STM OPEN ACCESS LICENCE B version 1.00 SOME COMMERCIAL USE RIGHTS AND TRANSLATION AND TEXT AND DATA MINING RIGHT ADDED Agreeing to the Publisher’s licence enables the Licensee (“Researcher”) to: • Commercially Use and Share the Work/Licensed Material other than for reserved commercial purposes (listed below). • Translate the Work/Licensed Material faithfully for purposes other than reserved commercial purposes, as long as Licensee translates the Work into any language faithfully rendering its meaning context and significance and the translation must be accompanied by a notice stating that it is an unofficial and unauthorised translation, provided further Licensee agrees to notify the Publisher in writing and to grant a non-exclusive Licence back to the Publisher for any and all uses of the translation. • Text and Data Mine (TDM) the Work/Licensed Material for purposes other than reserved commercial purposes (as defined below) and to engage in certain re-use rights with the outcomes of any TDM process in the following ways: TDM by loading and technically format the Work/Licensed Material on the Licensee’s server for purposes of classification or recognition of relations and associations by the Licensee using automated programs or devices to download, index extract semantic entities, derive patterns and for the Licensee to evaluate and interpret any TDM Output for access and use by Licensee, but without creating Adapted Material, product or service that competes with the Work/Licensed Material. • With the understanding that: Waiver— Any of the above conditions can be waived if you get prior written permission from the copyright holder. Public Domain— Where the work or any of its elements is in the public domain under applicable law, that status is in no way affected by this user licence Definitions— “Text and Data Mining” means to perform extensive automated searches of Licensed Materials, including data embodied therein, the sorting, parsing, addition or removal of linguistic structures, and the selection and inclusion of subscribed content into an index or database for purposes of classification or recognition of relations and associations. “TDM Output” means the result of any Text and Data Mining activity or operation, capable of fixation, reproduction and/or communication in any form which is based on Licensed Material. Interpretation— Any term defined in a licence applied to Licensed Materials, such as the Creative Commons NonCommerical Non Derivative (version 4.0) International license, or the STM non-commercial licence (version 1.0) shall have the same meaning in relation to the researcher rights added herewith. The terms and conditions of any other licence applied by the publisher to Licensed Materials shall prevail in case of conflict with any rights added in favour of or obligations created for any researcher under this Researcher Rights Added licence. • Reservation of Rights for certain Commercial Purposes Commercial User Rights are granted as part of this licence by the Publisher to you, the Licensee, unless they are “Reserved Commercial Rights” (RCR). RCR are specifically excluded from this Licence, but may be available on request from the Publisher. RCR are uses of the Work for the purposes or in the way described below: -­‐ the sale of reprints or copies in any manner or form. -­‐ The provision of reprints or copies in the course of selling educational or information services of the user. -­‐ the distribution of reprints for advertising or marketing of the user’s products or services or corporate identity -­‐ the provision of sponsored access to licensed materials to customers or end-users of the products or services offered by the user. -­‐ The sale or distribution of any translation of the Work for money or money’s worth or for advertising, marketing or promotion of company products or services. ***
