Important Notice to Bidders
1. The attention of prospective purchasers is drawn to the general and special conditions of sale which are available for inspection
at the office of the Vendors Solicitors and at the office of the Auctioneers, plus any addendums that are issued prior to or on the
night of the auction.
2. Prospective purchasers shall be deemed to have inspected the relevant property. The vendor’s solicitors will provide a contract
pack including the usual necessary searches and enquiries with all relevant authorities and other bodies. This is available for
inspection at the Auctioneers office, during normal business hours. It is advisable to arrange for a survey of the property prior to
the Auction.
3. As soon as the Auctioneers gavel falls on a bid, the successful bidder is under a binding contract to purchase the relevant property.
The purchaser is immediately at risk in relation to the property and should therefore have confirmed bank or building society finance
arranged (if required) and will also be deemed to have made prior arrangements for any insurance cover that is required.
Completion will occur 28 days after exchange, unless otherwise specified.
4. On a property being knocked down, the successful bidder must immediately present to the Auctioneers Clerk his name and
address and if appropriate, the name and address of the person or company on whose behalf he has been bidding, also the
2 forms of identification requested concerning the Money Laundering Act 2007 - this information is detailed separately.
5. The successful bidder must sign and exchange contracts with the Vendors Solicitors prior to leaving the room and at the same
time pay to the Solicitor a deposit of 10% of the purchase price plus the Buyer’s Premium. In default of any of the above,
the Auctioneer shall be entitled as Agent for the Vendors, to treat the failure or default as repudiation and rescind the contract.
Thereafter the Auctioneer shall be entitled to re-submit the property for sale and if a successful bidder does not pay a deposit
and/or complete the memorandum the Vendor reserves the right to claim any loss he suffers as a result.
6. The Vendor has a right to sell before Auction or withdraw the Lot and neither the Auctioneer nor the Vendor is responsible for any
abortive costs, loss or damages incurred by a prospective purchaser in these circumstances. Information as to prior sale or the
withdrawal of a Lot can be obtained from the Auctioneers at any time prior to the Auction but vaild only at the time of enquiry.
7. Prospective purchasers are strongly advised to check any sales particulars as to measurements, areas and all other matters to
which the properties are expressed to be subject to and have the benefit of. In respect of any contents,fixtures and fittings,
expressed to be included within the sale an inspection of the property must be made, and the Legal Information provided by the
vendors solicitors must be inspected. All measurements and areas referred to in this catalogue are approximate only.
8. All location plans published in the particulars of sale are to enable prospective purchasers to locate the property only. The plans
are photographically reproduced and therefore not to scale and are not intended to depict the interest to be sold but are for

accordance with the requirements on guidance notes of relevant professional bodies or other authorities. In all respects prospective
purchasers are deemed to have relied upon their own knowledge or the advice of their own professional or other advisors.
10. Guide Price ranges are provided as an indication of the sellers minimum expectations. They are not necessarily figures that the
property will sell for and may change at any time prior to the auction. Each property will be subject to a Reserve Price which is
the figure below which the auctioneer cannot sell the property below, at auction. The reserve price will be no higher than the upper
end of the Guide Price range.
11. Bids may be refused at the Auctioneer’s discretion. The Auctioneers reserve the right to bid on behalf of the Vendor up to the
reserve.
12. Inspection of investment properties is courtesy of the tenant. Inspection of properties with vacant possession only by arrangement
with the Auctioneers. Interested parties should ring the office to discuss viewing arrangements or book keys before making their
journey.
13. Properties sold at auction are not normally cleared of furniture and effects on completion.

Frequently Asked Questions
What is a guide price?
The guide price is an indication of the sellers’ minimum expectation. It is not a valuation or a figure at which a lot will sell for
and may change at any time prior to auction.
What is a reserve price?
Each Lot will be offered subject to a reserve. This is the figure below which the auctioneer cannot sell the lot. The reserve
will be set within the guide price range and will be no higher than the upper end of the guide price range.
Can I view the property before the auction?
Yes of course, just visit our web site or call our office to arrange a viewing.
Can I get a survey done on the property prior to the auction?
If you require a survey, your surveyor should contact us for access.
Do I need a solicitor?
Yes you do! You can choose to appoint a solicitor prior to the auction to review the Legal Pack on your behalf. If you are the
successful bidder, you will be required to provide details of your solicitor on the night of the auction, as you will need legal
representation to deal with the completion of your purchase.
Do I need to register to bid at auction?
There is no requirement to pre-register for the auction.
What if I can’t attend the auction - can I still bid?
We strongly advise you to attend the auction but for those who are unable, we provide a remote bidding service by telephone
or proxy bid. Telephone/proxy bidding forms are available within the catalogue. The completed form must be returned to
Loveitts Coventry office not less than 2 working days prior to the auction, together with payment for the 10% deposit and
the Buyers’ Premium.
Can someone else bid on my behalf on the night?
Yes, however they must bring with them 2 forms of ID for themselves in addition to your 2 forms of ID. They will also
need a Letter of Authority from you. It must be noted that should you default, the bidder will be liable.
What do I need to bring with me to the auction?
You must bring with you 2 forms of ID, something that has your photo on it, (passport or photo card style driving licence),
plus proof of address (recent utility bill or bank statement). Without your 2 forms of ID you will be unable to bid at the
auction. Only original documents will be accepted. ID is required by anyone who will be signing the contract.
Are there any other costs involved?
Successful bidders will be liable to pay a Buyers Premium as indicated in the catalogue. You will usually be required to pay
for the legal searches, as per the solicitors Legal pack, plus any other costs that the sellers’ solicitors has added into the
contract (if any). It is essential therefore that you have read the legal documents prior to the auction.
If I am a successful purchaser, when do I need to pay the balance of the
purchase price and complete the sale?
The remainder of the monies are payable no later than 28 days after the night of the auction (unless stated otherwise in the
contract), this is when completion will take place, and the property becomes yours.
What happens if I change my mind after winning a bid?
On the fall of the hammer you enter into a binding contract. If you fail to complete on time you may lose the property and
your deposit. You will be in breach of contract and risk being sued by the seller.
Who insures the property following the auction?
The responsibility of insuring the property from the night will be as per the solicitor’s Legal Pack for each individual property.

hand personally so that it is received not less than 48 hours prior to the time of the commencement of the auction at which the particular
property is to be sold. It is your responsibility to ensure the form has been received by Sally Smith.
5.
No alteration to any Telephone/Proxy bidding form will be accepted after it is received by the auctioneer.
6.
The prospective Buyer should send with the Telephone/Proxy form a valid cheque or banker’s draft drawn on a United Kingdom branch
and payable to Loveitts Ltd or payment may be taken by debit card representing the 10% (minimum £2,000) of the maximum price to
which the prospective Buyer wishes to bid. Where the particular lot is purchased below the maximum bid figure the balance of the deposit
will be considered as an additional deposit towards the purchase price.
7.
The prospective Buyer appoints the auctioneer as agent and authorises the auctioneer to bid for the relevant lot on behalf of the
prospective Buyer in such manner as the auctioneer thinks fit in his absolute discretion.
8.
The prospective Buyer shall be considered to have inspected the auction catalogue and the general and separate special conditions of
sale and notices to prospective Buyers for the relevant lot and to have full knowledge thereof and authorises the auctioneer or any duly
authorised partner or employee of Loveitts as the prospective purchasers agents to sign the memorandum of contract incorporating all
such matters at or after the auction.
9.
In the case of a telephone bid, the prospective buyer should provide a signed blank cheque which the auctioneer will complete on behalf
of the prospective buyer (for 10% of the purchase price, minimum £2,000) if the prospective buyer is successful in purchasing the relevant
property.
10. The prospective purchaser may in writing only at any time up to the commencement of the auction in which the particular lot is to be
sold withdraw the auctioneer’s authority to bid. It is the prospective purchaser’s responsibility to ensure that the auctioneer personally
receives such instructions and he should check to ensure such instructions have been received.
11. The amount of the prospective purchasers bid will not be disclosed to the vendor or any other person either during or after the sale
without the consent of the prospective Buyer.
12. The auctioneer reserves the right to bid himself or through an agent up to the reserve price for the particular lot.
13. Prospective Buyers are advised to telephone Loveitts on the day of the auction to ensure that there are no amendments to the particulars
of sale or conditions relating to the relevant lot or other matters relating to it. The prospective Buyer will be deemed to have knowledge
of such amendments and will buy subject to them in any event. If the prospective Buyer does not telephone and such amendments
have been made, the auctioneer may in his absolute discretion decide not to bid for the relevant lot on the prospective Buyer’s behalf
and the auctioneers will not be responsible for any loss, costs or damages incurred by the prospective Buyer as a result thereof.
14. Should the prospective Buyer wish to bid at the auction in person or through an agent, such intention must be conveyed in writing to the
auctioneer in person prior to the lot being offered for sale. In this case the auctioneer will not make any bids on behalf of the prospective
Buyer.
15. The auctioneer will make no charge to a prospective purchaser for this service and will accept no liability whatsoever for any bid not
being made on behalf of the prospective purchaser whether through lack of clarity of instructions or for any other reason whatsoever.
The prospective purchaser will be advised if the relevant lot has been successfully purchased on his behalf as soon as possible after
the auction. Where the lot has not been purchased the prospective purchaser will be notified by post and the deposit returned as soon
as possible.
16. Prospective Bidders are advised in respect of telephone bids that should they become disconnected during bidding or are unobtainable,
Loveitts will not be held responsible or liable for any loss suffered in respect thereof.
17. The successful buyer or bidder will be jointly and severally liable to pay Loveitts the buyer’s fee referred to in the Important Notice to
Prospective Buyers at the front of the Auction Catalogue.
18. The auctioneer will make no charge as to the prospective buyer for this service, and will accept no liability whatsoever for any bid not
being made on behalf of the prospective buyer for any reason whatsoever.
