attribute is the c.1893 schoolhouse for former Caledon Township School Section No. 9, originally known as ‘The Maples’. Page 1 of 3 DP-2015-077 The proposed alteration pertains to the installation of rooftop solar panels on the schoolhouse and the adjacent modern garage, and associated wall-mounted electrical equipment. Both the schoolhouse and the modern garage have hip roofs; the proposal is to install the panels on the rear, west-facing sections of the roofs, which are not visible from the public realm (Schedule B). A building permit is required for installation of roof-top solar panels. Pursuant to section 33 of the OHA, alterations to a designated heritage property require the consent of Council after consultation with Heritage Caledon. Council’s approval of proposed alterations to a designated property is intended to ensure that alterations are not detrimental to the property’s identified heritage attributes. Heritage Caledon’s alteration review subcommittee reviewed the formal proposal (Schedule B) and undertook a site visit with the property owners to assess potential impacts of the proposed alteration on the designated property on August 13, 2015. The recommendations of the alteration review subcommittee in support of the proposed alteration to the Tramble-Westfall Schoolhouse were endorsed by the full Committee on September 14, 2015 (HC-2015-024). Heritage Caledon supports the proposed alteration to the Tramble-Westfall Schoolhouse for the following reasons: The installation of the solar panels is considered a reversible alteration, and will not impact the hip roof configuration of the schoolhouse; The proposed placement of the solar panels will not be visible from the public realm due to the hip roof configuration of the schoolhouse and garage, and the heavy coniferous screening of the rear of the property; and, The owners propose to install all wall-mounted electrical metering equipment associated with the solar panels on the garage, not the schoolhouse. In light of the above, Heritage Caledon recommends that Council consent to the alteration request on the conditions that the exterior wall-mounted equipment be located on the garage and that the necessary building permit be obtained: The OHA requires Council to provide its decision within ninety (90) days of the notice of receipt of the application to alter the property. As notice of receipt of the application was given on July 22, 2015, Council’s decision on the matter at this meeting date meets the OHA’s ninety (90) day response period. Council may consent to the application as proposed, consent with conditions, or refuse the application. If Council consents to the application with conditions or refuses the application, the property owners may, within thirty (30) days of receiving notice of Council’s decision, apply for a hearing before the Review Board. Financial Implications All costs associated with this application, including the building permit, will be borne by the property owners. Type, Quantity and Prices of Components 1. The type and quantities of the required components for the proposed PV System have been identified on page 2 of this Contract. II. Labeling 1. The product labels and Trade Marks of each PV solar panel shall state the manufacturers’ name, each module’s serial number, indicate the nominal output as well as current and voltage characteristics at standard test conditions (STC) of the type of module concerned, and bear a clear warning against hazardous behaviour. Further, each module shall have a label showing the UL mark or equivalent, and will comply with all labeling requirement set forth in UL 1703. 2. The Purchaser shall not, without the prior written consent of EthoSolar, alter or make any addition to the labeling or packaging of the products displaying the Trade Marks, and shall not alter, deface, or remove in any manner any reference to the Trade Marks, any reference to EthoSolar or any other name attached or affixed to the products or their packaging or labelling. III. Title and Risk of Loss/Insurance 1. Risks of loss or damage, as well as any additional costs due to events occurring after the time of delivery shall pass to the Purchaser on delivery in accordance with FOB Incoterms 2000. a. FOB EthoSolar’s warehouse – Insurance is covered through EthoSolar insurance during transport; b. FOB Supplier’s premises – Insurance is covered through Supplier’s insurance during transport. 2. Title to the products shall be transferred at the moment the risk is transferred per FOB Incoterms 2000. EthoSolar assigns to the Purchaser all its rights against the carrier of the products, especially rights to give instructions and to take delivery of and to claim in relation to the products. IV. Installation 1. This contract applies only to the work and materials that are stated within it. Any additional work done will be an extra charge to the Contract. 2. If additional work is required, it will be invoiced as “Time & Materials”. The EthoSolar installation labour rate is $75.00 per hour. The EthoSolar machine rate is $120.00 per hour including the operator. If excavation is required in frost or if there is the presence of large stones, shale, flat rock, bedrock, wet or saturated soils or any other obstruction an extra charge may apply unless these conditions are noted in this Contract. 3. Building sites that are not level can incur extra costs due to delayed installation, lost time, additional materials required, and/or may be considered unsafe for the aerial lift equipment. For these reasons it is required that the Purchaser provides and ensures a level and safe building site prior to the arrival of the installation crew. If the site is not level, the Purchaser is required to consult with EthoSolar before construction begins in order to avoid additional costs. EthoSolar can advise the best course of action to minimize extra costs. Unless otherwise noted, any site excavation or finish grading is not included in this Contract. 4. All workmanship is guaranteed for one year from date of completion. The warranty information for components is identified on page 3 of this Contract. 5. Building permit fees and possible associated costs are included in the aforementioned fees including, site specific engineering, general review commitments and engineer site visits. Any required roof upgrades as indicated by the structural engineer are the responsibility of the Purchaser and are not included in this scope of work unless otherwise agreed in writing by EthoSolar. Construction cannot begin without a building permit or a signed waiver. Failure to get the necessary permits will delay the start of the project. 6. Estimates will be returned to the Purchaser as quickly as possible. Time of installation will depend on how quickly the Purchaser replies to a proposed quote from EthoSolar. Once the Purchaser returns this completed Contract with the deposit, EthoSolar will position the project into the EthoSolar work schedule and the Contract price will be locked in. 7. Insurance for the PV system equipment and liability is covered by EthoSolar during construction. It is advisable that the homeowner notify their insurance company of the installation and request their policy include the addition of the solar generating equipment prior to connection by the utility. EthoSolar’s insurance will expire after construction is complete and the system is connected to the grid. 8. Estimated time of installation may vary due to weather conditions, added work load at each site or machinery breakdown. 9. EthoSolar, their affiliates, employees, sub-contractors or trades do not assume or imply any responsibility or liability for damages to underground services. It is the responsibility of EthoSolar to obtain any and all service locates prior to any ground work commencing or confirm that a locate is not required. V. Terms of Payment The payment shall be made by cash, cheque or money wire transfer. These are the only acceptable methods of payment. The following terms of payment are: 1. Ethosolar Inc. requires a $ 1,500 deposit cheque and a signed copy of this Contract to apply for an IESO micro-FIT contract and an LDC Offer to Connect. 2. Upon receipt of the Application Approval Notice from the IESO, a 30% down payment of the contract price or &7.682022 will be required to order the solar components and mounting hardware. Scheduling for installation will be based on project delivery time. If Purchaser cancels the order, EthoSolar reserves the right to retain up to the full deposit depending on the stage of installation. 6 Schedule "B" to Development Approval & Planning Policy Report DP-2015-077 Page 7 of 11 MicroFIT Solar System Proposal 3. When the project is delivered and is mechanically installed on the Purchaser’s site, although not electrically tied to the grid, an additional 60% of the Contract or &32.;42022 is due. 4. Once all electrical components and metering are completed to the satisfaction of the local ESA inspector the final payment of the remaining 10% less the initial $1,500 deposit or &542022 will be due within 21 days. (HST for the total project to be added to this final payment). ** Overdue accounts will be charged 2% interest per month or 24% per annum starting 30 days from invoice date. ** If the total due is not received within 90 days of invoice date, EthoSolar reserves the right to enter onto the property and reclaim part or all of the PV System and its components to settle the outstanding account. ** EthoSolar offers a money-back guarantee for Purchaser that is not granted a microFIT contract by the IESO provided that installation has not yet begun and system can be re-sold. In the case that installation has already begun, EthoSolar will refund to the Purchaser their deposit minus time and material. ** All invoices from EthoSolar will be submitted to the email of the Purchaser identified on the cover page of this document. VI. Documents EthoSolar may accept a signed copy of this Contract by the Purchaser as an acceptance and Notice to Proceed (NTP) document. By signing this Agreement, You agree that You have read and accepted all the Terms and Conditions of this Agreement and authorize EthoSolar to proceed with Engineering, Procurement and Construction of the Solar PV as described in this Agreement. You acknowledge that certain obligations exist between You and EthoSolar as reflected in the Terms and Conditions of this Agreement. You further agree to the indicated location and roof planes shown on PV System Design, Equipment & Warranty Information (Schedule A) for the proposed solar PV array layout.
